Director of Public Works P.O. #5227 May 17, 2002 RECOMMENDATION It is recommended that the City Council approve Proposed Ordinance No. 5227 prescribing various speed limits on Highway 69 from the City limits north of Aero Drive to Gulfway Drive {State Highway 87} in accordance with Section 106-143- Speed on State Highways of Division 4-Speed of Chapter 106 of the Code of Ordinances. BACKGROUND At the request of thc City Council in 1999, the Texas Department of Transportation (TXDOT) conducted a speed zone survey on Highway 69 from the City limits north of Aero Drive to Gulfway Drive {State Highway 87}. Staff indicated at the time that increases in speed limits, rather than the reduction of same, would likely be shown by the study to be done by TXDOT. An increase in the current speed limits was shown to be necessary, based on the eighty-five percentile speed, and traffic and engineering investigations made by TXDOT, in conformance with State law and City ordinances (Sec. 106-143). Through additional review and investigation by TXDOT and City representatives, the limits of the speed limit changes were altered to provide a more reasonable transition between zones. In addition, City forces have rebuilt the 39th Street traffic signal (raised, back plates) to provide a better advance view of it from the north. The signal also now has five (5) seconds of all-red time for northbound and southbound traffic. In conjunction with the speed limit increase, the fines for violation of any provision of this section of the ordinance shall be from One ($1.00) Dollar to not more than Five-Hundred ($500.00) Dollars per violation. AN ORDINANCE PRESCRIBING VARIOUS SPEED LIMITS ON HIGHWAY 69 FROM THE CITY LIMITS NORTH OF AERO DRIVE TO GULFWAY DRIVE {STATE HIGHWAY 87} IN ACCORDANCE WITH SECTION 106-143-SPEED ON STATE HIGHWAYS OF DMSION 4-SPEED OF CHAPTER 105 OF THE CODE OF ORDINANCES; PROVIDING A PENALTY NOT EXCEEDING FIVE HUNDRED {$500.00~ DOLLARS FOR ITS VIOLATION; AND PROVIDING FOR PUBLICATION AND EFFECTIVE IMMEDIATELY AFTER PUBLICATION DATE. WHEREAS, the Texas Department of Transportation {TXDOT} has recently conducted a speed zone survey on Highway 59 from the City limits north of Aero Drive to Gulfway Drive {State Highway 87); and, WHEREAS~ increases in speed limits on certain sections and continuation of the current speed limits on certain sections of Highway 69 has been proven to be necessary, based on the eighty-five percentile speed, and traffic and engineering investigations made by TXDOT; and, WHEREAS~ the speed limit changes or maintenance on Highway 69 is denoted on the TXDOT Speed Zone Strip Map dated August 20-26, 1999 {updated in April, 2002}, a copy of said map being attached hereto and made a part hereof by reference as Exhibit "A' and on a summary map attached hereto and made a part hereof as Exhibit "B'; now therefore, P.O. #5227 Pa~e #2 BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR~ TEXAS: Section 1. The maximum speed limits on Hi§hway 69 from the City limits north of Aero Drive {M.P. 13.064) to Gulfway Drive {State Hi§hway 87, M.P. 19.338) shall be as follows in accordance with TXDOT's Speed Zone Strip Map dated August 20-26, 1999 and revised in April, 2002: 70 MPH Viterbo Ditch M.P. 13.064 to near Highway 73 M.P. 17.127 65 MPH Near Highway 73 M.P. 17.127 to Texaco Canal {north of 39th Street) M.P. 17.560 55 MPH Texaco Canal (north of 39m Street) M.P. 17.560 to 39th Street M.P. 17.729 50 MPH 39th Street M.P. 17.729 to near 29th Street M.P. 18.413 45 MPH Near 29th Street M.P. 18.413 to Commerce Street M.P. 19.036 40 MPH Commerce Street M.P. 19.036 to Gulfway Drive (S.H. 87) M.P. 19.338 Section 2. All required regulatory speed limit signs indicating the new speed limits shall be installed and maintained on Highway 69 by the Texas Department of Transportation; Section 3. If any portion of this Ordinance shall, for any reason, be declared invalid by any court of competent jurisdiction, the invalidity shall not affect the remaining provisions hereof. P.O. Any person who violates any provision of this Ordinance or who shall neglect to comply with the terms hereof shall be deemed guilty of a misdemeanor and shall on conviction thereof be fined in any sum not less than One ($1.00) Dollar nor more than Five Hundred ($500.00) Dollars as provided in the Code of Ordinances, and each violation shall constitute a separate offense. Section 5. All Ordinances and part of Ordinances in conflict herewith are hereby repealed but only to the extent of the conflict. Section 6. This Ordinance or its caption and penalty shall be published one {1) time within Ten {10) days after final passage hereof in the official newspaper of the City of Port Arthur. This Ordinance shall take effect immediately after date of publication.
