JDC Fluid Equipment, LLC is the Texas distributor for Fairbanks Morse products and should be considered as a sole source, because changing the brand of pumps might require modifications to the pump station. JDC Fluid Equipment, LLC of Houston, Texas has provided a quote of$35,293.45 this includes a five percent (5%) discount from original quote plus freight not to exceed $1,000.00; funding is available in 410-1255-532.42-00, Equipment Maintenance. Staff Analysis, Considerations: City of Port Arthur employees will install pump. Budget Considerations: This pump will be charged to Water and Sewer Account No. 410-1255-532.42-00, Equipment Maintenance. Recommendation: I recommend that the City Council approve Proposed Resolution No. 20090 to authorize the execution of a contract in the amount of $35,293.45 with a five percent (5%) discount from original quote and freight not to exceed $1,000.00 for a Fairbanks Morse Solids Handling Pump from Kansas City, Kansas to Port Arthur, Texas for the Water and Sewer Department. A RESOLUTION AUTHORIZING THE EXECUTION OF A CONTRACT FOR THE PURCHASE OF ONE (1) FAIRBANKS MORSE VERTICAL COUPLED SOLIDS HANDLING PUMP FOR THE WATER AND SEWER DEPARTMENT WITH JDC FLUID EQUIPMENT,LLC OF HOUSTON, TEXAS IN THE AMOUNT OF $35,293.45 PLUS FREIGHT NOT TO EXCEED $1,000.00. FUNDS ARE AVAILABLE IN ACCOUNT NO. 410-1255-532.42, EQUIPMENT MAINTENANCE. WHEREAS, the Water and Sewer Department maintains lift stations throughout the City; and, WHEREAS, a pump in North Plant Lift Station is beyond repair and in need of replacement; and, WHEREAS, Pentair Flow Technologies sells its products, Fairbanks Morse Equipment for Municipal Water and Wastewater Market, through distributors exclusive to geographic areas; and, WHEREAS, the current distributor for our area (sole source) is JDC Fluid Equipment, LLC; and, WHEREAS, this purchase is authorized by Procurement Policies and Procedures Section 3-105 Sole Source Procurement, b) Compatibility—The product must match an existing brand of equipment for compatibility and is available from only one supplier; and, WHEREAS, this procurement is exempt from the bid process under Texas Local Government Code Section 252.022, General Exemptions(A)(7) (D), captive replacement parts or components for equipment; and, WHEREAS, the sole source for bids has been evaluated by the Water and Sewer Department and Purchasing (quote sheet attached as Exhibit"A"),NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF CITY OF PORT ARTHUR: P. R. No. 20090 1/23/18ds Page 2 of 3 THAT, the Interim City Manager of City of Port Arthur is hereby authorized and directed to execute, on behalf of City of Port Arthur, a contract between City of Port Arthur and JDC Fluid Equipment, LLC, for the unit price shown in Exhibit "A", in $35,293.45 with a five percent (5%) discount from original quote plus freight not to exceed $1,000.00 for a Fairbanks Morse Solids Handling Pump from Kansas City, Kansas to Port Arthur, Texas, as shown in the contract attached as Exhibit"B"; and, THAT, funding for this material is provided for in the Water and Sewer budget; and, THAT, a copy of the caption of this resolution be spread upon the minutes of City Council.
