RE: P.O. NO. 6692—An Ordinance of the City of Port Arthur, Texas, adopting the
Port Arthur Comprehensive Plan "Imagine Port Arthur: Your Dream, Our
Future."
Introduction:
The intent of this Agenda Item is to request that City Council approve P.O.NO. 6692, adopting
the Port Arthur Comprehensive Plan, "Imagine Port Arthur: Your Dream, Our Future."
Background:
The Port Arthur City Council approved Resolution No. 15-028 authorizing an agreement with
Freese and Nichols, Inc. ("FNI") of Texas for Comprehensive Planning Services in the not-to-
exceed amount of$153,000.00.
The scope of work associated with the Comprehensive Plan update included the following three
(3) phases:
Phase I: Community Snapshot and Visioning
Phase II: Plans and Recommendations
Phase III: Report, Implementation, and Adoption
There were four community meetings organized based on Council Districts(Districts 1-4). The
meetings were held at the Robert A. Bowers Civic Center and Port Arthur City Hall in March
2017. A special youth meeting was held on April 20, 2017, at the Port Arthur City Hall.
Participants were asked a series of questions involving transportation and circulation,future land
use, neighborhoods and community livability, and annexation and growth management.
Individuals were invited to participate in a polling exercise that helped to define the overall
vision of Port Arthur.
The Port Arthur Planning Commission approved the final draft of the Comprehensive Plan at
their February 5, 2018 meeting. Members of City Council were given a copy of the plan on
March 13,2018, for review and comment. On April 10,2018, Freese and Nichols, Inc. made a
presentation on the final draft of the Plan.
In accordance with Chapter 213 of the Texas Local Government Code and Article XI, Section 4
of the City of Port Arthur Charter, the Port Arthur City Council held a public hearing on April
24, 2018, at which the public was given the opportunity to provide testimony and written
evidence.
A draft and description of this Comprehensive Plan (Master Plan) was presented at the Public
Hearing and was made available for examination in the City's Planning Department,the official
website of the City, as well as the plan website at http://www.imagineportarthur.com.
Budget Impact:
None
Recommendation:
It is recommended that City Council approve P.O. NO. 6692, adopting the Port Arthur
Comprehensive Plan, "Imagine Port Arthur: Your Dream, Our Future."

AN ORDINANCE OF THE CITY OF PORT ARTHUR, TEXAS,
ADOPTING THE PORT ARTHUR COMPREHENSIVE PLAN
"IMAGINE PORT ARTHUR: YOUR DREAM, OUR FUTURE"
PURSUANT TO TEXAS LOCAL GOVERNMENT CODE
CHAPTER 213 AND ARTICLE XI, SECTION 4 OF THE PORT
ARTHUR CITY CHARTER AS PROVIDED HEREIN; REPEALING
ALL ORDINANCES AND RESOLUTIONS INCONSISTENT OR IN
CONFLICT HEREWITH; AND PROVIDING FOR SEVERABILITY
AND PUBLICATION AND AN EFFECTIVE DATE THEREOF.
WHEREAS, Chapter 213 of the Texas Local Government Code provides that
municipalities may adopt a comprehensive plan for long-range development for the City and that
such a comprehensive plan may include,but is not limited to provisions of land use,transportation,
public facilities, and to coordinate and guide the establishment of development regulations; and,
WHEREAS, pursuant to Article XI, Section 4 of the Charter of the City of Port Arthur,
the City Council may adopt a comprehensive plan as a whole or in part and may adopt any
amendment thereto,after at least one (1)public hearing on the proposed action. The Council shall
act on such plan, or part thereof, within sixty (60) days following its submission by the City
Manager; and,
WHEREAS, the Port Arthur Planning and Zoning Commission conducted an extensive
review, public hearings, and received public comments; and thereafter made its final
recommendations to the City Manager and to the City Council for adoption of the Port Arthur
Comprehensive Plan"Imagine Port Arthur: Your Dream, Our Future", attached hereto as Exhibit
"A"; and
WHEREAS, after the subject public hearings, studies, and reviews, the City Council has
considered and has accepted the recommended changes of the Commission incorporated into the

Port Arthur Comprehensive Plan"Imagine Port Arthur: Your Dream, Our Future," to be adopted
in accordance with the limitations,restrictions and requirements of Chapter 213 of the Texas Local
Government Code for use as a future planning device of an advisory nature only, with the specific
intent that the Comprehensive Plan is not to conflict with zoning regulations,which will prevail in
case of conflict; and,
WHEREAS, all public notices have been posted, published and all required hearings on
this matter have been held in accordance with law;
NOW,THEREFORE,BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF PORT ARTHUR,TEXAS:
Section 1. That the facts and matters set forth in the preamble of this Ordinance are
hereby found to be true and correct.
Section 2. The City of Port Arthur Comprehensive Plan "Imagine Port Arthur: Your
Dream, Our Dream is hereby adopted pursuant to the limitations,restrictions,and requirements of
Section 213 of the Texas Local Government Code, as contained herein, Article XI, Section 4 of
the Charter of the City of Port Arthur, and any map of the Port Arthur Comprehensive Plan
illustrating future land use shall contain the following clearly visible state"A comprehensive plan
shall not constitute a zoning regulation or establish zoning district boundaries."
Section 3. All Ordinances and Resolutions or parts of Ordinances or Resolutions in
conflict or inconsistent with this Ordinance are hereby expressly repealed.
Section 4. In the event any clause phrase,provision, sentence,or part of this Ordinance
or the application of the same to any person or circumstances shall for any reason be adjudged
invalid or held unconstitutional by a court of competent jurisdiction, it shall not affect, impair, or
invalidate this Ordinance as a whole or any part or provision hereof other than the part declared to

be invalid or unconstitutional; and the City Council of the City of Port Arthur,Texas,declares that
it would have passed each and every part of the same notwithstanding the omission of any such
part thus declared to be invalid or unconstitutional, whether there be one or more parts.
Section 5. The City Secretary shall give notice of the enactment of this Ordinance by
promptly publishing it or its descriptive caption after final passage in the official newspaper of the
City; the Ordinance to take effect upon publication.
