Smith, RN, BSN, Director of Health Services RE: Authorization to renew and amend the Contract Amendment Between Texas Department of State Health Services and the City of Port Arthur to provide TB services in South Jefferson County. Amendment includes adding funds and extending the contract to August 31, 2019. Introduction: The intent of this Agenda item is to seek the City Council's approval for the City Manager to amend the contract between the Department of State Health Services and the City of Port Arthur for the Tuberculosis program by adding$25,278.00 and extending the contract period to August 31, 2019. Background: These are state funds that have been awarded to the city of Port Arthur since 2015, and renewed for the last three years. It is between the Department of State Health Services and the City of Port Arthur to provide basic services and associated activities for tuberculosis (TB) prevention and control, and expanded outreach services to individuals of identified special populations who have or who are at risk of developing TB. Budget Impact: This award is for $25,278.00 and includes a 20% cash match of$5,056 from the city's general fund for FY 2019. This award is contingent on the $5,056 being budgeted in the city's general fund for FY 2018-2019. Recommendation: It is recommended that the City Council approve P.R.No. 20191, approving the contract amendment between the City of Port Arthur and the Department of State Health Services to add funds and extend contract period to August 31, 2019. A RESOLUTION APPROVING AMENDMENT NO. 1 TO THE CONTRACT BETWEEN THE CITY OF PORT ARTHUR AND THE DEPARTMENT OF STATE HEALTH SERVICES BY INCREASING FUNDING IN THE AMOUNT OF $25,278.00 WITH A CITY MATCH OF $5,056.00 FOR FY 2019 TO A NEW TOTAL CONTRACT AMOUNT NOT EXCEEDING $60,668.00 FOR THE TUBERCULOSIS PREVENTION AND CONTROL; AND EXTENDING THE CONTRACT PERIOD BEGINNING SEPTEMBER 1,2018 THROUGH AUGUST 31,2019. WHEREAS,pursuant to Resolution No. 17-066, Council approved the contract award of $25,278.00 and the 20% city match of$5,056.00 for FY 2017-2018, between the Department of State Health Services and the City of Port Arthur for Tuberculosis Prevention and Control; and WHEREAS, this contract amendment will provide additional financial assistance to the Port Arthur City Health Department, basic services and associated activities for tuberculosis (TB) prevention and control, and expanded outreach services to individuals of identified special populations who have TB or who are at high risk of developing TB; and, WHEREAS, the Department of State Health Services now desires to amend the contract by increasing funding in the amount of$25,278.00 for the period beginning September 1, 2018 through August 31, 2019 with a city match of$5,056.00 for FY 2018-2019. WEHREAS, this resolution is contingent on the 20% city match of $5,056.00 being budgeted in the City's General Fund for FY 2018-2019 budget period; and, WHEREAS, this will cover a portion of salaries and travel for the TB clinic staff in the Health Department. That, the City Council of the City of Port Arthur hereby accepts and approves the amended contract between the City of Port Arthur and the Department of State Health Services for tuberculosis prevention and control services in the amount of$25,278.00 and the city match of$5,056.00. Section 3. That, the City Council deems it is in the best interest of the City to approve and authorize the City Manager and the Director of the City's Health Department to amend the contract between the Department of State Health Services and the City of Port Arthur in substantially the same fore as delineated in Exhibit"A". Section 4. That, a copy of the caption of this Resolution be spread upon the Minutes of the City Council. WHEREAS, the System Agency has chosen to exercise its option to renew the Contract in accordance with Section III of the Contract Signature Document; WHEREAS, the Parties desire to revise the Budget to add funds for the period beginning September 1, 2018 through August 31, 2019 (hereinafter referred to as "Fiscal Year 2019" or "FY2019"); Whereas,the Parties desire to revise the Statement of Work; and Whereas the Parties desire to add to the Supplemental and Special Conditions. SECTION IV of the Signature Document, BUDGET is hereby amended to add TWENTY- FIVE THOUSAND TWO HUNDRED SEVENTY - EIGHT DOLLARS ($25,278.00) in DSHS funding with the Grantee providing a total of FIVE THOUSAND FIFTY - Six DOLLARS ($5,056.00) in matching funds, for a total Contract amount not to exceed SIXTY THOUSAND SIX HUNDRED SIXTY - EIGHT DOLLARS($60,668.00). 3. SECTION I.G.of ATTACHMENT A,STATEMENT OF WORK is hereby deleted in its entirety and replaced with the following: G.Not lapse more than 1% of the total funded amount of the Contract. SECTION III.A. of ATTACHMENT A, STATEMENT OF WORK is hereby amended to add the following email address to which vouchers and any supporting documentation must also be submitted by electronic mail: CMSinvoices@dshs.texas.gov. 5. The Parties agree to add to the Contract ATTACHMENT B-1, FY2019 BUDGET, which is attached to this Amendment and incorporated into the Contract as if fully set forth therein. All FY2019 expenditures shall be made in accordance with Attachment B-1. 6. ATTACHMENT D,SUPPLEMENTAL AND SPECIAL CONDITIONS is hereby amended to add the following new Section 1.16 under the Special Conditions: SECTION 1.16 GRANTEE'S CERTIFICATION OF MEETING OR EXCEEDING TOBACCO- FREE WORKPLACE POLICY MINIMUM STANDARDS. Grantee certifies that it has adopted and enforces a Tobacco-Free Workplace Policy that meets or exceeds all of the following minimum standards of: a) Prohibiting the use of all forms of tobacco products, including but not limited to cigarettes, cigars, pipes, water pipes (hookah), bidis, kreteks, electronic cigarettes, smokeless tobacco, snuff and chewing tobacco; b) Designating the property to which this Policy applies as a "designated area," which must at least comprise all buildings and structures where activities funded under this Contract are taking place, as well as Grantee owned, leased, or controlled sidewalks, parking lots, walkways, and attached parking structures immediately adjacent to this designated area; c) Applying to all employees and visitors in this designated area; and d) Providing for or referring its employees to tobacco use cessation services. If Grantee cannot meet these minimum standards,it must obtain a waiver from the System Agency. 7. This Amendment No. 1 shall be effective as of September 1, 2018. 8. Except as amended and modified by this Amendment No. 1, all terms and conditions of the Contract, as amended, shall remain in full force and effect. In the event of a conflict between the Contract and the terms of this Amendment, the terms of this Amendment shall control. 9. Any further revisions to the Contract shall be by written agreement of the Parties. Signature Page Follows.
