Introduction:
City is requesting City Council approve P.R. No. 20294 authorizing the Council approval for
Mold Remediation at the Operation Center by Action Restoration of Port Arthur,Texas in the
amount of$101,673.50.
Background:
The Operation Center was damaged by the flooding caused by on Hurricane Harvey. Due to
the extensive mold damage, the operation center is currently not in use. Total Safety tested
for mold and asbestos and determined that only mold remediation was required, and provided
a scope of work; Action Restoration provided a TIPS/TAPS quote based on that scope of
work in the amount of$101,673.50.
Budget Impact:
Payment will be provided by funds received from insurance. (Account No. 147-2300-901.32-
00, Project No. 082617) Emergency Management Fund
Recommendation:
City is requesting City Council approve P.R. No. 20294 authorizing Mold Remediation of the
Operation Center by Action Restoration of Port Arthur,Texas in the amount of$101,673.50

RESOLUTION NO.
A RESOLUTION AWARDING A CONTRACT FOR MOLD
REMEDIATION OF THE OPERATION CENTER TO
ACTION RESTORATION, INC. OF PORT ARTHUR
THROUGH TIPS/TAPS COOPERATIVE CONTRACT
WITH THE PROJECTED BUDGETARY IMPACT AMOUNT
OF $101,673.50. FUNDING IS AVAILABLE IN ACCOUNT
NO. 147-2300-901.32-00 PROJECT NO. 082617
(EMERGENCY MANAGEMENT FUND)
WHEREAS,the City's Operation Center located at 201 H.O. Mills sustained major flood
damages during Hurricane Harvey; and
WHEREAS, the moisture from the floodwaters has caused mold to form within the
building making it unfit for habitation; and
WHEREAS, it is deemed in the best interest of the City to address the health and safety
concerns at the Operation Center; and
WHEREAS, Action Restoration, Inc. of Port Arthur submitted a proposal for the mold
remediation in the amount of$101,673.50 through TIPS/TAPS,a cooperative purchasing program;
and
WHEREAS, Charter 271 of the Local Government Code allows a city,by resolution of its
governing body, to participate in cooperative purchasing programs, such as TIPS/TAPS, a
purchasing cooperative, as an alternative to a formal bid process; and
WHEREAS, pursuant to Resolution No. 12-008, the City of Port Arthur entered into an
interlocal agreement with Region VIII Education Service Center for the participation in the
Interlocal Purchasing System(TIPS/TAPS).
NOW THEREFORE,BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF PORT ARTHUR:
Section 1. That, the facts and opinions in the preamble are true and correct.
Section 2. That, the City Manager is hereby authorized to award the contract, in
substantially the same form attached hereto as Exhibit"A",for mold remediation of the Operation
Center to Action Restoration, Inc. of Port Arthur through TIPS/TAPS, with a projected budgetary
impact amount of$101,673.50.
Section 3. That,a copy of this caption be spread upon the Minutes of the City Council.

CONTRACT FOR MOLD REMEDIATION
AT THE OPERATION CENTER
THIS AGREEMENT, made this day of , 2018,
by and between the City of Port Arthur, a municipal corporation organized under the laws
of the State of Texas, hereinafter called "OWNER" or "CITY" and Action Restorations
a(n) Corporation herein acting by and through hereinafter
called "CONTRACTOR"
WITNESSETH: That for and in consideration of the payment terms, conditions
and agreements set forth herein , OWNER and CONTRACTOR agree as follows:
1. The term of this Contract shall be 14 calendar days from start date on Notice to
Proceed.
2. The Contractor will perform work as stated in the Contract Documents.
3. During the term of this Contract, the Contractor will furnish at his own expense all of
the materials, supplies, tools, equipment, labor and other services necessary to
connection therewith, excepting those supplies specifically not required of Contractor
in the Specifications.
4 The CONTRACTOR agrees to perform all the work described in the proposal and
contract documents and to comply with the terms therein for the rates stated in the
proposal for a sum of$101,674.50.
6. The term "Contract Documents" means and includes the following:
a) Agreement
b) Proposal
7. This Agreement shall be binding upon all parties hereto and their respective heirs,
executors, administrators, successors and assigns.
8. IN WITNESS WHEREOF, the parties hereto have executed, or caused to be executed
by their duly authorized officials,this Agreement in(2 copies) each of which shall be
deemed an original on the date first above written.

PRICE TO PERFORM WORK $94,580.00 (plus taxes if
applicable)
General:
•All work will be carried out in accordance with all EPA, OSHA and TDH Rules, Regulations and
Guidelines
•The above pricing includes no replacement materials or systems including labor to install
replacement materials or systems
•Water and electricity shall be provided by customer at no additional charge to Action
Restoration.
Exclusions :
.SF Rate is base on non restricted access to building.
.Any down time resulting from access issues will be charged to client
.SF Rate is also base on all utilities required to perform the scope of work
be provided by owner at no charge to Action Restoration
Action Restoration has been a member of the NADCA since 2010
Payment Terms: NET 30 Proposal Valid until JUNE 17,2018

T.I.P.S. RATES
Thank you for allowing Action Restoration, Inc. to provide the following proposal to you for
the HVAC duct and coil cleaning project listed above. We have been serving this industry for
17 years with over 10 million in specialty equipment. Action Restoration is a certified NADCA
(National Air Duct Cleaning Association) company, HUB and WBE certified. All workers are
trained and experienced in HVAC duct and coil cleaning.
Action proposes to provide all labor, material and equipment to perform the following:
Scope of Work:
Action proposes to clean the HVAC duct in Public Works
The scope of work will be performed and completed in a workmanship like manner.
PRICE TO PERFORM WORK $7,093.50 (plus taxes if
applicable)
General:
.Price includes 9458 sf of air duct cleaning.
.A $80.00 cost will be added to each coil that is requested to be cleaned.
•All work will be carried out in accordance with alt EPA, OSHA and TDH Rules, Regulations and
Guidelines
•The above pricing includes no replacement materials or systems including labor to install
replacement materials or systems
•Water and electricity shall be provided by customer at no additional charge to Action
Restoration.
Exclusions :
.SF Rate dose not include detachment of HVAC coil or blower only contact HEPA vacuum
per NADCA standard
.SF Rate is base on non restricted access to building.
.Any down time resulting from access issues will be charged to client

Action Restoration has been a member of the NADCA since 2010
