Introduction:
Approval of Proposed Resolution No. 20239 authorizing the second year, first renewal, of an
agreement with CMM Construction Co., Inc. of Beaumont, Texas with the annual projected
budgetary impact of$250,000.
Background:
This is an annual contract which provides the placement of hot-mix asphaltic concrete on a
unit cost basis with CMM Construction Co., Inc. of Beaumont, Texas. The City Council
approved this contract per Resolution No. 17-138. This is the second year, first renewal year
of this contract.
Budget Impact:
Funding is available in the Water Utility Department Water Distribution—Streets account,
410-1253-532.36-00 and Capital Improvement Capital Projects—Streets—307-1601-591.86-
00.
Recommendation:
It is recommended that City Council authorize the City Manager to approve P. R. No. 20239,
as discussed and/or outline above.

RESOLUTION NO.
A RESOLUTION AUTHORIZING THE SECOND YEAR, FIRST
RENEWAL, FOR THE CONTRACT BETWEEN THE CITY OF
PORT ARTHUR AND CMM CONSTRUCTION CO., INC. OF
BEAUMONT, TEXAS FOR PLACEMENT OF HOT-MIX
ASPHALTIC CONCRETE FOR THE PROJECTED
BUDGETARY IMPACT AMOUNT OF $250,000. FUNDING IS
AVAILABLE IN WATER UTILITY DEPARTMENT WATER
DISTRIBUTION — STREETS ACCOUNT NO. — 410-1253-532.36-
00 AND CAPITAL IMPROVEMENT CAPITAL PROJECTS
ACCOUNT NO.307-1601-591.86-00.
WHEREAS, periodically the City requires the services of a contractor to place hot-mix
asphaltic concrete for various projects; and,
WHEREAS, per Resolution No. 17-138, the City entered into a one year agreement with
the option to renew for two additional years with CMM Construction, Inc., for the placement of
hot-mix asphaltic concrete; now therefore,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT
ARTHUR:
THAT, facts and opinions in the preamble are true and correct; and,
THAT, the City Manager is hereby authorized to execute the second year contract, in
substantially the same form, attached as Exhibit A, with a projected budgetary impact amount of
$250,000, for the placement of hot-mix asphaltic concrete (HMAC) with the option of renewal
for one additional year with CMM Construction Co., Inc., of Beaumont, Texas; and,
THAT, funding is available in the Water Utility Department Water Distribution— Streets
account no. 410-1253-532.36-00 and Capital Improvement Fund Capital Projects — Streets
account no. 307-1601-591.86-00; and,
THAT, a copy of the caption of this Resolution be spread upon the Minutes of the City
Council.

RENEWAL CONTRACT FOR PLACEMENT OF HOT-MIX ASPHALTIC CONCRETE
THIS AGREEMENT,made this the of , 2018,by and between the City of
Port Arthur, a municipal corporation organized under the laws of the State of Texas, hereinafter
called"OWNER"or "CITY", and CMM Construction Co., Inc. , hereinafter called
"CONTRACTOR". WITNESSED: That for and in consideration of the payment terms,
conditions and agreements set forth herein, OWNER and CONTRACTOR agree as follows:
1. Pursuant to Resolution 17-138, the City entered into a one-year contract with the option
of renewal for two additional years. The parties hereby agree to exercise said option for a
second year.
2. The term of this Contract shall be from to .
3. During the term of this Contract, the CONTRACTOR will furnish at his own expense all

of the materials, supplies, tools, equipment, labor, and other services necessary to
connection therewith, excepting those supplies specifically not required on
CONTRACTOR in the Specifications.
4. This contract shall not exceed the amount of$250,000.
5. The term"Contract Documents" means and includes the following:

6) Bidder's Information Sheet *
*These items were attached to the original letting contract. The agreement only is
included for this renewal.
6. This Agreement shall be binding upon all parties hereto and their respective heirs,
executors, administrators, successors, and assigns.
7. IN WITNESS WHEREOF,the parties here to have executed, or caused to be executed by
their duly authorized officials, this Agreement in two (2) copies, each of which shall be
deemed an original of the date first written above.
