Background: "Ace" is a 5 year-old German Shepherd that the police department has owned for approximately 3 years. He has never been able to become certified in the areas of drug detection, patrol duties or tracking. Officer Tony Legnon was recently tasked to train with Ace and attend a K9 Handler certification course. Our department was contacted by the instructor of the course and told that Ace was not displaying the qualities needed to be a police service dog. The vendor from which the canine was purchased has agreed to reimburse the police department for half of the purchase price. Budget Impact: The is no budgetary impact for the retirement and transfer of ownership. Recommendation: It is recommended that City Council approve the retirement of police canine "Ace" and transferring the ownership of the canine to the personal care of Officer Tony Legnon. A ORDINANCE AUTHORIZING THE RETIREMENT OF POLICE CANINE "ACE" AND TRANSFERRING THE OWNERSHIP OF THE CANINE TO THE PERSONAL CARE OF OFFICER TONY LEGNON. WHEREAS, the Police Department has a police canine known as Ace that has been in service for the City for the past 3 years and has been assigned to K-9 handler Officer Tony Legnon; and WHEREAS, the canine was sent to a certification course to continue training and was unable to achieve said certification; and WHEREAS, it is the expert opinion on the instructor that the canine did not display the qualities needed to be a service canine; and WHEREAS, Officer Legnon has agreed to take possession and ownership of Ace and assume all future expenses and liability involved in the care and maintenance of the canine; and WHEREAS, it is deemed in the best interest of the City to approve the retirement and transfer of Ace to Officer Legnon to personally care for and assume all responsibility and future care and cost of ownership. NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR: Section 1 . That the facts and opinions in the preamble are true and correct. Section 2 . That the City Council of the City of Port Arthur hereby authorizes the retirement of police canine "Ace" and the transfer of the ownership of the canine to the personal care of Officer Tony Legnon, who agrees to assume all future responsibility, ownership, cost and care of the canine. Section 3 . That Officer Legnon shall sign this ordinance agreeing to the terms therein. Section 4 . That a copy of the Ordinance shall be spread upon the Minutes of the City Council . READ, ADOPTED AND APPROVED on this day of A.
