CITY OF PORT ARTHUR ENGINEERING DEPARTMENT COUNCIL ACTION MEMO TO: Brian McDougal, City Manager FROM: Armando Gutierrez, P.E., Director of Public Works DATE: January 3, 2017 SUBJECT: P.R.# 19639 -Northstar Port Arthur, LLC 24"Diesel Pipeline RECOMMENDATION It is recommended that the City Council approve Proposed Resolution No. 19639 authorizing the execution of Major Pipeline Permit 16-01 from the City of Port Arthur to Northstar Port Arthur, LLC. for the installation of a 24" diesel pipeline within the corporate limits of the City of Port Arthur. BACKGROUND Northstar Port Arthur, LLC of The Woodlands, Texas has made application for a major pipeline permit to install a 24"diesel pipeline within the corporate limits of the City of Port Arthur. This pipeline will originate near Texaco Island Road and terminate at the meter skid near the Port of Port Arthur for a total distance of approximately one (1) miles more or less, the proposed route being more fully shown on the attached map marked Exhibit "A". The Public Hearing for the requested pipeline permit will be held on Tuesday January 17, 2017 at 8:15 a.m. in the City Council Chambers and will allow input from the public and other interested parties. The Citizen's Pipeline Advisory Committee will meet and review the permit application prior to the public hearing and will present their recommendation at the public hearing. The Director of Planning and I have reviewed said application. BUDGETARY/FISCAL EFFECT The permit fee of$1,500.00 will be deposited in Account 001-0000-332.81-00 EMPLOYEES/STAFF EFFECT None. A RESOLUTION AUTHORIZING THE EXECUTION OF MAJOR PIPELINE PERMIT 16-01 FROM THE CITY OF PORT ARTHUR TO NORTHSTAR PORT ARTHUR, LLC OF THE WOODLANDS, TEXAS FOR THE INSTALLATION OF A TWENTY FOUR INCH (24") DIESEL PIPELINE WITHIN THE CITY LIMITS OF PORT ARTHUR, TEXAS. WHEREAS, Northstar Port Arthur, LLC of The Woodlands, Texas has submitted an application to install a twenty inch (24") diesel pipeline within the city limits of Port Arthur, Texas; and, WHEREAS, the proposed installation will originate from a point (29.8443981,- 93.95839) near Texaco Island Road and terminates at the meter skid near the Port of Port Arthur (29.855836, -93.945787) for a distance of one (1)mile more or less; and WHEREAS, the members of the citizen's Pipeline Advisory Committee met on January 11, 2017, a copy of their recommendation of approval being attached hereto and made a part hereof as Exhibit"A"; and WHEREAS, the Public Hearing for the requested pipeline was held on January 17, 2017: and WHEREAS, the Director of Public Works and the Director of Planning have reviewed such application and now recommend that a permit be granted pursuant to Chapter 66 (Oil and Gas) of the Code of Ordinances of the City of Port to install and maintain said pipeline within the City in accordance with the routing set forth in the Permit attached hereto and made a part hereof as Exhibit"B"; and WHEREAS, Northstar Port Arthur, LLC of The Woodlands, Texas has submitted the required information and documents for their major pipeline permit to be considered for approval now therefore, P.R.No. 19639 Page 2 BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR, TEXAS: THAT, the City Manager be and is hereby authorized to execute on behalf of the City Pipeline Permit 16-01 to Northstar Port Arthur, LLC of The Woodlands, Texas for the installation of a 24" diesel pipeline originating from a point near Texaco Island Road (29.8443981, - 93.95839) and terminates at the meter skid near the Port of Port Arthur (29.855836, -93.945787) for a distance of one (1) mile more or less within the corporate limits of the City of Port Arthur, Texas as set forth as Exhibit"B" and made a part hereof. Director of Public Works EXHIBIT "A" City of Port Arthur Citizens' Pipeline Advisory Committee Meeting Minutes 11 January 2017 Meeting began at 5:31 P.M., January 11, 2017 Attendees: Committee Members: Deral Segler Warren Field John Parker Kelvin Alvarenga Earl Tezeno City Staff: Armando Gutierrez, P.E. -Director of Public Works Rhonda L. Bell, Sr. Engineering Technician Visitors: Charles Thompson-Northstar Port Arthur, LLC Larry Kelly-Port of Port Arthur Action: Charles Thompson gave a brief description of the project, being the construction and installation of a twenty-four inch(24") diesel pipeline. The project was estimated to be valued at approximately $30,000,000.00 He noted that Motiva's docking facility had outgrown its ability to load vessels and is entering into an agreement with the Port of Port Arthur to use their docks. This pipeline would allow them to service 7 - 9 additional vessels