ORDINANCE NO.
AN ORDINANCE TERMINATING THE LOCAL STATE OF
DISASTER FOR THE CITY OF PORT ARTHUR
WHEREAS, pursuant to the Texas Government Code, Chapter 418, (the "Texas
Disaster Act"), and Section 15, Article II of the Charter, the City of Port Arthur, Texas
declared a state of local disaster on August 24, 2017 due to imminent threat from
Hurricane Harvey; and
WHEREAS, in accordance with Texas Government Code Section 418.108(b), the
declaration of local state of disaster may not be continued or renewed for a period of
more than seven (7) days except with the consent of the City Council of Port Arthur,
Texas; and
WHEREAS, the City Council continued or renewed the declaration of local state
of disaster pursuant to Ordinance Nos. 17-28, 17-32, 17-35, 17-36, and 17-37; and
WHEREAS, because the City suffered widespread damage, the City activated its
Emergency Management Plan and the City Council determined that extraordinary
measures were needed to alleviate the suffering of people and to protect or rehabilitate
property; and
WHEREAS, the conditions necessitating the declaration of a local state of
disaster have ceased to exist; and
WHEREAS, the Texas Disaster Act provides that a local state of disaster may be
terminated by the governing body of the political subdivision or by executive order of
the Mayor; and

WHEREAS, the City Council of the City of Port Arthur, Texas, pursuant to Texas
Government Code Section 418 deems it in the best interest of the City of Port Arthur to
end the declaration of local state of disaster for the City of Port Arthur, Texas.
NOW THEREFORE, BE IT DECLARED BY THE CITY COUNCIL OF THE
CITY OF PORT ARTHUR, TEXAS:
THAT the facts and opinions in the preamble are true and correct
THAT the City Council, as the governing body of the City of Port Arthur hereby
terminates the proclamation/declaration of state of local disaster described in the
preamble.
THAT public emergency exists requiring that this ordinance be passed formally on
the date of its introduction; therefore, this ordinance shall take effect immediately upon
its passage.
THAT a copy of the caption of this Ordinance be spread upon the Minutes of the
City Council.
READ, ADOPTED AND APPROVED on this day of October A.D., 2017, at
a Regular Meeting of the City Council of the City of Port Arthur, by the following vote:
