ORDINANCE NO.
AN ORDINANCE AUTHORIZING THE CONVEYANCE OF THE
PROPERTY LOCATED AT 701 WEST REV. DR. RANSOM HOWARD
ALSO KNOWN AS WEST 7th STREET IN PORT ARTHUR, TEXAS TO
TRIANGLE COMMUNITY OUTREACH, INC. (REQUESTED BY
COUNCILMEMBER LEWIS)
WHEREAS, the City Council of the City of Port Arthur finds it in the best interest
of the citizens of Port Arthur for the City to execute a special warranty deed to Triangle
Community Outreach, Inc., as attached hereto as Exhibit "A"; and
WHEREAS, this will allow Triangle Community Outreach, Inc. to maintain a
distribution location solely for non—perishable food and volunteer activities that promote
a public purpose for the citizens of Port Arthur.
NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF PORT ARTHUR:
Section 1. That the facts and opinions in the preamble are true and correct.
Section 2. That the City Manager is hereby authorized to execute a special
warranty deed to Triangle Community Outreach, Inc., for the land and improvements
located at 701 West Rev. Ransom Howard Street aka West 7th Street, Port Arthur,
Texas, pursuant to Section 253.011 of the Texas Local Government Code, in
substantially the same form as attached hereto as Exhibit "A".
Section 3. That if Triangle Community Outreach, Inc. fails to maintain their
properties in accordance with Chapter 34 of the Code of Ordinance and uphold the

terms set forth in the Affidavit of Intent, the property located at 701 West Rev. Ransom
Howard Street aka West 7th Street, Port Arthur, Texas shall be reverted back to the
City.
Section 4. That a copy of the caption of this Ordinance be spread upon the
Minutes of the City Council.

Consideration: Pursuant to 253.011 of the Texas Local Government Code, the
ownership of these tracts will automatically revert to the City of Port Arthur if Triangle
Community Outreach, Inc., fails to use this property and improvements thereon
described as 701 West Rev. Ransom Howard aka West 7th Street, Port Arthur, Texas
(Lot 11 & 12 Res 24 RESV) primarily for a public purpose, as delineated in Ordinance
No. . Also, pursuant to the Affidavit of Intent executed on April 13, 2017, the
ownership of these tracts will automatically revert back to the City of Port Arthur if
Triangle Community Outreach, Inc. fails to maintain their properties in accordance with
Chapter 34 of the Code of Ordinances for the City of Port Arthur and up hold the terms
set forth in the Affidavit of Intent.
Property (including any improvements): Being Lots Numbered Eleven and Twelve
(11 & 12) in Block Number R Twenty-four 24, according to the map used by the City of
Port Arthur for taxation purposes, at the Northwest corner of the intersection of West 7th
Street and Grannis Avenue, Port Arthur, Jefferson County, Texas, being more
particularly described by metes and bounds as follows, to-wit:
BEGINNING at a point in the N.W. corner of West 7th Street and Grannis Avenue;
THENCE along Grannis Avenue N. 48° 47 W. a distance of 50.00 feet to a point;
THENCE S. 41° 13' W. a distance of 138.00 feet to a point;
THENCE S. 48° 47' E. a distance of 50.00 feet to a point in the Northerly line of West 7th
Street;
THENCE along West 7th Street N. 41° 13' E. a distance of 138.00 feet to the POINT OF
BEGINNING, with frontage of 138.00 feet on West 7th Street and 50.00 feet on Grannis
Avenue.
Reservations from and Exceptions to Conveyance and Warranty: That such deed
is subject to all restrictions, covenants, conditions, easements, rights -of-way and
prescriptive rights whether recorded or not, and all recorded reservations if any
and zoning and other laws affecting the property.
Grantor, for the consideration and subject to the reservations from and exceptions to
conveyance and warranty, grants, sells and conveys to Grantee the property, together
with all and singular the rights and appurtenances thereto in any wise belonging, to
have and to hold it to Grantee, Grantee's heirs, executors, administrators,
successors, or assigns forever. Grantor binds Grantor and Grantor's heirs,
executors, administrators, and successors to warrant and forever defend all and
singular the property to Grantee and Grantee's heirs executors, administrators,
successors, and assigns against every person whomsoever lawfully claiming or to
claim the same or any part thereof, except as to the reservations from and exceptions
to conveyance and warranty by and through only the grantor.
