Havens, Deputy Fire Chief RE: P.R. 19995—Purchase of SHSP Funded Hazmat Equipment Introduction: The intent of this Agenda Item is to seek the City Council's approval for the Fire Department to purchase Radiation, Biological, and Chemical detection equipment with funds awarded by the Office of the Governor for Fiscal Year 2017 State Homeland Security Program-Law Enforcement Terrorism Prevention Program(SHSP-LETPP) from FarrWest Environmental Supply, Inc., the sole—source, Authorized Partner for Texas for Smiths Detection, Inc. (sole manufacturer with products protected by specific trade patents and cannot be duplicated for any purpose). Grant funds were awarded specifically to fund the purchase of Biological/ Etiologic agent detection equipment, and radiation monitoring and detection equipment for the Fire Department's Hazardous Materials Response Team in the amount of$39,126. Background: On Feb. 28, 2017, Res. 17-056 passed authorizing the City Manager to apply for the 2017 State Homeland Security Program—Law Enforcement Terrorism Prevention grant. The Office of the Governor made notification that the City of Port Arthur was awarded $81,158 based on the application. These funds were awarded to purchase hazardous materials,radiological, biological and chemical detection equipment, and protective ensembles for dive team operators and hands free tactical radio equipment for the SWAT team. Budget Impact: There is no cash match requirement for this grant. Funds are budgeted in account 001-1121- 522.25-00 for this purchase. A RESOLUTION AUTHORIZING THE FIRE DEPARTMENT TO PURCHASE HAZARDOUS MATERIALS RESPONSE TEAM EQUIPMENT FROM FARRWEST OF SCHERTZ, TEXAS, IN THE AMOUNT OF $39, 126 . 00 WITH FUNDS AWARDED FROM THE 2017 STATE HOMELAND SECURITY PROGRAM-LAW ENFORCEMENT TERRORISM PREVENTION PROGRAM (SHSP-LETPP) GRANT; FUNDS AVAILABLE IN FIRE/MINOR EQUIPMENT ACCOUNT NO. 001- 1121-522 .25-00 WHEREAS, on February 28 , 2017 , Council passed Resolution No. 17-056 authorizing the City Manager to apply for the fiscal year 2017 State Homeland Security Program - Law Enforcement Terrorism Prevention Program grant; and WHEREAS, the Office of the Governor made notification that the City of Port Arthur was awarded funding from the FY 2017 State Homeland Security Grant Program (SHSP) and Law Enforcement Terrorism Prevention Program (LETPP) in the amount of $81, 158 ; and WHEREAS, on November 7, 2017, Council passed Resolution No. 17-292 authorizing the City Manager to accept the fiscal year 2017 State Homeland Security Program - Law Enforcement Terrorism Prevention Program grant; and WHEREAS, the Fire Department is in need of Hazardous Materials Radiological, Biological, and Chemical Detection Equipment; and WHEREAS, Smiths Detection, Inc . is the sole manufacturer of the Smith Detection products, services and software, and each product is protected by specific trade patents and cannot be duplicated for any purpose (see Exhibit "A" ) ; and WHEREAS, FarrWest Environmental Supply, Inc . is the sole- source, Authorized Partner for Texas (see Exhibit "A" ) ; and WHEREAS, the Hazardous Materials Radiological, Biological, and Chemical Detection Equipment can only be purchased directly through FarrWest Environmental Supply, Inc . in the State of Texas (see Exhibit "A" ) ; and WHEREAS, this type of procurement which is available from one source is authorized pursuant to §252 . 022 (a) (7) (A) of the Texas Local Government Code, which are items that are available from only one source, because of patents, copyrights, secret processes, or natural monopolies; and WHEREAS, the SHSP-LETPP Grant is 1000 funded with no cash match requirement; and WHEREAS, funds were budgeted and are available in account 001-1121-522 . 25-00 for this purchase; and WHEREAS, the City Council finds it in the best interest of the citizens of the City of Port Arthur that the Fire Department purchase and field the aforementioned equipment from FarrWest Environmental Supply, Inc . , in the amount of $39, 126 . 00 (see Exhibit "B" ) ; and WHEREAS, City Council agrees that in the event of loss or misuse of the Office of the Governor funds, City Council assures that the funds will be returned to the Office of the Governor in full . NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR: Section 1. That the facts and opinions in the preamble are true and correct . Section 2 . That the Fire Department is authorized to use funds from the Office of the Governor for Fiscal Year 2017 State Homeland Security Program-Law Enforcement Terrorism Prevention Program (SHSP-LETPP) grant to purchase Special Operations Equipment in the amount of $39, 126 from FarrWest Environmental Supply, Inc . of Schertz, Texas, as delineated in Exhibit "B" . Section 3 . That a copy of the Resolution shall be spread upon the Minutes of the City Council .
