This property is owned by Garner Environmental Services, Inc., who has leased it for the cell tower location. This property is located in an Industrial (1) zoned district and the tower land use is allowed by right in an "I" district. As such, no Specific Use Permit or other zoning change is necessary for construction of the tower since the structure satisfies all the distance requirements set forth in the City's Zoning Ordinance. In the Zoning Ordinance Special Conditions, a cell tower "shall be [no] closer to any residential district boundary line than a distance equal to the sum of the required yard setback specified for the zoning district in which such structure is located, plus 25 feet, plus twice the height of the portion of the structure above two stories (23 feet). Such distance shall be measured as the shortest possible distance in a straight line from the structure to the closest point of a residential district boundary line." The setback distance is specified to be a residential front yard setback, which is 20 feet. As such, the formula is as follows: 5+25+2060-23)=287 ft. The proposed structure is actually 325 feet from the nearest residentially zoned district: therefore, it is more than the minimum required distance from the nearest residentially - zoned district in all directions. The above equation was devised by former City Attorney Mark Sokolow as a method to only allow cell towers to be located in commercially -zoned districts. The previous permit process required all cell towers to receive Specific Use Permits (SUPS) and any wishing to locate in residentially -zoned districts created a great deal of animosity from nearby 1 residents. Sokolow's equation requires towers to be quite a distance from residential districts, but allows the location "by right" when the distance requirement is met.
