Funds are available through TML settlement in Hurricane Harvey Account 147-2300-901.92-00, Project No. 082617. This purchase is for the items stated only. There is other furniture, equipment, etc. that will be purchased for the Civic Center Department using TML-IRP insurance money in the near future. Background: Purchasing received a quote through Buyboard Cooperative Program for the replacement of a forklift for the Civic Center Department. This is a replacement of a forklift for the Department due to losses from Hurricane Harvey. The funding will come from a settlement from TML- IRP. Budget Impact: Funds are available through TML-IRP settlement in Hurricane Harvey Account No. 147-2300- 901.92-00, Project No. 082617. Recommendation: It is recommended that City Council approve the City Manager to purchase a forklift from Equipment Depot of Beaumont, Texas, as discussed and/or outline above. A RESOLUTION AUTHORIZING THE CITY MANAGER TO PURCHASE A FORKLIFT FOR THE CIVIC CENTER DEPARTMENT FROM EQUIPMENT DEPOT OF BEAUMONT, TEXAS, THROUGH BUYBOARD COOPERATIVE PURCHASING PROGRAM CONTRACT NO. 515-16 IN THE AMOUNT OF $32,550.00. FUNDS ARE AVAILABLE IN HURRICANE HARVEY ACCOUNT NO. 147-2300-901.92-00, PROJECT NO. 082617 WHEREAS, pursuant to Resolution No. 18-004, the City Council authorized the City Manager to execute a contract between Texas Municipal League Intergovernmental Risk Pool — Turnkey Recovery Program to rebuild Robert A. "Bob" Bowers Civic Center (3401 Cultural Center Drive); and WHEREAS, the Civic Center Department's forklift was deemed a total loss due to flooding from Hurricane Harvey; and, WHEREAS, the Texas Municipal League Intergovernmental Risk Pool (TML-IRP) will cover the replacement of the forklift for the Civic Center Department in the amount of $32,550.00; and, WHEREAS, Chapter 271 of the Texas Government Code allows a city, by resolution of its governing body, to participate in cooperative purchasing programs, such as Texas Buyboard, as an alternative to formal bid process; and, WHEREAS, pursuant to Resolution No. 02-341, the City of Port Arthur entered into an interlocal agreement for cooperative purchasing with Texas Buyboard; and, WHEREAS, Equipment Depot is part of the Buyboard Cooperative Purchasing Program under Buyboard Contract No. 515-16; and, WHEREAS, Equipment Depot will provide the forklift for the amount of$32,550.00; and, WHEREAS, the Civil Center Department recommends the awarding of the purchase contract to Equipment Depot of Beaumont, Texas,through their Buyboard Contract No. 515-16; now therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR: THAT,the facts and opinions in the preamble are true and correct. THAT, the City Manager is hereby authorized and directed to purchase a forklift from Equipment Depot of Beaumont, Texas, through Buyboard Contract No. 515-16, for the replacement of the forklift deemed a total loss by TML-IRP due to Hurricane Harvey, proposal attached hereto as Exhibit"A".
