The property in question is the former fire station #5. The station was bid originally in 1996. At that time the city chose to lease the property rather than sell. The lease has expired and we need to sell the property. We are recommending that the property be bid "as is" and with no conditions on its use. On April 6, 2000 the City sold property on Procter Street. The sale included conditions for use which included economic development purposes, etc. (See Ordinance 99-54 attached.) The purchaser has not met those conditions and now we are in a difficult legal situation. After bids are received, the sale will come before Council for approval. To sell the property, it will require an Ordinance passed by a recorded affirmative vote of 2/3 of all the members of the Council. P. R. NO. 11782 JJA: 5/14/02 RESOLUTION NO. A RESOLUTION AUTHORIZING THE CITY MANAGER TO SEEK BIDS FOR THE CASH SALE OF CITY PROPERTY LOCATED AT 3801 LEWIS DRIVE WHEREAS, on May 1, 1993 the voters authorized the City of Port Arthur to sell the Fire Station #5 property located at 3801 Lewis Drive, WHEREAS, on March 20, 1996 the property appraised at $35,000, WHEREAS, on May 22, 1996 the City received bids for the sale of the property, WHEREAS, On August 20, 1996 the City Council rejected the bids and adopted Resolution 96-165 which authorized the lease of the property, WHEREAS, said lease expired on September 1, 2001 and the building has been vacated. BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR: Section 1. That the facts in the preamble are tree and correct. Section 2.
