INVOCATION, PLEDGE & ROLL CALL Councilmember Scott gave the invocation followed with the pledge to the flag. The City Council of the City of Port Arthur met in Special Session on Monday, November 13, 2017 at 4:00 p.m. in the City Council Chamber, City Hall, with the following members present: Mayor Derrick Freeman; Mayor Pro Cal Jones; Councilmembers Raymond Scott, Jr., Thomas Kinlaw, III, Harold Doucet, Sr., Willie "Bae" Lewis, Jr. and Charlotte M. Moses; City Manager Brian McDougal; City Secretary Sherri Bellard and City Attorney Valecia Tizeno. Councilmember Kaprina Frank joined the Special Meeting at 4:07 p.m. Councilmember Osman Swati was absent from the Special Meeting. II. *CLOSED MEETING (EXECUTIVE SESSION) Closed Meeting: (1) Section 551.074 Government Code — To Discuss The Duties, Responsibilities, Discipline, Or Dismissal Of The City Manager (Requested By Councilmember Doucet) Pursuant To Texas Government Code 551.074 (b), The Officer Or Employee Who Is The Subject Of Deliberation Or Hearing, May Require The Governmental Body To Conduct An Open Meeting If The Employee Requests A Public Hearing. *The City Manager Has Requested That This Provision Be Invoked. The City Council recessed their meeting at 4:04 p.m. to meet in Executive Session to consider the above-mentioned topics, and reconvened their meeting at 6:35 p.m. with the following members present: Mayor Freeman; Mayor Pro Tem Jones; Councilmembers Scott, Kinlaw, Doucet, Lewis, Moses and Frank; City Manager McDougal; City Secretary Bellard; City Attorney Tizeno and Sergeant At Arms Chief Patrick Melvin The City Attorney read the following motion into the record: MOTION IN OPEN SESSION A Motion To Accept The Resignation Of City Manager Brian McDougal Effective November 21, 2017. The Parties Agree That Brian McDougal Will Be Placed On Administrative Leave With Pay Until November 21, 2017. The City Further Agrees To Accept A Separation Agreement With Brian McDougal Based Upon The Terms Agreed Upon By The Parties. In Accordance With The Charter Of The City Of Port Arthur, The Assistant City Manager, Dr. Jimmie Johnson, Will Serve Until An Interim City Manager Is Appointed. The motion was made by Councilmember Lewis and seconded by Mayor Pro Tem Jones that the above-mentioned motion be adopted. The following roll call vote was taken on the motion to adopt the above-mentioned motion: Councilmember Doucet "Yes" Councilmember Frank "Yes" Mayor Pro Tem Jones "Yes" Councilmember Kinlaw "Yes" Councilmember Lewis "Yes" Councilmember Moses "Yes" Councilmember Scott "Yes" Mayor Freeman "Yes" The above-mentioned motion was adopted. III. ADJOURNMENT Upon the motion by Councilmember Moses, seconded by Mayor Pro Tem Jones and carried unanimously, the City Council adjourned their Special Meeting at 6:36 p.m. An audio-tape of this meeting is on file in the office of the City Secretary and is made a part of the official minutes of this meeting.
