In particular, the disagreed with the requirement that all subdivided lots to be sold must be located on improved, dedicated city streets or on private streets built to city standards. He declared that if the city required townhomes to front on city streets, that meant that the city would not allow a townhome development in Port Arthur. And he expressed this belief to many city officials and council members to the point that the city manager insisted that I write a townhome ordinance to amend the zoning ordinance. So this effort is in response to that instruction. In short, this amendment inserts the word "townhome" to all places in the zoning ordinance that refers to "single-family attached" housing, so that anyone reading the zoning ordinance could easily see that townhome developments are certainly allowed in Port Arthur, even if they did not recognize that "single-family attached" housing is also considered to be townhome housing. The amendment does not remove the requirement that townhomes must front on improved, dedicated city streets or private streets built to city standards. 1 P.O. FROM: PAUL BROWN, SENIOR PLANNERf &_8 SUBJECT: P.O. 6589 — GAMING AMENDMENTS TO ZONING ORDINANCE DATE: 10/13/2016 When the Port Arthur Police Department last year started issuing permit stickers for gaming machines, otherwise known as 8 liners, the department did not coordinate the new practice with the Planning Division, Code Enforcement and the Fire Marshal. As a result, some businesses that had four or five gaming machines, expanded the activity to increase the number of machines, while other gaming roorns opened without seeking guidance from planning, code enforcement or the fire marshal. This shortcoming presented major problems when game rooms greatly increased their number of machines without providing adequate off-street parking for the many players the establishments attracted. In other situations, the businesses lacked the appropriate electrical capacity for the number of permitted machines or the number of customers greatly exceeded the legal occupancy rating for the type of business previously located in the building. In short, a thorough mess had been created. Although state law holds that gambling is illegal, it also states that amusement and entertainment games are legal and that cities and counties must allow such machines and are responsible for regulating and enforcing such establishments to make sure that garnbling is not taking place. With that in mind, several of us on staff have worked toward revising the city ordinance regulating these machines and businesses. As part of that effort, we have found that some amendments are needed to the Zoning Ordinance: in particular, we need to add a land and building use description for these gaming rooms along with an off-street parking requirement. This coning ordinance amendment will add a land -use description, an off-street parking requirement, and definitions for a game room and for the game machine. We have also prepared an amendment to the existing gaming machine ordinance, but we will make that available at a later meeting. P.O.
