No.20094—Resolution authorizing the execution of an agreement between the City of Port Arthur and the Port Arthur Economic Development for a Disaster Recovery Plan. Introduction: The intent of this Agenda Item is to request that City Council authorize an agreement between the City of Port Arthur and the Port Arthur Economic Development Corporation as it pertains to the administrative charges to be used for a Disaster Recovery Plan in relation to Hurricane Harvey, in an amount not to exceed $50,000. Background: The City of Port Arthur was devastated by an unprecedented rain event that caused by Hurricane Harvey that resulted in severe flooding throughout the City on August 29, 2017. Budget Impact: The Port Arthur Economic Development Corporation will fund the administrative cost associated with developing a Disaster Recovery Plan in relation to Hurricane Harvey in the not to exceed amount of$50,000. Funding available in EDC Account No. 120-1429-582-59-iQc 05 Recommendation: It is recommended that City Council authorize an agreement between the City of Port Arthur and the Port Arthur Economic Development Corporation as it pertains to the administrative charges to be used for a Disaster Recovery Plan in relation to Hurricane Harvey, in an amount not to exceed$50,000. A RESOLUTION AUTHORIZING THE EXECUTION OF AN AGREEMENT BETWEEN THE CITY OF PORT ARTHUR AND THE PORT ARTHUR ECONOMIC DEVELOPMENT CORPORATION AS IT PERTAINS TO ADMINISTRATIVE CHARGES TO BE USED FOR A DISASTER RECOVERY PLAN IN RELATION TO HURRICANE HARVEY, IN THE AMOUNT NOT TO EXCEED $50,000 FUNDING AVAILABLE IN EDC ACCOUNT NUMBER 120-1429-582.59- 05. WHEREAS,the City Council of the City of Port Arthur hereby deems it to be in the best interests of the citizens of the City of Port Arthur to authorize the City of Port Arthur "Type A" Economic Development Corporation to expend funds not to exceed $50,000.00 for the development of a disaster recovery plan in relation to the Hurricane Harvey flooding event that devastated Port Arthur, Texas on August 29, 2017. NOW,THEREFORE,BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR, TEXAS: Section 1. That the facts and opinions of the preamble are true and correct. Section 2. The City of Port Arthur is authorized to enter into an administrative service agreement with the City Port Arthur Economic Development Corporation for the development of a disaster recovery plan in relation to the Hurricane Harvey flooding event the devastated Port Arthur, Texas on August 29, 2017. Funding will not exceed $50,000.00. Section 3. That this Agreement is subject to Economic Development Corporation funds being made available. Section 4. That a copy of the caption of this Resolution be spread upon the minutes of the City Council. P.R. No. 20094) STATE OF TEXAS § COUNTY OF JEFFERSON § AGREEMENT The City of Port Arthur and the City of Port Arthur Section 4A Economic Development Corporation herein agree as to the following: I. The City and the City of Port Arthur Section 4A Economic Development Corporation herein agree that it is in the best interest of both parties and the citizens of Port Arthur to enter into an agreement related to a recovery plan as a result of the damages that stemmed from Hurricane Harvey. For the fiscal year October 1, 2017 to September 30, 2018, the City of Port Arthur Section 4A Economic Development Corporation shall pay to the City fifty thousand dollars ($50,000) of sales tax revenue received during the fiscal year. Said funding $50,000 will be used by the City of Port Arthur for the preparation of a Disaster Recovery Plan in relation to Hurricane Harvey. Said funding will be paid by Port Arthur Section 4A Economic Development Corporation upon the submission of invoices by the Director of Community Services for the development of a City Disaster Recovery Plan. II. a. The City will develop a professional disaster recovery plan in relation to Hurricane Harvey and the resulting flooding event that devastated Port Arthur, Texas on or about August 29, 2017. b. The EDC Staff can call on and have reasonable access to relevant city departments to address issues with respecting to the development and implementation of the project. c. The EDC Staff shall have access to non-confidential city records needed to facilitate the project. III. The City and the EDC herein agree that the EDC shall also pay the City its proportionate share of the audit fees that can be allocated to the EDC as it pertains to the development of a disaster recovery plan.
