A RESOLUTION APPROVING THE EMERGENCY REPAIR OF THE EPG LEACHATE PUMPING SYSTEM AT THE CITY OF PORT ARTHUR LANDFILL BY C2R INC. OF HUMBLE, TEXAS WITH A PROJECTED BUDGETARY IMPACT OF $54,089.00. FUNDS ARE AVAILABLE IN ACCOUNT NO. 403-1274-533.36-00. WHEREAS, the EPG Leachate Pumping System is in disrepair and has shut down at the City's Landfill; and WHEREAS,this has caused a buildup of leachate and leachate leaking; and WHEREAS, it is an immediate necessity to complete this emergency repair, in order to properly operate the landfill and protect the public health. It is further needed in order to meet the mandatory requirements of the Texas Commission of Environmental Quality(TCEQ); and WHEREAS,pursuant to Section 252.022(a)(2)of the Texas Local Government Code,this purchase is authorized because of the public calamity that requires the immediate appropriate of money to relieve the necessity of the municipality's residents or to preserve the property of the municipality; and WHEREAS, it is further authorized pursuant to Section 252.022(a)(3) because of unforeseen damage to public machinery, equipment, or other property; and WHEREAS, C2R, Inc. submitted a quote of$54,089.00 (with a cost of $17,527.00 for parts and 36,562.00 for the repair), attached as delineated in Exhibit"A". BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR: THAT, the facts and opinions in the preamble are true and correct; and, THAT, in order to protect the health and safety of our citizens, the City Council hereby authorizes the emergency repair to the EPG Lechate Pumping System by C2R, Inc., of Humble, Texas; and, THAT, a copy of this caption be spread upon the Minutes of the City Council.
