AN ORDINANCE AMENDING THE ZONING ORDINANCE OF
THE CITY OF PORT ARTHUR BY CHANGING A 5.275 ACRE
TRACT, RESERVE "C", FAIRWAY ESTATES, PORT ARTHUR,
JEFFERSON COUNTY, TEXAS FROM SINGLE-FAMILY TO
PLANNED DEVELOPMENT DISTRICT 35 (PD -35);
VIOLATION OF THIS ORDINANCE AND THE ZONING
ORDINANCE OF THE CITY OF PORT ARTHUR IS
PUNISHABLE AS PROVIDED IN SECTIONS 1-13 OF THE
CODE OF ORDINANCES AS AMENDED BY A FINE NOT
EXCEEDING TWO THOUSAND [$2,000.00] DOLLARS; AND
PROVIDING FOR PUBLICATION IN THE OFFICIAL
NEWSPAPER OF THE CITY OF PORT ARTHUR AND
EFFECTIVE IMMEDIATELY AFTER PUBLICATION DATE.

WHEREAS, all requirements of Article XI of the Charter and the Zoning Ordinance of
the City of bort Arthur, Texas, including the Local Government Code, Sections 211.006 and
211.007, having been fulfilled, the City Council held a public hearing December 14, 2010 at
7:00 P.M.; and,
WHEREAS, the proposed change may be protested in accordance with subsection
(d) of said Section 211.006; and,
WHEREAS, having received and considered the recommendation of the Planning
and Zoning Commission that the proposed change be approved, the City Council finds that
it would be in the public interest and general welfare of the City to change the Zoning
designation of the hereinafter described property as delineated in Exhibit "A"; and,
WHEREAS, Section 211.006 subsection (d) of the Local Government Code and
Section 24-105 of the City Zoning Ordinance requires the affirmative vote of three-fourths
of all members of the City Council (i.e. at least seven [7] members) if the proposed change
is protested in accordance with subsection (d); and,

WHEREAS, the objecting property owners' lot area amounts only to 4.2% of the lots
for which rezoning is requested; therefore, a simple majority vote of the City Council is
sufficient for approval of the zoning change; and,
WHEREAS, the City deems it advisable to set forth certain use regulations for the
"PD -35", Planned Development District 35; now, therefore,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR:
SECTION 1. That a zoning designation of the following tract of land located in the
City of Port Arthur, Jefferson County, Texas be and the same is changed from Single -Family
District to Planned Development District 35 (PD -35) (This property is located on the South
Side of Jimmy Johnson Blvd.):

FAIRWAY ESTATES ADDITION,
CITY OF PORT ARTHUR, JEFFERSON COUNTY, TEXAS

SECTION 2. USE REGULATIONS
Use regulations for the "PD -35", Planned Development -35 District shall permit uses
as prescribed in the Use Schedules, Section 7 of the Zoning Ordinance, City of Port Arthur,
Texas for professional office buildings and a shopping center as delineated in Section 19-
200(1) and (6) of the Port Arthur Zoning Ordinance.
SECTION 3. DEVELOPMENT STANDARDS
All new commercial structures must comply with the following standards:
1. Architectural style is not restricted; however, whatever general style established for
the first buildings constructed shall govern the appearance and style of all
subsequent buildings developed for PD -35.
2. Buildings shall have good scale and be in harmonious conformance with permanent
neighboring residential development.

3. Building materials:
A. Materials shall have good architectural character and shall be selected for
harmony of one Light Commercial building with all subsequent adjacent
buildings of the development.
B. Materials shall be selected for suitability to the type of buildings and the design
in which they are used. Buildings shall have the same materials used for all
building walls and other exterior building components wholly or partly visible
from public ways. If materials are not actually the same, they shall be
architecturally harmonious to the exterior components of other buildings.
C. Materials shall be of durable quality.
D. Any design exposing the structural frame to view shall consist of materials
compatible and harmonious with their surroundings and with the building itself.
4. Building components, such as windows, doors, eaves, and parapets shall have good
proportions and relationships with one another.
5. Colors shall be harmonious and shall use compatible accents.
6. Mechanical equipment or other utility hardware for buildings whether on the roof
or on the ground shall be screened from view from public ways with such screening
consisting of harmonious materials, or the mechanical equipment or utility
hardware shall be so located as not to be visible from any public ways. For this
purpose, public ways shall include the portions of the public golf course adjacent to
the rear or back of the buildings comprising this proposed development. The back of
the buildings can also be viewed from the nearby residential homes also adjacent to
the golf course.
7. Refuse and waste removal areas, service areas, service yards, storage yards, and
exterior work areas shall be screened from view from public ways shall be screened
from view from public ways, with such screening materials that are compatible and
harmonious with the buildings in the development.
8. Monotony of design in single or multiple building projects shall be avoided.
Variation of detail, form and siting shall be used to provide visual interest. In
multiple building projects, variable siting or individual buildings may be used to
prevent monotonous appearance.
9. Simultaneous with construction of commercial buildings, shrubbery and/or trees
and other various foliage shall be planted at the rear of each tract to provide some of
the required screening and a reasonable visual transition to the adjacent property.
10. Elevations or perspectives for all structures shall be submitted to and approved by
the Commission for all development. This requirement is in addition to the site plan
requirements of Section 23-300.

SECTION 4. That the Building Official and the Director of Planning are authorized
and directed to make all necessary changes to the "Zoning Map, City of Port Arthur, Texas" on
file in the offices of the Building Official and the Planning and Zoning Commission, so as to
reflect on said Map, the changes hereby made in conformity with the legend of said Map.
SECTION 5. If any section, subsection, sentence, clause, phrase or portion of this
Ordinance is for any reason held invalid or unconstitutional by any court of competent
jurisdiction, such portion shall be deemed a separate, distinct, and independent provision
and such holding shall not affect the validity of the remaining portions hereof.
SECTION 6. All ordinances and parts of ordinances in conflict herewith are hereby
repealed, but only to the extent of such conflict.
SECTION 7. Any person, firm or corporation who violates any provision of this
Ordinance or the City's Zoning Ordinance shall be guilty of a misdemeanor and shall be
punished by a fine not exceeding Two Thousand ($2,000.00) Dollars as provided in General
Provision -.Section 1-8 of the Code of Ordinances, and each day such violation shall be
permitted to exist shall constitute a separate offense.
SECTION B. This Ordinance or its caption and penalty shall be published at least
one (1) time within ten days after final passage hereof in the official newspaper of the City of
Port Arthur. This Ordinance shall take effect immediately after the date of such publication.
SECTION 9. Because the area of property owned by opponents to this zoning
change does not reach the minimum requirements set forth in Section 24-105 of the Zoning
Ordinance, a simple majority vote of the City Council is sufficient to adopt this ordinance.

Planning Association -Texas Chapter for the Port Arthur Downtown Revitalization Plan;
2. Staff will present the 2016 Long Range Planning Award to the Port Arthur City Council, Port Arthur
Economic Development Corporation and the Mardi Gras of Southeast Texas organization on
November 14, 2016 Port Arthur City Council Meeting.
