RE: Proposed Ordinance No. 6550
Nature of the Request:
This is a companion appropriation to P.R. 19380 in which The Parks and Recreation
Department is requesting approval of a professional services contract for the capital
improvement project for the design and construction of the Peoples Park and Pavilion. The
professional services contract includes the cost for the architectural firm and low bidder for
construction. The total project cost of$972,800, also includes funds for the 10% contingency
required by the City, ADA Review, and Site Concrete Testing. The City is funding a Match in
the amount of $362,800 as additional funding support to the EDC's appropriated funding of
$600,000, and a$10,000 donation from the Port Arthur Mardi Gras Planning Committee.
Staff Analysis, Considerations:
The General Liability Fund has built up a level of net assets in excess of what is needed in
that fund.
Recommendation:
I recommend that the City Council approve Proposed Ordinance No. 6550 authorizing a budget
amendment in the General Liability Insurance Fund to fund the City's portion, $362,800 of the
total project cost of$972,800 from the General Liability Fund.
Budget Considerations:
This Capital Improvement Project will be charged to the Economic Development Corporation
Fund No.: 120-1429-582.59-05; - 4B Development. Project Number: will be ordinance
number upon approval by City Council.

AN APPROPRIATION ORDINANCE AMENDING THE CITY OF PORT
ARTHUR BUDGET FOR THE FISCAL YEAR BEGINNING OCTOBER 1,
2015 AND ENDING SEPTEMBER 30, 2016 BY $372,800.00 TO FUND A 4B
DEVELOPMENT PROJECT FOR PEOPLE'S PARK AND CAPITAL
IMPROVEMENT PROJECT, INCREASING TRANSFERS-OUT OF THE
GENERAL LIABILITY INSURANCE FUND BY $362,800.00 INTO THE
ECONOMIC DEVELOPMENT CORPORATION FUND, RECOGNIZING
A CONTRIBUTION FROM THE MARDI GRAS PLANNING
COMMITTEE IN THE AMOUNT OF $10,000.00, FOR THE FUNDING OF
THE CONTRACT FOR ARCHITECTURAL PROFESSIONAL SERVICES
IN THE AMOUNT OF $972,800.00 WITH $600,000.00 APPROPRIATED
IN THE ECONOMIC DEVELOPMENT CORPORATION FUND 4B
DEVELOPMENT ACCOUNT. FUNDS ARE AVAILABLE IN ACCOUNT
NUMBER: 120-1429-582.59-05-4B DEVELOPMENT, ECONOMIC
DEVELOPMENT CORPORATION FUND.
WHEREAS, in accordance with Article XII, Section 9, of the City Charter, the City
Council may make emergency appropriations from time to time; and
WHEREAS, the City Council may make budget amendments for emergencies under
Section 102.009 and for Municipal purposes under Section 102.010 Local Government Code;
and
WHEREAS, on September 21, 2015, the City Council approved and adopted Ordinance
15-44 which appropriated the 2015-2016 Economic Development Corporation budget; and
WHEREAS, on November 10, 2015,the City Council approved and adopted Ordinance
15-52 which amended the original Economic Development Corporation Fund appropriation for
the 2015-2016 EDC budget; and
WHEREAS, on May 3, 2016, P.R. No. 19380 is on the City Council Agenda for
approval, which requires a formal appropriation,through a budget amendment.
NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF PORT ARTHUR:
Section 1. That the facts and opinions in the preamble are true and correct.
Section 2. That the following funds/departments Budget be increased/ (decreased) as
shown:
General Liability Fund (Transfer-Out) $ 362.800
Economic Development Fund Transfer-In $ 362,800
Contribution from Mardi Gras Committee $ 10,000
Economic Development Corporation Fund
EDC Fund $ 372,800

Section 3. That Section 13 of Ordinance 15-43 be amended to read:
That there be and is hereby appropriated the sum of Three Hundred Seventy-Two
Thousand, Eight Hundred Dollars ($372,800) to Economic Development Corporation Fund for
the payment of the eligible expenses for the Peoples Park and Pavilion Capital Improvement
Project.
Section 4. That a copy of the caption of this Ordinance be spread upon the minutes of
the City Council.
Section 5. That this Ordinance shall be effective immediately.
