AN ORDINANCE ADDING TO CHAPTER 14, BOARDS, AUTHORITIES, COMMISSIONS AND COMMITTEES, ARTICLE XXIII - PORT ARTHUR ELECTRICAL ADVISORY BOARD TO THE CODE OF ORDINANCES CREATING SAID BOARD, ESTABLISHING MEMBERSHIP CRITERIA, TERMS OF OFFICE, AND DELINEATING DUTIES OF SAID BOARD (REQUESTED BY COUNCILMEMBER LEWIS) WHEREAS, Councilman Lewis has requested that the City Council consider specific changes to the Code of Ordinances of the City of Port Arthur, which will require the establishment of an Electrical Advisory Board; and, WHEREAS, Section 1305.201 of the Texas Occupations Code permits a City to regulate its own electricians under specific circumstances and in order to facilitate the requested changes, the City Council must authorize the establishment of a board by ordinance to regulate local electricians; and, WHEREAS, Article XXIII will be added of Chapter 14 of the Code of Ordinances in order to create the Electrical Advisory Board, establish membership criteria, set terms of office, and delineate the duties and responsibilities said board, to be determined by the City Council in Exhibit "A"; and, WHEREAS, the Board will be consisted of nine (9) appointed members consistent with the City Council seats that can only be removed by just cause; and, WHEREAS, the appointees will serve three (3) year terms and will continue to serve until they are replaced or reappointed. NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR, TEXAS: Section 1. That the facts and opinions in the preamble are true and correct. Section 2. That Chapter 14, Article XXIII will be added to the Code of Ordinances of City of Port Arthur creating the Electrical Advisory Board in manner prescribed by the City Council as delineated in Exhibit "A". Section 3. That a copy of the caption of this Ordinance be spread upon the Minutes of the City Council. Section 4. That the ordinance shall be effective immediately. Derrick Ford Freeman, Mayor ATTEST: Sherri Bellard, City Secretary EXHIBIT "A" TO BE DETERMINED BY THE CITY COUNCIL Exhibit "A" (a) Duties of the Board. The duties and responsibilities of the Board shall include the following: 1. Act in conformity with 1305.201 of the Texas Occupations Code. 2. Hear all cases involving revocation of a license or registration, recommend suspension, probation, or revocation of license for violations 3. Conduct those hearings and appeals that are provided in this code to be conducted by the Electrical Board. 4. Hear appeals from decisions of the building official concerning interpretation of this code and the use of alternate materials and wiring methods; provided, however, the Board shall not have jurisdiction to hear any matter that is the subject of any case pending before the municipal courts. (b) This board will be in compliance with the State of Texas's electrical safety and licensing advisory board as set forth in 1305.051 of the Texas Occupations Code. Therefore, City of Port Arthur's electrical safety and licensing board will consist of nine members appointed by the governing body of the City as follows: (1) three master electrician members; (2) three journeyman electrician members; (3) one master sign electrician member; and (4) two public members. (c) The advisory board members must include: (1) two members who are affiliated with a statewide association of electrical contractors not affiliated with a labor organization; (2) three members who are affiliated with a labor organization; (3) one member who is not affiliated with a statewide association of electrical contractors or with a labor organization; (4) one member who is affiliated with a historically underutilized business, as that term is defined by Section 2161.001, Government Code ; and (5) one public member who is a building contractor principally engaged in home construction and is a member of a statewide building trade association. (6) A licensed electrical engineer or an electrical inspector may be appointed as a public member of the advisory board. (7) An appointment to the advisory board shall be made without regard to the race, color, disability, sex, religion, age, or national origin of the appointee.