per month using the Port's facilities. In addition it would create approximately 120 construction jobs and about 34 permanent jobs. Pipeline would be constructed in accordance with Texas Railroad Commission standards and specifications. Kelvin Alvarenga asked if any of those permanent jobs would be filled by local residents and Larry Kelly said that there would possibly be some positions filled locally. Warren Field asked about the pipe wall thickness and proximity to the existing Foley Ditch. He was informed that pipe is approximately 1/4"thick and that there are plans in the works to fill in that particular ditch. Mr. Thompson also noted that line would have at least five feet (5') of cover. Mr. Thompson was asked about a 3" line shown on plans and stated that it is a fiber optic line that would be pulled along with the pipeline to facilitate monitoring of the line. Northstar has already acquired a permit from Texas Department of Transportation to cross State Highway 82. Page 2 After all discussion was done Warren Field made a motion to recommend City Council approval of the request for the Pipeline Permit 16-01. The material to be transported through the pipeline is low sulfur diesel. The maximum allowable operating pressure on the pipeline is 740 PSIG. Because there are no crossings of any public streets, right-of-way or city easements no bond is required. The design criteria under which the pipeline will be constructed is DOT 49 CFR Part 195 Subpart C. An affidavit, provided by the city, describing that the pipeline will be constructed, operated and maintained in accordance with the lawful requirements of this article as well as a hold- harmless agreement is attached. The required permit fee was paid by check in the amount of$1,500 was mailed to the City on November 17, 2016. NO: 16 - 01 10077 Grogans Mill Road, Suite 530 DATE: The Woodlands, Texas 77380 The City of Port Arthur, pursuant to Chapter 66, Article II, Sections 66-51 through 66-69, Code of Ordinances hereby grants permission to the above-named permittee for the Construction/Installation of a proposed 24" diesel pipeline(s) to be located in accordance with the drawings and/or specifications attached hereto and made a part hereof. It is expressly understood that the City of Port Arthur does not hereby grant or purport to grant any right, claim title, interest, easement, or right-of-way on any property upon which such pipeline(s) and related valves, structures, etc. may be located pursuant hereto, and that the City may require the owner(s), at his own expense, to lower, adjust, relocate, or remove such pipeline(s) on or from any public property upon thirty (30) days written notice to the owner or agent thereof. Permittee shall be required to pay for and be responsible for any adjustments or casings, etc. of its pipeline required because of street improvement, utility or storm sewer crossings within the public rights-of-way covered by this permit. This permit is issued subject to all necessary rights-of-way or easements being acquired by permittee at its expense. Installation of the pipeline(s) within any public street, easement, alley, right-of-way, or grounds shall be performed in accordance with instructions of the City Engineer of the City of Port Arthur and permittee shall notify said City Engineer by letter in his office, forty-eight (48) hours prior to any work pertaining to Construction of the pipeline therein. Upon completion of such construction permittee shall notify the City Engineer of such completion in order that the City Engineer may make a final inspection thereof. MAJOR PIPELINE PERMIT -2- Special conditions for constructing, replacing or relocating pipeline(s) within the City are as follows: A. All pipelines within or across Public rights-of-way shall be constructed with pipe meeting DOT CLASS 4 design requirement for wall thickness. 1. No pipeline will be located longitudinally under any existing or proposed pavement. 2. All existing improved streets shall be crossed by the bored method, and boring shall extend the full width of the street right-of-way plus a minimum of one (1)foot beyond said right-of-way. Provide markers in accordance with Section 66-60. 3. Any pavement repairs or right-of-way restoration necessitated as a result of the construction or operation of any pipeline shall be made in accordance with instructions set out by the City Engineer. Repairs or restorations will be made in such a manner as to equal or exceed the original condition and smoothness that existed prior to construction or operation of pipeline. 4. All drainage improvements or conditions shall be restored to as good or better condition than their original. 