R. 19698 RECOMMENDATION: Approval of Proposed Resolution No. 19698 approving the second year of a contract with Sprint Waste Services of Port Arthur, Texas for leachate hauling for the Public Works Department Landfill Division. This contract is for an hourly rate of$72.03 per hour with a projected budgetary impact of$90,000 per year. This service will be provided on an as-needed basis. BACKGROUND: This is an annual contract for hauling leachate for the City's Landfill Division. The City approved Resolution 16-127 entering into a one-year agreement with Sprint Waste Services with the option to renew for two additional one-year periods. This request is for the second and final renewal of the leachate hauling contract with Sprint Waste Services. A RESOLUTION AUTHORIZING THE CITY MANAGER TO EXECUTE THE SECOND YEAR OF A THREE YEAR RENEWABLE CONTRACT BETWEEN THE CITY OF PORT ARTHUR AND SPRINT WASTE SERVICES OF PORT ARTHUR, TEXAS FOR LEACHATE HAULING AT THE CITY LANDFILL FOR A FEE OF $72.03 PER HOUR IN A PROJECTED BUDGETARY IMPACT OF $90,000. FUNDING IS AVAILABLE IN ACCOUNT NO. 403-1274-533.59-00 — PUBLIC WORKS DEPARTMENT LANDFILL DIVISION — OTHER CONTRACTUAL SERVICES. WHEREAS, pursuant to Resolution 16-127, the City entered into a one year agreement with the option to renew for two additional years with Sprint Waste Services of Port Arthur, Texas for leachate hauling, who is in agreement to renewal, see attached Exhibit "A"; now therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR: THAT, the City Manager is hereby authorized to execute the second year of a three year contract with Sprint Waste Services of Port Arthur, Texas for leachate hauling from the City's Landfill at a rate of$72.03 per hour, which is being increased from last year's rate of$70.00 per hour based on the 2.9% increase in the Consumer Price Index category "Transportation", in substantially the same form as attached hereto as Exhibit"A"; and, THAT, funding is available in account 403-1274-533.59-00, Public Works Department Landfill Division—Other Contractual Services; and, THAT, a copy of the caption of this Resolution be spread upon the Minutes of the City Council. THIS AGREEMENT,made this day of ,2017, by and between the City of Port Arthur, Port Arthur,Texas a municipal corporation organized under the laws of the State of Texas, hereinafter called "OWNER" or "CITY" and Sprint Waste Services a(n) Corporation, herein acting by and through Gregory Gabriele hereinafter called"CONTRACTOR". WITNESSETH: That for and in consideration of the payments,terms,conditions and agreements set forth herein,OWNER and CONTRACTOR agrees as follows: 1. Pursuant to Resolution 16-127,the city entered into a one-year contract with the option of renewal for two additional years. The parties hereby agree to exercise said option for a second year. 2. The term of this Contract shall be from to . It shall be renewable by mutual agreement for one additional one year period,with the rates adjusted according to the Consumer Price Index (CPI). Each subsequent yearly contract renewal shall require approval of the City Council. 3. During the term of this Contract,the CONTRACTOR will furnish at his own expense all of the materials, supplies,tools,equipment,labor,and other services necessary to connection therewith,excepting those supplies specifically not required on CONTRACTOR in the Specifications. 4. The CONTRACTOR agrees to perform all the work described in the Specifications and contract documents and comply with the terms therein for unit prices as stated below(based on the 2.9%increase in the Consumer Price Index): ITEM Tank Truck w/Operator, Full Load $72.03 per hour Tank Truck w/Operator Partial Load $72.03 per hour Minimum Hours Charged per Call-out Full or Partial Load Four(4)hours 5. This agreement can be terminated with thirty (30) days written notice for reasons other than just cause as stated in the specifications.
