I. INVOCATION, PLEDGE & ROLL CALL
Councilmember Frank gave the invocation followed with the pledge to the flag.
The City Council of the City of Port Arthur met in Special Session on Tuesday, June 20,
2017 at 4:05 p.m. in the City Council Chamber, City Hall, with the following members
present: Mayor Derrick Freeman; Councilmembers Raymond Scott, Jr., Thomas Kinlaw,
III, Harold Doucet and Kaprina Frank City Manager Brian McDougal; City Secretary
Sherri Bellard and City Attorney Valecia Tizeno.
Councilmember Charlotte Moses joined the Special Executive Meeting at 4:07 p.m.
Mayor Pro Tem Jones joined the Special Executive Meeting at 4:15 p.m.
Councilmember Willie "Bae" Lewis joined the Special Executive Meeting at 4:15 p.m.
Councilmember Osman Swati was absent from the Special Executive Meeting.
II. *CLOSED MEETING (EXECUTIVE SESSION) — CONTINUED
Closed Meeting:
(1) Section 551.071 Government Code — To Discuss With The
City Attorney Pending Litigation Regarding Cause No. E-
194887; Reginald Trainer, Efrain Avendano, Paul Hulin And
Herman Levingston v. City of Port Arthur
(2) Section 551.071 Government Code — To Receive Legal
Advice And Consultation With The City Attorney Regarding
Potential Litigation As It Pertains To A Public Nuisance
(3) Section 551.072 Government Code — To Discuss The Value
Of The Land In The City's Extraterritorial Jurisdiction (ETJ)
(4) Section 551.087 Government Code — To Discuss Incentives
For Commercial, Residential, And/Or Industrial Business
Prospects (Impact Waste Recycling, LLC)
The City Council recessed their meeting at 4:05 p.m. to meet in Executive Session to
consider the above-mentioned topics, and reconvened their meeting at 5:53 p.m. with
the following members present: Mayor Freeman; Mayor Pro Tern Jones;
Councilmembers Scott, Kinlaw, Doucet, Lewis, Moses and Frank; City Manager
McDougal; City Secretary Bellard; City Attorney Tizeno and Sergeant At Arms Patrick
Melvin.
MOTION IN OPEN SESSION
The City Attorney read the following motion into the record:
A Motion To Execute A Compromise And Release Of Claim In The
Settlement Between The Parties In Cause No. E194887 In The
Amount Of $48,000.00 A Full Indemnity And Hold Harmless
Agreement Will Be Signed By The Opposing Parties Authorized
Representative Releasing The City Of Port Arthur Of Any And All
Claims Arising From The Incident Drafted In A Form That Will Be
Approved By The City Attorney Prior To The Execution Of The
Documents And Entry With The Court
Upon the motion of Councilmember Doucet, seconded by Councilmember Lewis the
above-mentioned motion was adopted.
Voting Yes: Mayor Freeman; Mayor Pro Tern Jones; Councilmembers Scott, Kinlaw,
Doucet, Lewis, Moses and Frank.
Voting No: None.
III. ADJOURNMENT
Upon the motion by Councilmember Kinlaw, seconded by Mayor Pro Tern Jones and
carried unanimously, the City Council adjourned their Special Meeting at 5:35 p.m.
An audio-tape of this meeting is on file in the office of the City Secretary and is made a
part of the official minutes of this meeting.
