A RESOLUTION AUTHORIZING THE CITY MANAGER TO ACCEPT THE ARCHITECT'S CERTIFICATES OF SUBSTANTIAL COMPLETION FROM THE LABICHE ARCHITECTURAL GROUP, INC. FOR THE IMPROVEMENTS TO GRIFFING PARK AND HERMAN PARK WHEREAS, per Resolution No. 15-418, the City Council awarded a contract to Deztex Industrial of Port Arthur, Texas, for the improvements to Griffing Park, Herman Park and Rose Hill Park; and, WHEREAS, per Resolution 16-172, the City Council awarded Change Order No. 1 to decrease the contract amount by $23,031.00 to a new contract amount of$497,953.00; and, WHEREAS, the improvements to Griffing Park and Herman Park are now substantially complete and have met all of the required building codes, zoning requirements, inspections, etc., as delineated in the Code of Ordinances of the City of Port Arthur; and, WHEREAS, the City of Port Arthur has been presented a Certificate of Substantial Completion for Griffing Park attached hereto as Exhibit "A" and a Certificate of Substantial Completion for Herman Park attached hereto as Exhibit"B"; and, WHEREAS, staff recommends to City Council that the City Manager be authorized to accept said Certificate of Substantial Completion as delineated herein; now now therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR, TEXAS: Section 1. That the facts and opinions in the preamble are true and correct. Section 2. That the City Manager of the City of Port Arthur is hereby authorized and directed to execute, on behalf of the City of Port Arthur, the Certificate of Substantial Completion for Griffing Park, in substantially the same form as attached hereto as P. R. No. 19484 08/11/16 ca attached hereto as Exhibit "A" and Certificate of Substantial Completion for Herman Park, in substantially the same form as attached hereto as Exhibit"B". Section 3. That prior to taking full and final possession of Griffing and Herman Park, all items indicated in the Punch List (incorporated in the Certificate of Substantial Completion) shall be completed by the Contractor, DezTex Industrial. Section 4. That an authorized representative of DezTex Industrial shall sign a copy of the resolution agreeing to the terms thereof. Section 5. That prior to the release of project retainage monies, the Director of Parks and Recreation must certify to the City Manager that the park improvements are complete and all items listed in the Punch List (incorporated in the Certificate of Substantial Completion) have been finished and the Director of Parks and Recreation must be in receipt of all warranties related to the parks. Section 6. That a copy of the caption of this Resolution be spread upon the Minutes of the City Council. Owner assumes responsibility for insurance of the Project on July 08, 2016. Dr. Ransom Howard St. Port Arthur, TX 77640 Re: Griffing Park Project# 14037 Dear Mr. Kramer, On Thursday, July 7, 2016, an inspection was made of the above-mentioned project for the purpose of compiling a Punch List for Herman Park. The following persons were in attendance during the inspection: Dohn LaBiche, FAIA LaBiche Architectural Group, Inc.. Brian Kramer& Lance Deshotel DezTex, Inc. Jerry Smith, Harriet Collins, Issac City of Port Arthur Punch List 1. Add asphalt for elevation differences at end of sidewalk and parking lot so that there is a smooth transition between parking lot and new sidewalk. Transition must meet Texas Accessibility Standards. 2. Remove pallets and construction debris from site. 3. Backfill along edges of sidewalk so that there is not an abrupt drop off. 4. Repair tree scares from construction equipment. Contractor shall spray scares with pruning sealer. 5. Palm frons on playground are loose. Tighten anchors so that frons cannot be rotated. 6. Provide tools for playground equipment as promised by Kraftsman. • See attached site plan for references to the notes above. End of Punch List 1 of 2 Punch List for Herman Park Please correct the above-mentioned item of work by the earliest possible date and notify our office in writing upon their completion. We have established, July 7, 2016 as the Substantial Completion date. Also please submit the required Close-out Documents and Warranties along with Record Drawings and Specifications for approval and transmittal to the owner. Jerry Smith, Harriet Collins, Issac City of Port Arthur Punch List 1. Install backer rod and sealant in joint between existing sidewalk and new sidewalk leading to playground. Cut backer rod and concrete from joint and install backer rod and sealant in joint. 2. There are two sections of unacceptable sidewalk at the street and at the playground. Sidewalk at the street does not have radi as shown on construction documents (See drawing L3.0). Add additional sidewalk paralleling the playground as shown on L3.0. 3. Backfill along edges of sidewalk so that there is not an abrupt drop off. 4. Grade area from playground drain across play area so that water will not hold in area of dead grass. Re-sod area of dead sod. 5. Remove pallets and construction debris from site. 6. Provide tools for playground equipment as promised by Kraftsman. 7. Tighten loose nuts on new playground slide. 8. Grease bearings on playground steering wheel. 9. Items 4 and 5 above shall be completed before removal of construction fence. • See attached site plan for references to the notes above. End of Punch List Please correct the above-mentioned item of work by the earliest possible date and notify our office in writing upon their completion.
