ORDINANCE NO.
AN ORDINANCE AUTHORIZING DEED RESTRICTIONS THAT PROHIBIT THE USE
OF DESIGNATED GROUNDWATER FROM BENEATH THE 10 . 02 ACRES LOCATED
AND ADDRESSED AS 1500 INTRACOASTAL ROAD TO FACILITATE
CERTIFICATION OF A MUNICIPAL SETTING DESIGNATION OF SAID PROPERTY
BY THE TEXAS COMMISSION ON ENVIRONMENTAL QUALITY ("TCEQ")
PURSUANT TO THE TEXAS SOLID WASTE DISPOSAL ACT; AND PROVIDING FOR
AN EFFECTIVE DATE OF THIS ORDINANCE
WHEREAS, Chapter 361, Subchapter W of the Texas Solid Waste
Disposal Act (the "MSD Legislation" ) authorizes the TCEQ to
certify Municipal Setting Designations for properties upon the
receipt and approval of a properly submitted application to the
TCEQ; and,
WHEREAS, the Texas Legislature, in enacting the MSD
Legislation, found that an action by a municipality to restrict
access to or the use of groundwater in support of or to
facilitate a Municipal Setting Designation advances a substantial
and legitimate state interest; and,
WHEREAS, as part of the application process for a Municipal
Setting Designation, the Applicant is required to provide
documentation that the property for which the designation is
sought is subject to an ordinance that prohibits the use of the
designated groundwater from beneath the property as potable
water; and,
WHEREAS, Port Arthur Barge, Inc . , (formerly known as
Carotex, Inc . ) (hereinafter "Applicant" ) is in the process of
submitting an application to the TCEQ for certification of a
Municipal Setting Designation for the 10 . 02 acres of land
described in Exhibit "A" , and made a part hereof (the "MSD
Property" ) , said MSD Property being located within the limits of
the City of Port Arthur; and
WHEREAS, Applicant has certified to the City of Port Arthur
that :
1 . The purpose of such application is to assist
Applicant in obtaining from the TCEQ
determination that Applicant has met the
requirements of the MSD Legislation including a
prohibition against the use of the designated
groundwater for potable purposes ( "TCEQ MSD
Certificate" ) ; and
2 . As a part of such application, Applicant will
submit a statement to the TCEQ regarding the
type of known contamination in the groundwater
beneath the MSD Property; and
WHEREAS, a public drinking water supply system exists that
satisfies the requirements of the MSD Legislation for the MSD
Property and property within one-half mile of the MSD Property;
and,

WHEREAS, Applicant strongly desires, and the owner of the
MSD Property approves of the implementation of, a Municipal
Setting Designation for the MSD Property, as well as a TCEQ
MSD Certificate, and has requested the City of Port Arthur to
facilitate said objectives through passage of this Ordinance
pertaining to deed restrictions prohibiting the use of designated
groundwater from beneath the MSD Property; and
WHEREAS, the City Council of Port Arthur is of the opinion
that it is in the best interest of the public and the City to
facilitate Applicant' s efforts to secure a Municipal Setting
Designation and TCEQ MSD Certificate from the TCEQ by passage of
the Ordinance set forth hereinafter.
NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF PORT ARTHUR, TEXAS :
Section 1. That the facts and opinions in the preamble of
this Ordinance are true and correct and made a part of and fully
effective as if set forth in this Ordinance in their entirety.
Section 2 . That the City Council finds that it is in the
best interest and welfare of the public to facilitate the TCEQ' s
certification of a Municipal Setting Designation for the MSD
Property.
Section 3 . That to facilitate the TCEQ' s certification of a
Municipal Setting Designation for the MSD Property, the City
shall execute, deliver and file in the official property records

of Jefferson County, Texas, a certified copy of the Ordinance,
herein, prohibiting the use of designated groundwater for any
potable purpose .
Section 4 . That for purposes of this MSD Ordinance, the
designated groundwater shall mean below the surface of the MSD
Property to a depth of fifty (50) feet (the "Designated
Groundwater" ) .
Section 5 . That the Ordinance prohibiting potable use of the
Designated Groundwater shall run with the land and be binding on
and enforceable as to any and all subsequent owners of the MSD
Property.
Section 6 . That this Ordinance shall take effect
immediately from and after its passage and publication in
accordance with the provisions of the Charter of the City of
Port Arthur, and it is accordingly ordained.
Section 7 . That a copy of the caption of this Ordinance be
spread upon the Minutes of the City Council .
