RE: P.R. NO. 20197—A resolution amending Resolution No. 18-080 calling for a
public hearing to consider a zoning change from Multiple Family to Planned
Development District—37 [PD-37].
Introduction:
The intent of this Agenda Item is to request a public hearing for approximately 4.658 acres of
land consisting of Lots 3, 4, 5 and 6, Block 12, Range "G", Port Arthur Land Company
Subdivision, Port Arthur,Jefferson County, Texas.
The purpose of this request is to re-zone said property from Multiple Family to Planned
Development District—37 [PD-37] for the construction of a townhome development.
Background:
Notice of public hearing before the Planning and Zoning Commission was originally published
in the Port Arthur News on February 4, 2018. On February 19, 2018, the Port Arthur Planning
& Zoning Commission held a public meeting to discuss the proposed change. There were two
property owners to speak in opposition of the proposed change. In a vote of 3:1,the Commission
recommended that the request be denied based on issues involving major drainage concerns,
variance requests and community input.
In accordance with Section 211.007 (c) of the Texas Local Government Code, twenty-six (26)
notices must be mailed to each owner, as indicated by the most recently approved municipal tax
roll, of real property within 200 feet of the property on which the change in classification is
proposed The public hearing before the City Council is being rescheduled from the original
date of April 10,2018 in order to make certain that all of the notice requirements set forth in the
City's Zoning Ordinance and the Texas Local Government Code have been met.
Budget Impact:
None
Recommendation:
It is recommended that City Council approve P.R. No. 20197, calling for a public hearing to
consider granting a specific use permit for the construction of a townhome development. A
public hearing shall be held on Tuesday, May 8, 2018 at 9:00 a.m.

CHANGE FROM MULTIPLE FAMILY TO PLANNED
DEVELOPMENT DISTRICT—37 [PD-371 FOR APPROXIMATELY
4.658 ACRES OF LAND, LOTS 3, 4, 5 AND 6, BLOCK 12, RANGE
"G", PORT ARTHUR LAND COMPANY SUBDIVISION, CITY OF
PORT ARTHUR,JEFFERSON COUNTY,TEXAS
WHEREAS, the owner/applicant(s) — H&P Engineering & Construction — is requesting
that the City of Port Arthur consider this zoning change for the area delineated in Exhibit"A"from
Multiple Family"MF"to Planned Development District—37 "PD-37"; and,
WHEREAS, pursuant of Chapter 211.006(a) of the Texas Local Government Code, a
public hearing must precede any zoning change; and,
WHEREAS,the public hearing before the City Council is being rescheduled from the original
date of April 10,2018, in order to make certain that all of the notice requirements set forth in the City's
Zoning Ordinance and the Texas Local Government Code have been met.
NOW THEREFORE,BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF PORT ARTHUR:
THAT the facts and opinions in the preamble are true and correct.
THAT in accordance with Section 211.007 (b) (c) of the Texas Local Government Code,
the Planning and Zoning Commission shall make a preliminary report and hold public hearings on
that report before submitting a final report to the governing body. Written notice of each public
hearing before the zoning commission on a proposed change in a zoning classification shall be
sent to each owner, as indicated by the most recently approved municipal tax roll, or real property
within 200 feet of the property on which the change in classification is proposed.
THAT a public notice of the Planning and Zoning Commission hearing was published in
the official newspaper of the City on February 4, 2018 on which the change in classification is

proposed as required in 211.007 (b) of the Texas Local Government Code. The notice was also
sent to each owner of real property within 200 feet of the property on which the change in
classification is proposed as required in 211.007 (c) of the Texas Local Government Code.
THAT the Planning and Zoning Commission held a public hearing on February 19, 2018
to discuss the proposed change.
THAT the Planning and Zoning Commission recommended in a vote 3:1 to deny the
proposed change.
THAT upon receiving the final report of the Planning and Zoning Commission, the
governing body shall hold a public hearing to allow the property owners within 200 feet of the
property on which the change in classification as required in 211.007 (b) of the Texas Local
Government Code.
THAT Resolution No. 18-080 is hereby amended to reschedule the public hearing date
from the original date of April 10,2018 to a new public hearing date of May 8,2018 at 9:00 a.m. in the
City Council Chambers, Fifth Floor, City Hall, 444 Fourth Street to consider whether to grant this
applicant the zoning change request on approximately 4.658 acres of Land consisting of Lots 3,4,5 and
6, Block 12, Range "G", Port Arthur Land Company Subdivision, in Port Arthur, Jefferson County,
Texas,as delineated in Exhibit"A".
THAT in accordance with Section 211.006 (a) of the Texas Local Government Code,
before the fifteenth day before the date of the hearing, notice of the time and place of the hearing
must be published in the official newspaper in the municipality prior to the matter being heard
before City Council.
THAT a regulation or boundary is not effective until after a public hearing on the matter
at which parties interest and citizens have an opportunity to be heard.

THAT a copy of the caption of this Resolution be spread upon the Minutes of the City
Council.
