RE: P.R. NO. 19989—A resolution calling for a public hearing to consider a zoning
change from Multiple Family to Planned Development District—37 [PD-37].
Introduction:
The intent of this Agenda Item is to request a public hearing for approximately 4.658 acres of
land consisting of Lots 3, 4, 5 and 6, Block 12, Range "G", Port Arthur Land Company
Subdivision, Port Arthur, Jefferson County, Texas.
The purpose of this request is to re-zone said property from Multiple Family to Planned
Development District—37 [PD-37] for the construction of a townhome development.
Background:
On February 19, 2018, the Port Arthur Planning & Zoning Commission held a public meeting
to discuss the proposed change. In a vote of 3:1,the Commission recommended that the request
be denied based on issues involving major drainage concerns,variance requests and community
input.
In accordance with Section 211.007(c) of the Texas Local Government Code, twenty-six (26)
notices were mailed to each owner, as indicated by the most recently approved municipal tax
roll, of real property within 200 feet of the property on which the change in classification is
proposed. Notice of public hearing was also published in the Port Arthur News on February 4,
2018. There were two property owners to speak in opposition of the proposed change.
Budget Impact:
None
Recommendation:
It is recommended that City Council approve P.R. No. 19989, calling for a public hearing to
consider granting a specific use permit for the construction of a townhome development. A
public hearing shall be held on Tuesday, April 10, 2018 at 9:00 a.m.

CONSIDER GRANTING A ZONING CHANGE FROM MULTIPLE
FAMILY TO PLANNED DEVELOPMENT DISTRICT —37 [PD-37]
FOR APPROXIMATELY 4.658 ACRES OF LAND,LOTS 3,4,5 AND
6, BLOCK 12, RANGE "G", PORT ARTHUR LAND COMPANY
SUBDIVISION,CITY OF PORT ARTHUR,JEFFERSON COUNTY,
TEXAS
WHEREAS, the owner/applicant(s) — H&P Engineering & Construction — is requesting
that the City of Port Arthur consider this zoning change for the area delineated in Exhibit"A"from
Multiple Family"MF"to Planned Development District—37"PD-37"; and,
WHEREAS, pursuant of Chapter 211.006(a) of the Texas Local Government Code, a
public hearing must precede any zoning change.
NOW THEREFORE,BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF PORT ARTHUR:
THAT the facts and opinions in the preamble are true and correct.
THAT in accordance with Section 211.007 (b) (c) of the Texas Local Government Code,
the Planning and Zoning Commission shall make a preliminary report and hold public hearings on
that report before submitting a final report to the governing body. Written notice of each public
hearing before the zoning commission on a proposed change in a zoning classification shall be
sent to each owner, as indicated by the most recently approved municipal tax roll, or real property
within 200 feet of the property on which the change in classification is proposed.
THAT a public notice was published in the official newspaper of the City on February 4,
2018 on which the change in classification is proposed.
THAT the Planning and Zoning Commission held a public hearing on February 19, 2018
to discuss the proposed change.

THAT the Planning and Zoning Commission recommended in a vote 3:1 to deny the
proposed change.
THAT the governing body shall hold a public hearing upon receiving the final report of
the Planning and Zoning Commission.
THAT a public hearing to consider whether to grant this applicant the zoning change
request on approximately 4.658 acres of Land consisting of Lots 3, 4, 5 and 6, Block 12, Range
"G", Port Arthur Land Company Subdivision, in Port Arthur, Jefferson County, Texas, as
delineated in Exhibit "A" shall be held on April 10, 2018 at 9:00 a.m. in the City Council
Chambers, Fifth Floor, City Hall, 444 Fourth Street.
THAT in accordance with Section 211.006 (a) of the Texas Local Government Code,
before the fifteenth day before the date of the hearing, notice of the time and place of the hearing
must be published in the official newspaper in the municipality going to the City Council.
THAT a regulation or boundary is not effective until after a public hearing on the matter
at which parties interest and citizens have an opportunity to be heard.
THAT a copy of the caption of this Resolution be spread upon the Minutes of the City
Council.
