R. No. 19467 authorizing the City Manager to execute the second year (first renewal) agreement with the option to renew for one (1) additional year with Witt O'Brien Response Management of Fort Lauderdale, Florida for debris monitoring services for the City of Port Arthur, Texas. BACKGROUND It is in the best interest of the City of Port Arthur, Texas to have a service in place for debris monitoring services as required by FEMA in the event of an emergency or a disaster. Per Resolution 15-311,the City entered into an agreement with Witt O'Brien, LLC for a one (1) year term, with the option of renewing for two (2) additional one(1)year terms. BUDGET/FISCAL EFFECT Funding will be provided for in the appropriate disaster/emergency recovery project accounts. STAFFING/EMPLOYEE EFFECT None SUMMARY I recommend that the City Council approve P. R. No. 19467 authorizing the City Manager to execute the second year (first renewal) agreement with the option to renew for one (1) additional year with Witt O'Brien Response Management of Fort Lauderdale, Florida for debris monitoring services for the City of Port Arthur,Texas. A RESOLUTION AUTHORIZING THE SECOND YEAR (FIRST RENEWAL) OF THE AGREEMENT WITH WITT O'BRIEN'S, LLC OF FORT LAUDERDALE, FLORIDA FOR DEBRIS MONITORING SERVICES FOR THE CITY OF PORT ARTHUR IN THE EVENT OF AN EMERGENCY OR DISASTER. WHEREAS, it is deemed in the best interest of the City of Port Arthur to have a service in place for Debris Monitoring Services as required by FEMA in the event of an emergency or a disaster; and, WHEREAS, per Resolution 15-311, the City entered into an agreement with Witt O'Brien's, LLC for a one (1) year term, with the option of renewing for two (2) additional one (1) year terms; and, WHEREAS, the City desires to enter into an additional one (1) year (first renewal) agreement, with the option of renewing for one (1) additional year with Witt O'Brien's of Fort Lauderdale, Florida as delineated in Exhibit "A"; now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR: THAT, the facts and opinions in the preamble are true and correct. THAT, the City Manager is hereby authorized to execute a second year (first renewal) of the contract with Witt O'Brien's, LLC of Fort Lauderdale, Florida (attached as Exhibit "A") for the Debris Monitoring Services for the City of Port Arthur with the option to renew the contract for one (1) additional year. THAT, a copy of the caption of this Resolution be spread upon the Minutes of the City Council. Baah th, Sr. City Manager Interim Director of Public Works Jerry Dale, CGFO/CPA t1011, Director of Finance £* EXHIBIT A RENEWAL CONTRACT FOR DEBRIS MONITORING SERVICES FOR THE CITY OF PORT ARTHUR, TEXAS THIS AGREEMENT, made this day of , 2016, by and between the City of Port Arthur, a municipal corporation organized under the laws of the State of Texas, hereinafter called "OWNER" or "CITY", and Witt O'Brien's Response Management, Inc. a(n) corporation herein acting by and through Steve Braham, Executive Vice President hereinafter called "CONTRACTOR". WITNESSED: That, for and in consideration of, the payment terms, conditions, and agreements set forth herein, OWNER and CONTRACTOR agree as follows: 1. The City shall enter into a one-year renewal contract per Resolution No. 15-311. 2. The term of this Contract shall be from September 1, 2016 to August 31, 2017. 3. During the term of this Contract, the CONTRACTOR will furnish at his own expense all of the materials, supplies, tools, equipment, labor, and other services necessary to connection therewith, excepting those supplies specifically not required of CONTRACTOR in the Specifications. 4. The CONTRACTOR agrees to supply the materials described in the specifications and contract documents at the unit prices shown in the original bid. 5. The term "Contract Documents" means and includes the following" a. Agreement b —Rcqucst for Proposal* e—Gcncral Information* 4— e:—Proposal* f—Biddcr's Information Sheet* *These items were attached to the original letting contract. The agreement only is included for this renewal. 6. This Agreement shall be binding upon all parties hereto and their respective heirs, executors, administrators, successors and assigns. 7. IN WITNESS WHEREOF, the parties hereto have executed, or caused to be executed by their duly authorized officials, this Agreement in (2 copies) each of which shall be deemed an original on the date first above written.
