RE: P.R. NO. 19541 — Service Plans for Industrial Districts and for Points of
Electricity Delivery from Entergy.
Nature of the request:
The City Council is requested to confirm their motion made and passed on September 29, 2016,
directing the Planning Department to prepare service plans that provide for the extension of full
municipal services to the area to be annexed owned by the entities listed in Exhibit "A", and also
give directions regarding a service plan for points of delivery of electricity to these facilities by
Entergy.
Staff Analysis/Considerations:
The companies listed in Exhibit"A"have "in lieu of tax agreements" that expire at the end of the
year 2016. In case negotiations are not successful, the City will begin preparing an annexation
time table for said companies' properties. The annexation timetable will adhere to the rules in
the Texas Local Government Code and there shall be a schedule for publication, notice and
public hearings.
Recommendation:
Confirmation by the City Council that Service Plans shall be prepared for industrial district areas
mentioned in Exhibit "A" and for points of delivery of electricity by Entergy, as it pertains to the
mentioned industrial customers with expiring "in lieu of tax agreements."

RESOLUTION NO.
A RESOLUTION CONFIRMING THE MOTION OF THE
CITY COUNCIL DIRECTING THE PLANNING
DEPARTMENT PREPARE SERVICE PLANS FOR
INDUSTRIAL DISTRICT AREAS AND FOR POINTS OF
DELIVERY OF ELECTRICITY BY ENTERGY TO
INDUSTRIAL CUSTOMERS IN THE CITY'S ETJ
WHEREAS, the City Council has Industrial District Agreements with the following
corporations in Exhibit"A"; and,
WHEREAS, the following companies, as delineated in Exhibit "A," have agreements
expiring at the end of the year(December 31, 2016); and,
WHEREAS, the City of Port Arthur expects to annex these properties if new "in lieu of
tax agreements" are not entered into; and,
WHEREAS, the City expects to annex the areas to the points of delivery of electricity by
Entergy to industrial customers in the City's ETJ; and,
WHEREAS, pursuant to Section 43.065 of the Texas Local Government Code, and the
motion made and passed by the City Council on September 29, 2016, the Planning Department
was directed to prepare service plans that provide for the extension of full municipal services to
the area to be annexed owned by the entities listed in Exhibit"A".
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF PORT ARTHUR:
THAT pursuant to Section 43.065 of the Texas Local Government Code, and the motion
made and passed by the City Council on September 29, 2016, the City Council confirms their
motion that the Planning Department shall prepare service plans that provide for the extension of
full municipal services to the area to be annexed owned by the entities listed in Exhibit"A".

THAT the Planning Department shall prepare service plans as to the areas containing the
points of delivery of electricity by Entergy to industrial customers in the City's ETJ.
THAT a copy of the caption of this resolution be spread upon the minutes of the City
Council.
