A RESOLUTION AUTHORIZING THE EXECUTION OF A MEMORANDUM OF UNDERSTANDING BETWEEN ANCHOR HOTELS, LLC, AND THE CITY OF PORT ARTHUR TO SHARE IN THE COST FOR A WATERLINE RELOCATION PROJECT. THE CITY' S PROJECT COST FOR SAID PROJECT IS $33, 000 . 00; FUNDS ARE AVAILABLE IN ACCOUNT NUMBER 410-1253-532 . 35-00 . WHEREAS, Anchor Hotels, LLC is the owner of certain real property located near Hwy. 69 and Jimmy Johnson Boulevard. Said owner has begun new construction of a Days Inn motel on the tract depicted in Exhibit "A" ; and WHEREAS, in conjunction with the construction of the motel, it was discovered that a City owned waterline is encroaching upon the above referenced tract; and WHEREAS, there is a need to appropriately relocate the waterline away from the building and within the boundaries of a properly executed utility easement as depicted in Exhibit "B" ; and WHEREAS, quotes were solicited by the City and the cost of said relocation is $48 , 000; and WHEREAS, Anchor Hotels, LLC has agreed to contribute $15, 000 toward the cost of the relocation; and WHEREAS, upon the completion of the relocation project, Anchor Hotels, LLC, will grant the City a permanent waterline easement for s.pr19387 the relocation of the existing waterline and for any future maintenance. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR: Section 1 . That the facts and opinions in the preamble are true and correct . Section 2 . That City Council hereby authorizes the City Manager to execute an MOU with Anchor Hotels, LLC, as delineated in Exhibit "C", to share in the cost of a waterline relocation project . The City' s share will be $33, 000 and the developer' s cost will be $15, 000 . Section 3. That a copy of the caption of this Resolution shall be spread upon the Minutes of the City Council . WHEREAS, ANCHOR HOTELS, LLC ( "DEVELOPER" ) is the owner of certain real property located near Hwy. 69 and Jimmy Johnson Boulevard. Said owner has begun new construction of a Days Inn motel on the tract depicted in Exhibit "A" ; and WHEREAS, the CITY OF PORT ARTHUR ( "CITY" ) is a home rule municipality, acting by and through its City Manager; and WHEREAS, in conjunction with the new construction of the motel, it was discovered that a City owned waterline is encroaching upon the above referenced tract; and WHEREAS, there is an immediate need to appropriately relocate the waterline away from the building and within the boundaries of a properly executed utility easement as depicted in Exhibit "B" ; and WHEREAS, quotes were solicited by the City and the cost of said relocation is $48, 000 ; and WHEREAS, the Developer and the City desire to enter into an agreement regarding the costs associated with relocation of the waterline . NOW THEREFORE, in consideration of the premises and covenants contained herein the parties have agreed as follows : 1 . Developer agrees to grant to City and City' s employees and contractors a non-exclusive temporary construction easement over and across the Developer' s Tract as may be reasonably needed for relocation of the subject waterline . 2 . Developer agrees to grant to City without charge a permanent utility easement that is necessary for the relocation of the existing waterline . 3 . City shall be responsible for providing all labor and materials required to relocate the waterline . 4 . City shall be responsible for payment of the costs to any third-party contractor for relocating the waterline. Developer shall pay to City upon completion a total of $15, 000 . 00 towards the costs associated with the relocation of the waterline . 5 . This Agreement may be executed in any number of counter- parts, all of which shall constitute one and the same instrument, and any party hereto may execute this Agreement by signing and delivering one or more counterparts .
