On December 18, 2017, the Planning and Zoning Commission voted 4:0 to accept Site Plan
request: S 17-08.
On Wednesday, May 24, 2017, the City's Development Review Committee reviewed the
proposed development in accordance with all local/state/federal ordinances and other regulatory
guidelines. Specific instructions were given to the Developer as it relates to the establishment of
an RV Resort in the City of Port Arthur.

RECOMMENDED ACTION:

Sec. 57-123 - Approval of plans and plats required.
(a) Any person intending to establish a recreational vehicle park shall first discuss die development
wills the director of planning or elle designated planner to determine the steps and processes
involved in successfully receiving approval.
(b) The second step involves scheduling a Prc-Development meeting through the Planning
Division. At this meeting, the owner/developer, architect, contractor and others associated with
the park's desigil mid construction shall have the opportunity to discuss with representatives
Froin various city departments all the requirements for such a development.
(c) "Then the developer shall submit a site plan complying with all the requirements for an RV Park
listed in Chapter 58, Article III, Sections 58-121 through 58-132. Such application shall slate
the name and address of the person desiring to engage In such business, and if the applicant is
a partnership or corporation, the nacres and addresses of the respective partners and/or
directors, and a description of the property, including street address of the premises where such
RV park is to be operated so that it can be easily identified. It shall also give the naune of the
owner of such premises, and such other and lurtllcr information as may be required by the city.
This submittal shall consist of one reproducible copy of the plan and a digital copy that can be
clearly printed in 36 -inch by 48 -inch size. "The plan shall consist of an accurate drawing at a scale
of not more than 200 feet to die inch, which shows the exact dimensions ol' the tract of land
under consideration, its relationship to existing mid proposed streets and contiguous properties,
the type and use of all adjacent property, access provisions, and lice exact land use proposed for
the entire tract, including screening devices, private streets, recreational vehicle sites, usable
open space, parking, lighting, utilities, structures, and any other items required to properly
describe the proposed park layout. No person shall alter a recreational vehicle park to the extent
of- changing or significantly adding to that which is shown on the site plan on file with lfle
planning and zoning commission without first filing an amended site plan in the salve manner
as all original site plan. The director of planning shall have the right to refuse to exanline any
incomplete, unintelligible or indefinite site plan. The above describe plan shall be submitted
not less than eight days prior to any scheduled planning and zoning commission meeting during
which the plan is to be considered for approval or rejection.
(d) The planning and zoning commission shall notify the applicant in writing as to whether the plus
was approved or disapproved, stating the reasons for disapproval and the modifications or
conditions that must be made or islet belorc approval can be obtained upon subsequent
Submission.

SECTION 1. AREA
That the zoning designation of the following described tract of
land be and the same is hereby zoned 11PD-611, Planned Development -6
District under the provisions of section 17:
3.267 acres out of the W. Kyle Survey, No. 276, Abstract
No. 414, and 27.634 acres out of Palomar Section 3, Port
Arthur, Jefferson County, Texas and located on the north
side of State Highway 73 between F.M. 823 (West Port Arthur
Road) and the L.N.V.A. Canal.
SECTION 2. PERMITTED USES
A. All uses permitted in the "LC", Light Commercial District
and "I"Industrial District with the exception of the following which
are prohibited:
1. Residential (except Motel or Hotel and Caretaker or

SECTION 3. DEVELOPMENT STANDARDS
A. General Development Standards
The coverage, off-street parking, off-street loading, height
and yards shall comply with the standards established in the "LC",
Light Commercial District for all uses unless authorized herein or
specified on the site development plan approved by the Planning and
zoning Commission. Noise standards shall be those established for
Industrial Districts.
B. Major Thoroughfare Building Setback and Landscaping
Standards
1. No building, sign, structure or other structural improve-
ment shall be erected nearer than twenty-five (25) feet to the
right-of-way of State Highway 73 or State F.M. 8.23 (West Port Arthur
Road)). Driveways may be constructed across the land strip created
by such setbacks but no portion of any such driveway which may be
parallel to or approximately parallel to any street right-of-way

lane nor any off-street parking area adjacent to right-of-way shall
be located nearer than fifteen (15) feet to such right-of-way line;
it being the purpose and intent of this provision to create a
minimum fifteen (15) foot strip for lawn, planting and general
landscaping purposes between any building and the street
right-of-way and to permit only the construction of essential
driveways and walks crossing such strip. One tree with a minimum
2.5 inch caliper (average diameter of tree measured four (4) feet
above the ground) shall be planted by the property owner for each
fifty (50) feet of major thoroughfare frontage developed in PD -6.

