BACKGROUND:
The Planning and Zoning Commission is being asked to consider a preliminary plat for Roya Place
Townhomes Phase I, 4.658 Acres of Land, Part of Lots 3, 4, 5 & 6, Block 23, Range "G", Port
Arthur Land Company Subdivision. The site is located south of the unimproved portion of Rice
Farm Road and west of Wi//owood Lane. The purpose of this plat is to create one (1) tract of
land for a residential development of Condominium type housing. This subdivision is located in
a Multiple Family zoned district.

RECOMMENDATION:
The planning staff recommends approval of this request. A final plat cannot be submitted until
engineering plans and other site plans are approved.

Back in 2006 a subdivision was platted on the eastern side of the Port Arthur
Country Club in the Extraterritorial Jurisdiction of the City of Port Arthur. This
subdivision was not released from the city's ETJ, nor was it incorporated into the
city of Taylor Landing. Recently, the owner of the subdivision decided to change
the name of the subdivision to The Cove At Taylor Landing. So to do that, the
company decided to combine a series of plat phases and final plats into one,

When a local developer first submitted plans to build a townhome subdivision near
the Willows Apartments, the developer found fault with the rules for such a
development in the city of Port Arthur. In particular, the disagreed with the
requirement that all subdivided lots to be sold must be located on improved,
dedicated city streets or on private streets built to city standards. He declared that if
the city required townhomes to front on city streets, that meant that the city would
not allow a townhome development in Port Arthur. And he expressed this belief to
many city officials and council members to the point that the city manager insisted
that I write a townhome ordinance to amend the zoning ordinance. So this effort is
in response to that instruction.
In short, this amendment inserts the word "townhome" to all places in the zoning
ordinance that refers to "single-family attached" housing, so that anyone reading the
zoning ordinance could easily see that townhome developments are certainly
allowed in Port Arthur, even if they did not recognize that "single-family attached"
housing is also considered to be townhome housing. The amendment does not
remove the requirement that townhomes must front on improved, dedicated city
streets or private streets built to city standards.

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR:
SECTION 1. That the City's Zoning Ordinance (Appendix A) be amended in much the same
way as delineated in Exhibit A.
SECTION 2. That if any section, subsection, sentence, clause, phrase or portion of this
Ordinance is for any reason held invalid or unconstitutional by any court of competent jurisdiction,
such portion shall be deemed a separate, distinct, and independent provision and such holding shall
not affect the validity of the remaining portions hereof.
SECTION 3. That all ordinances and parts of ordinances in conflict herewith are hereby
repealed, but only to the extent of such conflict.
SECTION 4. That any person, firm or corporation who violates any provision of this Ordinance
or the City's Zoning Ordinance shall be guilty of a misdemeanor and shall be punished by a fine not
exceeding Two Thousand ($2,000.00) Dollars as provided in Chapter 1, Section 1-13 of the
Code of Ordinances, and each day such violation shall be permitted to exist shall constitute a
separate offense.
SECTION 5. That this Ordinance or its caption and penalty shall be published at least one (1)
time within ten days after formal passage hereof in the official newspaper of the City of Port Arthur.
This Ordinance shall take effect immediately after the date of such publication.
SECTION . That because IFSection 24-105 of the Zoning Ordinance does not apply, seven (7)
votes are not required to adopt this Ordinance.

1. Add the "Townhome" building type to the "Single -Family Residence Attached" item in the
Land Use Chart in Section 7-100 and retaining the same Zoned Districts for which such use
is allowed "By Right."
2. Add the "Townhome" building type in all the zoning district sections of the Zoning
Ordinance that include a listing for the "Single -Family Attached" building type, to wit, Section
11-200, Two -Family District Regulations; Section 12-200, Multiple -Family Regulations;
Section 13-200, Mobile Home District Regulations; Section 14-200, Neighborhood Service
District Regulations; Section 15-200, Light Commercial District Regulations; Section 16-200,
Heavy Commercial District Regulations. In all of the above sections, the "Single -Family
Attached, Townhome" building type shall require: Minimum Lot Area of 2,000 square feet;
Minimum Lot Width of 18 feet; Minimum Front Yard Setback of 20 square feet; Minimum
Side Yard Setback of 5 feet; Minimum Rear Yard Setback of 10 feet; and Maximum Under -
Roof Lot Coverage of 40 percent.
3. Add a Special Condition for "New Residential and Commercial Developments" to Section
22-100 (30) stating as follows: "New subdivided residential and multi -unit commercial
developments proposed after the date this ordinance becomes effective shall provide a
Traffic Impact Study of appropriate detail, extent, and completeness relative to the size and
area of commercial projects or number of residential units, and also in relation to the type,
size, and volume of predevelopment traffic, especially if the development has access to only
local residential access streets not built to current city standards and specifications (i.e.
concrete with curbs, gutters and storm drainage, and is at least 27 -feet wide from back of curb
to back of curb)." The City may waive the Traffic Impact Study for small residential
subdivisions meeting the requirements of a minor plat, at the City Manager, Planning
Director, or City Engineer's discretion.

When the Port Arthur Police Department last year started issuing permit stickers for gaming
machines, otherwise known as 8 liners, the department did not coordinate the new practice
with the Planning Division, Code Enforcement and the Fire Marshal. As a result, some
businesses that had four or five gaming machines, expanded the activity to increase the
number of machines, while other gaming roorns opened without seeking guidance from
planning, code enforcement or the fire marshal. This shortcoming presented major
problems when game rooms greatly increased their number of machines without providing
adequate off-street parking for the many players the establishments attracted. In other
situations, the businesses lacked the appropriate electrical capacity for the number of
permitted machines or the number of customers greatly exceeded the legal occupancy rating
for the type of business previously located in the building. In short, a thorough mess had
been created.
Although state law holds that gambling is illegal, it also states that amusement and
entertainment games are legal and that cities and counties must allow such machines and are
responsible for regulating and enforcing such establishments to make sure that garnbling is
not taking place. With that in mind, several of us on staff have worked toward revising the
city ordinance regulating these machines and businesses. As part of that effort, we have
found that some amendments are needed to the Zoning Ordinance: in particular, we need
to add a land and building use description for these gaming rooms along with an off-street
parking requirement.
This coning ordinance amendment will add a land -use description, an off-street parking
requirement, and definitions for a game room and for the game machine.
We have also prepared an amendment to the existing gaming machine ordinance, but we
will make that available at a later meeting.

5. Add a definition to Section 26 - Definitions for "(38.1) Gaming Machine Commonly
referred to as an "eight liner," any coin-operated machine or electronic, electromechanical
or mecanical contrivance designed, made, and adopted solely for bona fide amusement
purposes if the contrivance rewards the player exclusively with non-cash merchandise, prizes,
toys, or novelties, or a representation of value redeemable for those items, that have a
wholesale value available from a single play of the game or device of not more than ten (10)
times the amount charged to play the game Or device once, or $5, whichever is less. Not
included in this devinition is a machine used only for entertainment purposes, as
entertainment is defined in Section 372.1701 of the Texas Administrative Code. A Gaming
Machine can also be called an Amusement redemption machine."
