A RESOLUTION AUTHORIZING THE CITY MANAGER TO EXECUTE CHANGE ORDER NO. 7 TO THE CONTRACT BETWEEN THE CITY OF PORT ARTHUR AND N&T CONSTRUCTION, INC. OF BEAUMONT, TEXAS, DECREASING THE CONTRACT AMOUNT BY $2,500.00 TO A NEW CONTRACT TOTAL OF $842,187.53 AND TO ACCEPT THE ARCHITECT'S CERTIFICATE OF SUBSTANTIAL COMPLETION FROM THE LABICHE ARCHITECTURAL GROUP, INC. FOR THE IMPROVEMENTS TO THE PAVILION AND PEOPLES PARK WHEREAS, per Resolution No. 16-121, the City Council awarded a contract to N&T Construction, Inc. for the improvements to the Pavilion and Peoples Park; and, WHEREAS, per Resolution 17-008,the City Manager executed Change Order Nos. 1 through 6 to the contract which increases the contract amount by $10,537.53,to a new contract total of$844,687.53, and increases the time to a new completion date of April 30, 2017; and, WHEREAS,N&T Construction, Inc. has requested to delete painting of the concrete seatwalls at the Pavilion; and, WHEREAS, The LaBiche Architectural Group, Inc. has examined the request and recommends proposed Change Order No. 7 to delete painting of the concrete seatwalls at the Pavilion for the decreased amount of$2,500.00 (attached hereto as Exhibit"A") for a new contract amount of$842,187.53; and, WHEREAS, the improvements to the Pavilion and Peoples Park are now substantially complete and have met all of the required building codes, zoning requirements, inspections, etc., as delineated in the Code of Ordinances of the City of Port Arthur; and, WHEREAS, the City of Port Arthur has been presented a Certificate of Substantial Completion for the Pavilion and Peoples Park attached hereto as Exhibit"B"; and, WHEREAS, staff recommends to City Council to authorize the City Manager to P. R. #19720 03/15/2017 ca accept said Certificate of Substantial Completion as delineated herein; now therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR, TEXAS: Section 1. That the facts and opinions in the preamble are true and correct. Section 2. That the City Manager of the City of Port Arthur is hereby authorized and directed to execute, on behalf of the City of Port Arthur, Change Order No. 7, decreasing the contract amount by $2,500.00, for a new contract amount of $842,187.53, attached hereto as Exhibit "A", and to accept the Certificate of Substantial Completion for the Pavilion and Peoples Park, in substantially the same form as attached hereto as Exhibit"B". Section 3. That prior to taking full and final possession of the Pavilion and Peoples Park, all items indicated in the Punch List (incorporated in the Certificate of Substantial Completion) shall be completed by the Contractor,N&T Construction, Inc. Section 4. That an authorized representative of N&T Construction, Inc. sign a copy of the resolution agreeing to the terms thereof. Section 5. That prior to the release of project retainage monies, the Director of Parks and Recreation must certify to the City Manager that the park improvements are complete and all items listed in the Punch List (incorporated in the Certificate of Substantial Completion) have been finished and the Director of Parks and Recreation must be in receipt of all warranties related to the parks. Section 6. That a copy of the caption of this Resolution be spread upon the Minutes of the City Council. The Date of Substantial Completion of the Project or portion thereof designated above is hereby established as March 02, 2017 which is also the date of commencement of applicable warranties required by the Contract Documents, except as stated below. Mrs. Lauren Williams 1376 Laurel Street Beaumont, Texas 77701 Re: Pavilion & Peoples Park Project# 14036 Dear Mrs. Williams, On Friday, February 17, 2017, an inspection was made of the above-mentioned project for the purpose of compiling a Punch List for the Pavilion & Peoples Park. Punch List General Notes - Landscaping 1. Contractor to provide irrigation system schematic plan to owner. 2. Contractor to provide all warranty information to owner(includes irrigation and landscape plant materials) 3. Contractor to turn over keys to Peoples' Park and backflow preventer covers. 4. Clean all Pavilion metal wall panels of dirt and concrete splash. 5. Clean debris from faces of pavers in Peoples Park. 6. Patch all gaps between new paving and existing sidewalks in front of Pavilion. Pavilion - Landscaping 1. Install irrigation freeze and rain sensor 2. Clean caulking from paving 1 of 4 Punch List for Pavilion & Peoples Park Peoples Park - Landscaping 1. Remove sediment from back ally 2. Replace the wax myrtles between the utility fence and fountain 3. Replace one oak tree (adjacent to wax myrtle plantings) 4. Install and roll sod 5. Install irrigation and plantings around sculpture 6. Replace backflow preventer to meet design intent 7. Install backflow preventer cover 8. Finish installing irrigation nozzles 9. Install fiber fabric and bull rock in the utility yard. Electrical 1. Provide As-Built drawings for electrical work on this project. 2. Provide 0 & M Manuals for all electrical equipment furnished on this project. 3. Instruct Owner's personnel on the operation and maintenance of all equipment furnished for this project. Document training with trainee lists, including outline of training session and list of trainees. Turn lists over to the Architect. 4. Provide laminated Time Control Center wiring diagram in contactor junction box on inside of cover. 5. Provide laminated photocell wiring diagram on inside of junction box doors on both boxes at pavilion. 6. Complete installation of fixture globe on south west fixture at People's Park. 7. Paint receptacle covers on all lighting poles. Identify panel and circuit number of receptacle on receptacle inside cover. 8. Touchup paint junction covers on bollards. 9. Provide concrete collar on inground junction box per Sheet E2.0— Detail 2. 10. Grout Light Pole base plates as per Sheet E2.0 — Detail 1. 11. Complete demolition of existing conduit and wiring at northwest corner of project. Civil 1. On the northwest side of the Water feature at People's Park, a portion of the paving was holding water along seat walls after a rain event. Contractor to verify that drainage thru the Seat walls are clear and free of debris for proper drainage. Photo 1 below. 2. SWPPP erosion devices were still in place on storm inlets, which prevent visual verification that inlets were grouted at pipes and inverts. Please verify all inlets are grouted and free of debris. Photo 2 below. 3. New sidewalk connecting to existing sidewalk appears not to be flush. Please ensure this area is constructed to ADA standards. Photo 3 below. 4. Surrounding finished grading of the natural ground area was unfinished. Please ensure natural ground areas are finished to plans and specifications, and allow proper drainage. Photograph 3 Photograph 4 End of Punch List 3 of 4 Punch List for Pavilion & Peoples Park Please correct the above-mentioned item of work by the earliest possible date and notify our office in writing upon their completion so that we can establish a Substantial Completion date. We have not established the Substantial Completion date due to the number of items in need of correction. Please submit the required Close-out Documents and Warranties along with Record Drawings and Specifications for approval and transmittal to the owner.
