George to continue to act as the City's Health Authority and Supervising Physician of the Employee Health Services Clinic Nature of the Request: Since 1995, Dr. George has been the Health Authority for the City of Port Arthur and the Supervising Physician of the Employee Health Services Clinic since January 2010. He signs all protocols and standing delegation orders, consults with the mid-level provider, reviews charts, and perform other duties as required for the effective management and operation of the clinic. Dr. George became an employee of Southeast Texas Medical Associates (SETMA) in June 2011, but he has agreed to continue providing professional services to the City of Port Arthur. All payments for Dr. George's services are paid to SETMA. Staff Analysis,Considerations: None V Recommendations: It is recommended that the City Council approve Proposed Resolution No. 19487, approving a Contract with Southeast Texas Medical Associates (SETMA) for Dr. William D. George to continue to act as the City's Health Authority and supervising physician of the City's Employee Health Services Clinic. Budget Considerations: Compensation to SETMA on behalf of Dr. George will be paid as follows: $51,600 annually which includes $34,100 paid by health department account number 001-1301-541.54-00; $12,0001for the Employee Health Services, account number 001-1303- 541.54-00; and $5,500 is paid by the Fire Department. A RESOLUTION AUTHORIZING THE CITY MANAGER TO ENTER INTO A CONTRACT BETWEEN THE CITY OF PORT ARTHUR AND SOUTHEAST TEXAS MEDICAL ASSOCIATES (SETMA) FOR WILLIAM D. GEORGE, M.D., TO CONTINUE TO ACT AS THE CITY'S HEALTH AUTHORITY AND SUPERVISING PHYSICIAN OF THE EMPLOYEE HEALTH SERVICES CLINIC WHEREAS, Dr. William D. George has been acting as the Health Authority for the City of Port Arthur since August 1, 1995, and as the Supervising Physician of the City's Employee Health Services Clinic since January 2010; and, WHEREAS, Dr. George is now an employee of SETMA, but he will remain as the City's Health Authority and Supervising Physician; and, WHEREAS, compensation to SETMA will be paid at the same amount that is currently being paid to Dr. George: $51,600 annually which includes $46,100 paid by the Health Department and $5,500 by the Fire Department; now therefore, BE IT RESOLVED BY THE CITY COUNCIL OF PORT ARTHUR: SECTION 1. That, the facts and preamble are true and correct. SECTION 2. That, the City Council of the City of Port Arthur hereby authorizes the City Manager and Director of Health to execute said Contract, a copy of which is attached hereto as Exhibit"A." SECTION 3. That, a copy of the caption of this Resolution be spread upon the Minutes of the City Council. Smith, RN, BSN City Manager P irector of Health Services EXHIBIT "A" CONTRACT FOR INDEPENDENT PROFESSIONAL SERVICES This Agreement is made between the City of Port Arthur, Texas hereinafter referred to as "City" and Southeast Texas Medical Associates (SETMA) herein referred to as "Contractor." I. TERM OF CONTRACT This Contract shall be for a period beginning October 1, 2016 and shall remain in force through September 30, 2017. Thereafter, this Agreement shall be renewed annually at the discretion of the parties. II. PROFESSIONAL SERVICES This Contract will allow for Dr. William D. George, an employee of SETMA, to serve as the City's Health Authority and Supervising Physician of the City's Employee Health Services clinic. As the City's Health Authority, Dr. George shall: 1) Administer state and local laws relating to public health within the City's jurisdiction in accordance with Section 121.021 Texas Health and Safety Code, as amended. 2) Do all things necessary to implement and enforce the law to protect the public health. 3) Perform each duty applicable to the City's jurisdiction as prescribed by the Texas Department of State Health Services (DSHS). 4) Establish, maintain, and enforce quarantine in the City's jurisdiction. 5) Aid the Texas Board of Health and other public health officials in relation to local quarantine, inspection, disease prevention and suppression. birth and death statistics, and general sanitation in the City's jurisdiction. 6) Report as necessary the presence of contagious, infectious and dangerous epidemic diseases to the Texas Board of Health in the manner and at the times prescribed by said board. 7) Perform all acts for the Port Arthur City Health Department which are required by law to be performed by-a licensed physician or which if provided by a person other than a licensed physician would constitute the unlicensed or unlawful practice of medicine. 8) Provide consultant services in policy, planning, procedure, administrative and other matters to the Director of the Health Department as requested by said Director. 9) Provide Medical Director advisory services to the City's Fire Department First Responders Program registered with the Department of State Health Services. 10) Meet with the City's Fire Department representatives on a monthly basis to review emergency medical incidents, exposures and debriefings, establish and review medical protocols, review and make recommendations concerning DSHS certifications and continuing education. 11) Provide professional assistance to the City's Fire Department in administrative matters before boards, DSHS, and the City Council on an as needed basis. As the Supervising Physician of the City's Employee Health Services Clinic, Dr. George shall: 1) Function as the supervising physician of the City's Employee Health Services Clinic. 2) Review patient charts as needed and required. 3) Review and approve all protocols and standing delegation orders/guidelines for the effective operation of the Employee Health Services Clinic to include prescriptive authority for the mid-level provider. 4) Provide consultation as needed to the Employee Health Services Clinic mid-level provider and staff. III. COMPENSATION The Contractor shall be paid One Thousand Dollars ($1,000) per month for services provided for the Employee Health Services Clinic in addition to the Three Thousand, Three Hundred Dollars ($3,300.00) per month for professional services performed as the Health Authority. The hours of work shall be mutually agreed upon by the Director of Health of the City of Port Arthur and the City's Fire Chief. IV. LICENSURE/LIABILITY INSURANCE 1) The Contractor shall provide proof of licensure for Dr. George to practice medicine in the State of Texas. 2) The Contractor shall be covered under the City's liability insurance for services performed as the Health Authority. IV. TERMINATION This Agreement can be terminated with sixty (60) days prior written notice by either party. SIGNED AND AGREED TO on the day of , 2016.