Section 19 in the Zoning Ordinance provides PDD regulations. To create a PDD one or more of
the below criteria must be met:
19-200. - Creation.

The city council of the City of Port Arthur, Texas, after public hearing and notice to all parties
affected and after recommendation from the planning and zoning commission, may authorize the
creation of the following types of planned development districts:
( 1 ) Shopping centers of three acres or more. (2) Housing developments of two acres or more.
(3) Industrial parks or districts of eight acres or more. (4) Medical center and hospital. (5) Civic
center, community center and governmental center. (6) Office center. (7) Recreation center. (8)
A combination of ( 1 ) [through] (7) above. (9) Transitions districts as an extension of an existing
district where the provision for off-street parking, screening walls, open space and planting would
create a protective transition between a lesser or a more restrictive district.
Proposed PD — 38 does not meet the criteria listed above. The closest PDD type to this project
is (7) recreation center. The Zoning Ordinance does not define 'recreation center.' However, it
appears to be closer in line to meaning a park/public recreational area.
A PDD is designed to be a master -planned project that provide greater flexibility with the intent
to create unique, innovative projects that cannot be achieved through regular zoning districts.
The Proposed PD — 38 does not meet the intent of a PD district. Additionally, PD — 38 is located
in an area surrounded by single-family zoning and is characterized by residential development.
An RV park is not compatible with single-family land use and may create traffic hazards, noise,
and other nuisances to neighboring residential areas.
The City's Draft Comprehensive Plan 2017 calls for additional housing opportunities as well as
the preservation of existing residential neighborhoods (p. 138). Additionally, the draft Future
Land Use Map (FLUP) indicates the area as low density residential. The Draft FLUP is included in
this report as Attachment 5.
Public Notice:
Notices were mailed to adjacent property owners within a 200 ft. radius and the notice was
published in the Port Arthur News on Wednesday, January 24, 2018; more than ten (10) days
prior to the PAZ public hearing scheduled for February 5, 2018.
FISCAL IMPACT/BUDGET IMPLICATIONS:
N/A
RECOMMENDED ACTION:
Staff recommends the Planning and Zoning Commission to deny the proposed Zoning District
Change based on the analysis above.

SECTION 19. - PLANNED DEVELOPMENT DISTRICT REGULATIONS
19-100. - Intent and purpose.
The purpose of the "PD", planned development district is to provide greater flexibility and
opportunity for innovation in projects. Generally, greater detail is necessary about the proposed
uses and the site plan for a PD development than would be required for the same use(s) in
another district.
19-200. - Creation.
The city council of the City of Port Arthur, Texas, after public hearing and notice to all parties
affected and after recommendation from the planning and zoning commission, may authorize the
creation of the following types of planned development districts:

19-201. Comprehensive site plan required.
In establishing a planned development district, the city council shall require a comprehensive site
plan of the development. This site plan shall be approved and filed as a part of the ordinance
prior to the issuance of any building permit. The required plan shall set forth: The specific
categories of land use to be permitted; requirements for ingress and egress to the property; public
streets with adequate rights-of-way in conformance with the thoroughfare plan; private streets or
driveways; sidewalks; utilities; drainage; parking space; height of building; maximum lot
coverage, yards and open spaces, screening walls or fences and other development and protective
requirements considered necessary to create a reasonable transition to and protection of the
adjacent property.
19-202. All planned developments to be ordinance amendments.
Every planned development district approved under the provisions of this ordinance shall be
considered as an amendment to the ordinance as applicable to the property involved. In
approving the planned development district, the city council may impose conditions relative to
the standard of development and such conditions shall be complied with before a certificate of
occupancy is issued for the use of the land or any structure which is part to the planned
development district and such conditions shall not be construed as conditions precedent to the
granting of a certificate of occupancy.
19-203. All planned developments to be shown on map.
All planned development districts approved in accordance with the provisions of this ordinance
in its original form or by subsequent amendments thereto shall be referenced on the zoning
district map and a list of such planned development districts together with the category of uses
permitted therein shall be maintained in the appendix of this ordinance.
Editor's note— It should be noted that the planned development districts and category of uses
permitted therein, referenced in 19-203 and designated as appendix A attached to the zoning
ordinance, are not set out at length herein but are on file in the offices of the city secretary, the
director of planning, and the building official.

selected for the Disney College Program in Florida, following a position as a Journalist
in Nashville, TN. Ms. Courier was thanked for her services with working with the City
of Port Arthur.
