DATE: 04/16/2015 BACKGROUND: On February 5, 2014, The Planning and Zoning Commission approved the preliminary plat for Edison Square - Phase I. In accordance with Chapter 98, Section 98-182(c) of the Port Arthur Subdivision Ordinance, "When a preliminary plat has been approved and thereafter the subdivider fails to file a final plat of the subdivision or a section of such plat within a period of six months, the approval of the preliminary plat shall expire and have no further force of effect... " Therefore, a new application is being submitted for the Commission's consideration and approval. NATURE OF REQUEST: The Planning and Zoning Commission is being asked to consider a preliminary plat for Edison Square, Phase I. The site is located north of 12'h Street, south of le Street, and between 6rh Avenue and 8`h Avenue. This subdivision is located in Planned Development District — 36 (PD - 36), which allows for MF, or Multi -Family Residential, development. This preliminary plat divides the former Edison school tract into lots for 2F, or Two -Family, duplex development, which was allowed by right before the zoning was changed by City Council action on July 9, 2013. The entire 15.245 acre tract is surrounded by 2F zoning. The preliminary plat calls for the completion of the public infrastructure (water, sanitary and storm sewer), other utilities, and the private streets built to city standards. Upon completion and acceptance of the infrastructure, the entire development will be submitted for P&Z approval. The final plat will be filed with the Jefferson County Clerk's Office. Several pre -development meetings on this development plan and all city departments have identified necessary changes and given approval of this preliminary plat as submitted to the P&Z Commission. Owner - Port Arthur Housing Authority Agent/Developer - Port Arthur Housing Initiative II, LP Engineer/Surveyor - Soutex Surveyors, Inc. RECOMMENDATION: The planning staff has no objections to this request for preliminary subdivision plat approval. The final plat for the completed development cannot be submitted until all stages of drainage, water and sewer improvements are accepted for maintenance by the City in the manner described above. BUDGETARY/FISCAL EFFECT: None STAFFING/EMPLOYEE EFFECT: None SUMMARY: The preliminary plat should be approved as submitted. Any change in layout that will affect setbacks, water or sewer features or traffic flow shall be noted as a new/amended plat and resubmitted to the Planning and Zoning Commission for approval. 2 Sec. 98-182. - Approval of preliminary plat. (a) The commission shall render a decision within 30 days from the date the plat and other information was submitted to the commission by the director of planning. Such decision shall consist of approval or disapproval. All objections made to the preliminary plat shall be furnished the subdivider in writing. (b) When a preliminary plat has been approved, the subdivider may thereafter file a final plat of sections of the proposed subdivision upon which approval of the preliminary plat has been obtained, and, upon the approval of a final plat covering a portion of such subdivision, the remainder of the preliminary plat shall be deemed as approved as in subsection (a) of this section; provided, however, that such approval of the remainder of the preliminary plat shall be limited to a one-year period from the date of final approval of a section of such plat.
