Introduction:
Authorize the second year, first renewal, of the contract for the repairing/refurbishing
commercial refuse containers for the Public Works Solid Waste Division.
Background:
This is an annual contract for repairing/refurbishing commercial containers used at business
throughout the City. Double W. Services, L.L.C. was awarded the contract on Resolution 17-
011, with an option to renew for two additional years, This is the second year of this contract.
Budget Impact:
The projected budgetary impact is estimated at $50,000. Funds are provided in account no.
403-1273-533.59-00, Public Works Solid Waste Container Service Division—Other
Contractual Services.
Recommendation:
Approve the second year of the repairing/refurbishing commercial refuse containers with
Double W. Services, L. L. C.

RESOLUTION NO.
A RESOLUTION AUTHORIZING THE FIRST RENEWAL,
SECOND YEAR, OF AN ANNUAL CONTRACT WITH DOUBLE
W. SERVICES, L.L.C. OF MERIDIAN, TEXAS FOR THE
REPAIR AND REFURBISHING OF REFUSE CONTAINERS
WITH A PROJECTED BUDGETARY IMPACT IN THE
AMOUNT OF $50,000. FUNDING IS AVAILABLE IN ACCOUNT
NO. 403-1273-533.59-00, PUBLIC WORKS DEPARTMENT
SOLID WASTE CONTAINER SERVICE DIVISION — OTHER
CONTRACTUAL SERVICES.
WHEREAS, Double W. Services, L.L. C. was awarded a contract to repair and refurbish
refuse containers for the City through Resolution#17-001; and,
WHEREAS, this is the first renewal, second year, of an annual contract with a two year
renewal option; now therefore,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT
ARTHUR:
THAT, the City Manager is hereby authorized to execute the first renewal, second year
of the contract to repair and refurbish refuse containers with Double W. Services, L. L. C., of
Meridian, Texas, in substantially the same form as attached hereto as Exhibit"A"; and,
THAT, funding is available in account 403-1273-533.59-00, Public Works Solid Waste
Container Services Division—Other Contractual Services; and,
THAT a copy of the caption of this Resolution be spread upon the Minutes of the City
Council.
READ, ADOPTED, AND APPROVED this the day of , A.D. 2017 at

EXHIBIT "A"
CONTRACT FOR REPAIRING/REFURBISHING OF
REFUSE CONTAINERS
THIS AGREEMENT, made this the day of , 2017 by and between the
City of Port Arthur, a municipal corporation organized under the laws of the State of Texas,
hereinafter called"OWNER" or"CITY", and Double W. Services,L.L.C., hereinafter called
"CONTRACTOR".
WITNESSED: That for and in consideration of the payment terms, conditions and agreements
set forth herein, OWNER and CONTRACTOR agree as follows:
1. The term of this Agreement shall be for one (1) year from the date stated on the Notice to
Proceed,with an option to renew for one (1) additional one year period, unless sooner
terminated under the provision hereof. The City can terminate this contract at its
convenience which includes, but is not limited to, funding not being available in any
budget cycle within fifteen(15) days written notice.
2. During the term of this Contract,the CONTRACTOR will furnish at his own expense all
of the materials, supplies, tools, equipment, labor, and other services necessary to
connection therewith, excepting those supplies specifically not required of
CONTRACTOR in the Specifications.
3. The CONTRACTOR agrees to perform all the work described in the Specifications and
Contract Documents and comply with the terms therein for the prices as stated in the
attached bid.
4. The term"Contract Documents" means and includes the following:
1) Agreement
2) Invitation to Bid *
3) *
4) Specifications *
5) Bid *
6) Bidder's Information Sheet *
7) Notice to Proceed
*These items were attached to the original letting contract. This agreement is
only included in this renewal.
5. This Agreement shall be binding upon all parties hereto and their respective heirs,
executors, administrators, successors, and assigns.
6. IN WITNESS WHEREOF,the parties here to have executed, or caused to be executed by
their duly authorized officials, this Agreement in two (2) copies, each of which shall be
deemed an original of the date first written above.