5. Any pipeline crossing under any improved street may be required to be cased for a distance not less than one (1) foot beyond the right-of-way line of said street. Casings shall have two(2) vents with the owner's name and product carried in line shown on these vents. Casings shall be approximately the same diameter as the bored hole. 6. All pipelines shall be protected by adequate and approved cathodic protection measures. 7. Pipelines shall be covered to a minimum depth of four (4)feet below the ultimate flow lines of any existing ditches which it crosses under. 8. The owners of any pipeline under construction shall provide flagmen, barricades, flares, and signs for the protection of the public for the duration of the work as instructed by the City Engineer. 9. Other conditions or restrictions deemed necessary to provide for full use of the public right-of-way, and provide for the safety and convenience of the public shall be applied in cases not herein covered. 10. Pipelines shall be not less than four(4) feet below ground surface, except as otherwise specified above. MAJOR PIPELINE PERMIT -3- 11. Said pipeline shall be designed, constructed, operated, and maintained in accordance with the latest approved minimum standards established by the American National Standards Institute, United States Department of Transportation and other pipeline regulatory agencies. Where there are different standards among such agencies, the most stringent standard shall apply for purposes of this permit. 12. Pursuant to Section 66-61 and Section 66-62 telephone notification to the City shall be made as required by each section upon discovery of any leak or possibility of any leak within the City of Port Arthur. This notification shall include the information set out in each section, as well as other significant facts known by the carrier that are relevant to the cause of the failure or extent of the damages. 13. Pursuant to Section 66-62, permittee shall file within thirty(30) days of the discovery of any leak a written report with the City Engineer. Such report shall provide at a minimum the information required on the most current Texas Railroad Commission's leak report form. Upon request, such companies shall provide the following: ALL LINES 1. Construction records and test reports. 2. Operating and maintenance procedures. 3. Emergency plan. 14. The provisions of this permit shall be subject to any Federal and State legislation, rules, or regulations enacted or adopted, or which shall be here after enacted or adopted, to the extent that such laws and regulations shall preempt or supersede the authority of the City with respect to this Permit or provision hereof. 15. Hydrostatic test reports generated during construction are to be furnished to the City. 16. Permittee agrees that if in the event it becomes necessary to lower, case or adjust the line(s) permitted herein because of future street improvements, utility or storm sewer crossings within the public rights-of-way covered by this Permit, said line(s) shall be lowered, cased or adjusted at the sole expense of the Permittee or its assigns. 17. Permittee agrees to install pipe with a reinforced concrete coating within the limits of 600 feet before and 600 feet after passing any developed residential, recreational or commercial areas. MAJOR PIPELINE PERMIT -4- HOLD HARMLESS PROVISION This permit is subject to and incorporates fully Chapter 66, Section 66-51 through 66-69, Code of Ordinances. By acceptance of this Permit, permittee agrees to pay for all damages to or loss of City of Port Arthur's property which are caused by, result from, or arise out of permittee's construction, operation, maintenance, repair or removal of such pipeline(s) within the City limits of the City of Port Arthur. This permittee further agrees to indemnify and hold the City of Port Arthur harmless against and from any and all suits, claims, and demands for damages to or loss of property of others or for personal injuries to or death of persons whomsoever, including all necessary costs and expenses to the City of Port Arthur relating to such claims, or demands, caused by, resulting from, arising, or growing out of or connected with the granting of this permit or permittee's construction, operation, maintenance, repair or removal of such pipeline(s) within the City limits of the City of Port Arthur. This permit shall not become effective until the permittee has subscribed its acceptance hereof and furnished the City with bond and certification of liability insurance as required by the City pursuant to the aforesaid Chapter.
