Introduction:
Acceptance of Change Order No. 1 for a 24 day extension in the proposed city street Storm
Sewer Improvements along Woodworth Blvd. from Thomas Blvd. to 7th Street.
Background:
Proposed Change Order No. 1 is for request of additional time during the months from
October 2017 to February 2018 including 12 regular working days due to inclement weather
and 5 working days due to Mardi Gras activities. The time extension formula stating 7
calendar days for every 5 calendar days lost equals to a total of 24 calendar days. This change
order increases the contract term from 270 calendar days to 294 calendar days and a new
substantial completion date from June 28, 2018 to July 22, 2018.
Budget Impact:
Funds are available in the following account: N/A
Recommendation:
Approval of P.R. No. 20195 authorizing the City Manager to execute Change Order No. 1 to
the contract with Norman Highway Constructors for the Storm Sewer Improvements along
Woodworth Blvd.

RESOLUTION NO.
A RESOLUTION AUTHORIZING THE CITY MANAGER TO EXECUTE
CHANGE ORDER NO. 1 TO THE CONTRACT BETWEEN THE CITY OF
PORT ARTHUR AND NORMAN HIGHWAY CONSTRUCTORS OF
ORANGE, TEXAS FOR THE STORM SEWER IMPROVEMENTS
ALONG WOODWORTH BLVD. FROM 7TH STREET TO THOMAS
BLVD. INCREASING THE CONTRACT TERM BY 24 DAYS TO A NEW
TOTAL OF 294 DAYS.
WHEREAS, per Resolution No. 17-188, the City Council awarded a contract for
the Storm Sewer Improvements along Woodworth Blvd. from Thomas Blvd. to 7th Street
to Norman Highway Constructors of Orange, Texas in the projected budgetary impact
amount of $1,186,728.00 and a term of 270 calendar days; and,
WHEREAS, proposed Change Order No. 1 is for the request for time extension
due to inclement weather and Mardi Gras activities from October 2017 to February 2018
including 12 regular working days for inclement weather and 5 regular working days for
Mardi Gras activities; and,
WHEREAS, the City of Port Arthur's Time Extension Formula states to award
seven calendar days for every five regular days of work lost added another 7 calendar
days that can be added to the actual 17 regular days that were lost bringing the total
amount requested to 24 calendar days (attached as Exhibit "A"); and,
WHEREAS, Change Order No. 1 will increase the total term of the contract from
270 calendar days to 294 calendar days and extending the substantial completion date
from June 28, 2018 to July 22, 2018 herein deemed an appropriate action; now,
therefore,

BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT
ARTHUR:
THAT, the facts and opinions in the preamble are true and correct; and,
THAT, the City Manager of the City of Port Arthur is hereby authorized and
directed to execute said Change Order No. 1 to the contract between the City of Port
Arthur and Norman Highway Constructors of Orange, Texas; and,
THAT, Change Order No. 1 increases the contract term from 270 calendar days
to 294 calendar days and extending the substantial completion date from June 28, 2018
to July 22, 2018; and,
THAT, a copy of the caption of this Resolution be spread upon the Minutes of
the City Council.

Dear Mr. Gutierrez:
Attached is Change Order No. 1 for the Proposed City Street Strom Sewer
Improvements along Woodworth Blvd. This change order includes the request for time
extension of 24 days from October to the end of February due to weather and Mardi
Gras. The City of Port Arthur's Contract Documents lists several factors that are
deemed justified for a Contractor to request a time extension. Unforeseeable causes
hurricanes, rainy weather when sixty percent of the workforce cannot work for seven
hours or more, and inclement weather resulting in material or any work damages are
some examples. Though the days requested all meet the criteria, the City of Port
Arthur's Time Extension formula to award seven calendar days for every five regular
days of work lost added another 7 calendar days that can be added to the actual 17
regular days that were lost. The Contractor lost 12 regular working days between the
months of October until the end of February resulted from either a heavy rain or a
steady rain that prevented the Contractor from working and lost 5 days due to the
request of the City to be closed during Mardi Gras. We recommend the City of Port
Arthur authorize the change to the contract by adding 24 calendar days to extend the
contract end date from June 28, 2018 to July 22, 2018. I have attached Change Order
No. 1 which modifies the contract to reflect this revision for your consideration and
