PO 6538: AMENDING THE CTIY OF PORT ARTHUR BUDGET

Dale, Finance Director r RE: Mid-Year Budget Amendment Nature of the request: During the first six months of this fiscal year several resolutions, requiring funding, have been taken before the City Council and approved, which although funding was available, a formal appropriation adjusting the budget was not presented nor was action taken. Staff Analysis, Considerations: Rather than do one at a time, it was determined that all be included in one appropriation ordinance at mid-year for the City Council to approve. Recommendation: The attached Proposed Ordinance No. 6538 does just that and we are recommending that the City Council approve it as presented. Budget Considerations: As shown. AN APPROPRIATION ORDINANCE AMENDING THE CITY OF PORT ARTHUR BUDGET FOR THE FISCAL YEAR BEGINNING OCTOBER 1, 2015 AND ENDING SEPTEMBER 30, 2016 BY $731,707.00 FOR THE GENERAL FUND, ($335,655.00) FOR THE WATER AND SEWER FUND, ($832,193.00) FOR THE SOLID WASTE FUND, $2,712,632.00 FOR THE EQUIPMENT REPLACEMENT FUND, $11,000.00 FOR THE OTHER EMPLOYEE BENEFITS FUND, AND $13,000.00 FOR THE HOTEL OCCUPANCY TAX FUND AS SHOWN IN EXHIBIT A. WHEREAS, in accordance with Article XII, Section 9, of the City Charter, the City Council may make emergency appropriations from time to time; and WHEREAS,the City Council may make budget amendments for emergencies pursuant to Section 102.009 and for Municipal purposes under Section 102.010 Local Government Code; WHEREAS, on September 21, 2015, the City Council approved and adopted Ordinance 15-43 which appropriated the 2015-2016 budget; and WHEREAS, there have been unanticipated costs increases in the General Fund, Equipment Replacement Fund, Other Employee Benefits, and in the Hotel Occupancy Tax Fund. Additionally, there are decreases in the Water and Sewer Fund and in the Solid Waste Fund. WHEREAS, these amendments are necessary for municipal purposes to meet unusual and unforeseen emergency conditions as delineated in Section 102.009 (c)of the Texas Local Government Code. NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR: Section 1. That the facts and opinions in the preamble are true and correct. Section 2. That Section 6 of Ordinance 15-43 be amended to read: That there be and is hereby appropriated the sum of Twenty-Three Million, Three Hundred Seventy-Four Thousand, Six Hundred Sixty-Seven Dollars ($23,374,667) to the Water and Sewer Fund for the payment of the Operating Expenses and necessary Capital Outlay for the Water and Sewer Department. Section 5. That Section 7 of Ordinance 15-43 be amended to read: That there be and is hereby appropriated the sum of Nine Million, Eighty-Five Thousand, One Hundred Fifty-One Dollars ($9,085,151) to the Solid Waste Fund for the payment of the Operating Expenses and necessary Capital Outlay for the Solid Waste Department. Section 6. That Section 9 of Ordinance 15-43 be amended to read: That there be and is hereby appropriated the sum of Two Million, Seven Hundred Twelve Thousand, Six Hundred Thirty-Two Dollars ($2,712,632) to the Equipment Replacement Fund for the purchase of capital equipment. Section 7. That Section 12 of Ordinance 15-43 be amended to read: That there be and is hereby appropriated the sum of Seven Hundred Fifty-Five Thousand, Five Hundred Dollars ($755,500) to the Other Employee Benefits Fund for the payment of Accrued Absences and Other Employee Benefits. Section 8. That Section 15 of Ordinance 15-43 be amended to read: That there be and is hereby appropriated the sum of One Million,Ninety-Four Thousand, One Hundred Thirty-Six Dollars ($1,094,136) to the Hotel Occupancy Tax Fund for the payment of eligible expenses. Section 9. That a copy of the caption of this Ordinance be spread upon the minutes of the City Council. Section 10. That this Ordinance shall be effective immediately.
