Background: The City of Port Arthur entered into a multi-year management contract with Aquila Golf, Inc. for the operation and maintenance of the Babe Didrikson Zaharias Municipal Golf Course. Aquila Golf, Inc. has requested an increase in fees for Port Arthur residents and non-residents due to the overall increase in labor, materials, insurance, fuel and other operating expenses combined with decreased number of rounds. A RESOLUTION AUTHORIZING AN AMENDMENT TO THE CONTRACT BETWEEN THE CITY OF PORT ARTHUR AND AQUILA GOLF, INC., FOR THE MANAGEMENT OF BABE DIDRIKSON ZAHARIAS MEMORIAL GOLF COURSE AS IT PERTAINS TO RESIDENT AND NON-RESIDENT FEES WHEREAS, on July 31, 1993 the City of Port Arthur entered into a multi-year management contract with Aquila Golf, Inc. for the operation and maintenance of the Babe Didrikson Zaharias Municipal Golf Course; and, WHEREAS, said contract was extended pursuant to Resolutions 93-138. 03-024 and 13- 557; and, WHEREAS, Aquila Golf, Inc., the "Manager" of the golf course, has requested an Amendment to the Management Contract changing the resident and non-resident fees for the Babe Didrikson Memorial Golf Course as shown in Exhibit"A"hereto; and, WHEREAS, the City Council and City Golf Course Committee have received and critically reviewed the proposal as presented by Aquila Golf, Inc., the "Manager" of the referenced golf course, and deem the increase in the residential and non-residential fees to be justified and reasonable; and, WHEREAS, the City Council deems the Babe Didrikson Zaharias Memorial Golf Course an amenity which contributes to the quality of life in Port Arthur and has been satisfied with the operations and management services of Aquila Golf, Inc. at the Babe Didrikson Zaharias Memorial Golf Course; now, therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR, TEXAS: Section 1. That the facts and opinions in the preamble are true and correct. Section 2. That the City Manager of the City of Port Arthur is hereby P. R. # 19707 05/15/2017 ca authorized and directed to execute an Amendment to the Management Contract with Aquila Golf, Inc., in substantially the same form as attached as Exhibit"B". Section 3. That a copy of the caption of this Resolution be spread upon the Minutes of the City Council. There has not been an increase in resident green fees and annual fees in almost 5 years. Overall increases in labor, materials, insurance, fuel, and other operating expenses combined with decreased number of rounds make this request necessary. Enclosed are the current rates along with the proposed rates. These prices are still lower than the current non-resident rates. We are planning to raise the rates for non-residents so the savings for Port Arthur residents will still be significant. WHEREAS,the City of Port Arthur and Aquila Golf Inc. entered into the original contract to operate and maintain the Babe Didrikson Zaharias Memorial Golf Course per Resolution No. 03-051. WHEREAS,the parties to the contract now desire to amend and herein amends the resident and non-resident fees for the Babe Didrikson Zaharias Memorial Golf Course, as attached hereto as Exhibit "A".
