INVOCATION, PLEDGE & ROLL CALL Councilmember Scott gave the invocation followed with the pledge to the flag. The City Council of the City of Port Arthur met in Regular Session on Tuesday, September 12, 2017 at 5:30 p.m. in the City Council Chamber, City Hall, with the following members present: Mayor Derrick Freeman; Mayor Pro Tern Cal Jones, Councilmembers Raymond Scott, Jr., Thomas Kinlaw, III, Harold Doucet, Sr., Willie "Bae" Lewis, Jr., Osman Swati, Charlotte M. Moses and Kaprina Frank; City Manager Brian McDougal, City Secretary Sherri Bellard, City Attorney Valecia R. Tizeno, and Sergeant At Arms Chief of Police Patrick Melvin. II. PROCLAMATIONS & MINUTES Proclamations The Mayor issued the following proclamation: September 2017 as "National Suicide Prevention Month" III, PETITIONS & COMMUNICATIONS A. Speakers (1) Darwin Moore Regarding Issue's With the Port Arthur Police Department And Other City Departments - Not Present B. Presentations (1) Presentation By Concord EMS (Requested by Councilmember Lewis) - Not Present (2) Presentation By City Staff With Regard To Responsibilities Related To Storm Water Pumping Within The City Of Port Arthur (Request By Councilmember Lewis) Public Works Director Armando Gutierrez gave the above-mentioned presentation. C. Employee Recognition - None D. Correspondence - None E. Discussion (1) Discuss And Possibly Take Action Regarding Colonial Pipeline Company (Request By Councilmember Lewis) Upon the motion of Councilmember Swati, seconded by Councilmember Frank and carried, Executive Session will be re-opened at the end of this Regular Meeting to discuss the above-mentioned item. Voting Yes: Mayor Freeman; Mayor Pro Tern Jones; Councilmembers Scott, Kinlaw, Doucet, Lewis, Swati, Moses and Frank. Voting No: None. (2) Discuss And Possibly Take Action Regarding Amending Article III (Electrical Code) Of Chapter 18 (Building Code) Section 18-72 Pertaining To The Definition Of One Or Two Family Dwelling Unit Electrician (Residential Wireman) (Requested By Councilmember Lewis) Building Inspector Phil Vilardi appeared before the City Council to answer inquiries regarding the above-mentioned building code. IV. PUBLIC HEARINGS — 6:00 PM (1) A Public Hearing To Receive And Hear All Persons Desiring To Be Heard On Proposed Property Tax Rate Of $0.792000 Per $100 Valuation Has Been Proposed For Adoption By The Governing Body Of City Of Port Arthur. This Rate Exceeds The Lower Of The Effective Or Rollback Tax Rate, And State Law Requires That Two Public Hearings Be Held By The Governing Body Before Adopting The Proposed Tax Rate The Mayor introduced the above-mentioned Public Hearing at 6:16 p.m. The City Attorney gave an overview of the above-mentioned Tax Rate. The Mayor requested to hear from anyone present in the audience who wished to speak regarding the above-mentioned item. Warren Field, 1147 60th Street, appeared before the City Council to address the above- mentioned Tax Rate. Upon the motion of Councilmember Swati, seconded by Councilmember Frank and carried unanimously, the City Council closed the Public Hearing at 6:27 p.m. (2) A Public Hearing For The Purpose Of Hearing All Persons Interested In The Proposed Budget For The City Of Port Arthur And The Port Arthur Section 4A Economic Development Corporation For The Fiscal Year Beginning October 1, 2017 And Ending September 30, 2018. This Budget Will Raise More Total Property Taxes Than The Last Year's Budget By $321,100 Or 1.71% And Of That Amount, $156,946 Is Tax Revenue To Be Raised From New Property Added To The Tax Roll This Year The Mayor introduced the above-mentioned Public Hearing at 6:28 p.m. The Mayor requested to hear from anyone