NO. 20051 — APPOINTING AND/OR REAPPOINTING ONE (1) REGULAR MEMBER TO THE CONSTRUCTION BOARD OF ADJUSTMENTS AND APPEALS COMMENT Nature of the Request: Staff recommends that the City Council adopt P. R. No. 20051, appointing and/or reappointing one (1) member to the Construction Board of Adjustments and Appeals. There is a vacancy for a regular board member and an appointment needs to be made. The term for a Construction Board member is two (2) years; therefore the term for the appointed Construction Board Member will begin on December 19, 2017, and expire on December 19, 2019. This will fill seven (7) of the nine (9) positions on the Construction Board. Staff Analysis/Considerations: City Council approved Ordinance #17-46 On November 7, 2017, which changed the rules and regulations of the CBOAA and increased the number of board members to nine (9). Previously the make-up of the Board was five(5) regular members and two (2) alternate members. The CBOAA was unable to hold a Public Hearing on December 7, 2017 due to lack of a quorum (5 members). They however, would have been able to operate under the original make-up of the Board. Cancellation of the December 7th meeting cost the City $2,000 in advertising and $638.24 in postage. We will have to readvertise and re-letter the owners of all properties at that same cost to hold the next meeting. Further, at least 14 citizens were in attendance (some of which had taken off from jobs and traveled distances). Staff is concerned that a quorum will be difficult to attain under the new ordinance. Recommendation: Staff recommends that the City Council adopt P. R. No. 20051, thereby appointing and/or reappointing one (1) regular member to the Construction Board of Adjustments and Appeals. A RESOLUTION APPOINTING AND/OR REAPPOINTING A MEMBER OR MEMBERS TO THE CONSTRUCTION BOARD OF ADJUSTMENTS AND APPEALS (REQUESTED BY MAYOR PRO TEM JONES) WHEREAS, Ordinance No. 98-04 created the Construction Board of Adjustments and Appeals;and WHEREAS, Ordinance No. 15-25 amended Ordinance No. 98-04;and WHEREAS, Ordinance No. 17-46 Amended Ordinance No. 15-25 and the membership in the Board is comprised of nine (9) regular members;and WHEREAS, the scope of duties of the Board is delineated in the Building Code, and Section 54.033 Local Government Code,and in Ordinance No. 17-46;and WHEREAS,the current makeup of the Board is delineated in Exhibit"A";and WHEREAS, as shown in the attached Exhibit "A", there is a vacancy for a regular board member and an appointment needs to be made;and WHEREAS,any Councilmember can make a motion to nominate a person. WHEREAS, Mayor Pro Tem Jones wishes to nominate Richard Williams as a regular board member to the Construction Board of Adjustments and Appeal. NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR: Section 1.THAT the facts and opinions in the preamble are true and correct. Section 2.THAT the City of Port Arthur hereby confirms the appointment of Richard Williams, as a regular member to the Construction Board of Adjustments and Appeals. Section 3. THAT the terms of the new members shall be two (2) years. Section 4.THAT in accordance with Resolution No. 98-157,these appointees shall immediately contact the City Secretary,be sworn in, and receive a copy of Ordinance No. 17-46. 1 P. R.
