Introduction:
City is requesting City Council approve P.R. No. 20295 authorizing the Council approval to
approve the Renovation of the Water Service Center by SpawGlass Construction Corp of
Beaumont, Texas with a projected budgetary impact of$236,794.95.
Background:
The Water Service Center was damaged by the flooding caused by Hurricane Harvey. Due to
the extensive damage, the Water Service Center is currently not in use. Once the mold
remediation has been completed, the City will begin renovation of the Water Service Center. A
BuyBoard quote was received by SpawGlass Construction Corp in the amount of$236,794.95.
Budget Impact:
Payment will be provided by funds received from insurance. (Account No. 147-2300-901.32-
00, Project No. 082617) Emergency Management Fund
Recommendation:
City is requesting City Council approve P.R. No. 20295 authorizing renovation of the Water
Service Center by SpawGlass Construction Corp of Beaumont,Texas with a projected budgetary
impact amount of$233,295.67.

A RESOLUTION AWARDING A CONTRACT FOR THE
RENOVATION OF THE WATER SERVICE CENTER TO
SPAWGLASS CONSTRUCTION CORP OF BEAUMONT,
TEXAS THROUGH BUYBOARD COOPERATIVE
CONTRACT #520-16 EZ1QC WITH A PROJECTED
BUDGETARY IMPACT OF $236,794.95. FUNDING IS
AVAILABLE IN EMERGENCY MANAGEMENT FUND
(ACCOUNT NO. 147-2300-901.32-00, PROJECT#082617)
WHEREAS,the Water Service Center located at 111 H.O. Mills sustained major damages
from Hurricane Harvey; and,
WHEREAS,the Water Service Center is currently not is use due to the extensive damages
caused by the flooding; and,
WHEREAS,it is deemed in the best interest of the City of Port Arthur to address the health
and safety concerns by carrying out mold remediation and renovations to the Water Service Center;
and,
WHEREAS, SpawGlass Construction Corp has submitted a proposal for the renovation
through a cooperative contract with BuyBoard; and
WHEREAS, Chapter 271 of the Local Government Code allows a city, by resolution of
its governing body, to participate in cooperative purchasing programs, such as BuyBoard, a
purchasing cooperative, as an alternative to a formal bid process; and
WHEREAS, per Resolution No. 02-341,the City entered into an interlocal agreement for
cooperative purchasing with the BuyBoard Cooperative Purchasing Program("BuyBoard"); and,
NOW THEREFORE,BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF PORT ARTHUR:
Section 1. That,the facts and opinions in the preamble are true and correct.
Section 2. That, the renovation of the Water Service Center with SpawGlass
Construction Corp of Port Arthur through BuyBoard, with a projected budgetary impact of
$236,794.95 is hereby approved, a copy of the estimate/quote is attached hereto as Exhibit"A".
Section 3. That,a copy of this caption be spread upon the Minutes of the City Council.

CONTRACT FOR RENOVATION
AT THE WATER SERVICE CENTER
THIS AGREEMENT, made this day of , 2018,
by and between the City of Port Arthur, a municipal corporation organized under the laws
of the State of Texas, hereinafter called "OWNER" or "CITY" and SpawGlass Building
Services,a(n) Corporation herein acting by and through hereinafter
called "CONTRACTOR"
WITNESSETH: That for and in consideration of the payment terms, conditions
and agreements set forth herein , OWNER and CONTRACTOR agree as follows:
1. The term of this Contract shall be 60 calendar days from start date on Notice to
Proceed.
2. The Contractor will perform work as stated in the Contract Documents.
3. During the term of this Contract, the Contractor will furnish at his own expense all of
the materials, supplies, tools, equipment, labor and other services necessary to
connection therewith, excepting those supplies specifically not required of Contractor
in the Specifications.
4 The CONTRACTOR agrees to perform all the work described in the proposal and
contract documents and to comply with the terms therein for the rates stated in the
proposal for a sum of$236,794.95.
6. The term "Contract Documents" means and includes the following:
a) Agreement
b) Proposal
7. This Agreement shall be binding upon all parties hereto and their respective heirs,
executors, administrators, successors and assigns.
8. IN WITNESS WHEREOF, the parties hereto have executed, or caused to be executed
by their duly authorized officials, this Agreement in( 2 copies) each of which shall be
deemed an original on the date first above written.
