ORDINANCE NO.
AN ORDINANCE DESIGNATING A PORTION OF LAND LOCATED IN
THE CITY OF PORT ARTHUR'S EXTRATERRITORIAL JURISDICTION
(ETJ) AS AN INDUSTRIAL DISTRICT PURSUANT TO 42.044 OF THE
TEXAS LOCAL GOVERNMENT CODE.
WHEREAS, a map of the City of Port Arthur's extraterritorial jurisdiction ([Ti) is
attached hereto in substantially the same form as Exhibit "A"; and
WHEREAS, pursuant to 42.044 (b) of the Texas Local Government Code, "the
governing body of a municipality may designate any part of its extraterritorial jurisdiction
as an industrial district and may treat the designated area in a manner considered by the
governing body to be in the best interests of the municipality."
WHEREAS, it is in the best interest of the citizens of Port Arthur to designate a
portion of land located in the City of Port Arthur's extraterritorial jurisdiction (ETJ) as an
Industrial District.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF PORT ARTHUR, TEXAS:
Section 1. That pursuant to 42.044 of the Texas Local Government Code, the
City of Port Arthur hereby designates a portion of land located in the City of Port Arthur's
extraterritorial jurisdiction (ETJ), as depicted in the map attached hereto as Exhibit "A",
as an Industrial District.
Section 2. That a copy of the caption of this Ordinance be spread upon the
Minutes of the City Council.
Section 3. This Ordinance shall be effective from and after the date of its
passage.
READ, ADOPTED AND APPROVED on this day of A.D.,
2017, at a Regular Meeting of the City Council of the City of Port Arthur, Texas, by the