present in the audience who wished to speak regarding the above-mentioned item. No one appeared before the City Council to address the above-mentioned item. Upon the motion of Councilmember Swati, seconded by Councilmember Doucet and carried, the adoption of the Proposed Budget was postponed until the Special Meeting to be held on September 28, 2017 at 3:00 p.m. Voting Yes: Mayor Freeman; Mayor Pro Tern Jones; Councilmembers Scott, Kinlaw, Doucet, Lewis, Swati, Moses and Frank. Voting No: None. V. UNFINISHED BUSINESS - None VI. CONSENT AGENDA Upon the motion of Councilmember Swati, seconded by Councilmember Doucet and carried, the following Consent Agenda item was adopted. Voting Yes: Mayor Freeman; Mayor Pro Tem Jones; Councilmembers Scott, Kinlaw, Doucet, Lewis, Swati, Moses and Frank. City Council Minutes 2 Regular Meeting — September 12, 2017 Voting No: None. A. Expense Reports: (A1) Councilmember Charlotte Moses: Tour Aries Clean Energy Facility Nashville, TN, June 29-30, 2017 $1,206.52 VII. ITEMS REQUIRING INDIVIDUAL ACTION A. Resolutions - None B. Ordinances (1) P. O. 6640 - An Ordinance Amending Sections 18-33, 58- 122, 110-94, And 110-97 As It Pertains To Permit Schedule, Turn-On Charge, Location Of Recreational Vehicles And Adjustment Of Water Bilis As A Result Of Hurricane Harvey, And Providing An Effective Date The City Manager introduced the above-mentioned Proposed Ordinance. Upon the motion of Councilmember Frank, seconded by Councilmember Doucet and carried, Proposed Ordinance No. 6640 was adopted becoming Ordinance No. 17-33. Voting Yes: Mayor Freeman; Mayor Pro Tern Jones; Councilmembers Scott, Kinlaw, Doucet, Lewis, Swati, Moses and Frank. Voting No: None. The caption of Ordinance No. 17-33 reads as follows: ORDINANCE NO. 17-33 AN ORDINANCE AMENDING SECTIONS 18-33, 58-122, 110-94, AND 110-97 AS IT PERTAINS TO PERMIT SCHEDULE, TURN-ON CHARGE, LOCATION OF RECREATIONAL VEHICLES AND ADJUSTMENT OF WATER BILLS AS A RESULT OF HURRICANE HARVEY, AND PROVIDING AN EFFECTIVE DATE (2) P. O. 6642 - An Ordinance Amending Chapter 86 Subdivisions Article III Required Improvements Section 86-79 Who May Collect And Dispose Of Refuse (D) Refuse Disposal Rate Schedule As To Amend The Rate Schedule For The Landfill From Volume To Tonnage The City Manager introduced the above-mentioned Proposed Ordinance. Upon the motion of Councilmember Frank, seconded by Councilmember Moses and carried, Proposed Ordinance No. 6642 was adopted becoming Ordinance No. 17-34 Voting Yes: Mayor Freeman; Mayor Pro Tem Jones; Councilmembers Scott, Kinlaw, Doucet, Lewis, Swati, Moses and Frank. Voting No: None. The caption of Ordinance No. 17-34 reads as follows: ORDINANCE NO. 17-34 AN ORDINANCE AMENDING CHAPTER 86 SUBDIVISIONS ARTICLE III REQUIRED City Council Minutes 3 Regular Meeting — September 12, 2017 IMPROVEMENTS SECTION 86-79 WHO MAY COLLECT AND DISPOSE OF REFUSE (D) REFUSE DISPOSAL RATE SCHEDULE AS TO AMEND THE RATE SCHEDULE FOR THE LANDFILL FROM VOLUME TO TONNAGE (3) P.O. 6644 — An Ordinance Extending The Declaration Of Disaster And Emergency Pursuant To §418.108(b) Of The Texas Government Code The City Manager introduced the above-mentioned Proposed Ordinance. Upon the motion of Councilmember Frank, seconded by Mayor Pro Tem Jones and carried, Proposed Ordinance No. 6644 was adopted becoming Ordinance No. 17-35. Voting Yes: Mayor Freeman; Mayor Pro Tem Jones; Councilmembers Scott, Kinlaw, Doucet, Lewis, Swati, Moses and Frank. Voting No: None. The caption of Ordinance No. 17-35 reads as follows: ORDINANCE NO. 17-35 AN ORDINANCE EXTENDING THE DECLARATION OF DISASTER AND EMERGENCY PURSUANT TO §418.108(B) OF THE TEXAS GOVERNMENT CODE VIII.
