Williams, Safety&Risk Mari lavII RE: A Resolution Authorizing the Settlement of a Claim in the Estimated Amount of $750,000.00 Made Against TMLIRP (SynergyNDS) Nature of the request: On August 30, 2017, many City properties sustained damages during the flooding from Hurricane Harvey. In an effort to stabilize said properties, TML-IRP contracted SynergyNDS to conduct recovery and disaster services including drying services, selective demoing, temporary offices/trailers and generator replacement. SynergyNDS conducted such services and continues to provide temporary office facilities (trailers). Estimated claims total $750,000.00. Staff Analysis, Considerations: The City of Port Arthur has insurance coverage through Texas Municipal League-Intergovernmental Risk Pool (TML). TML has agreed to reimburse Synergy directly on such covered property losses and expenses for which SynergyNDS managed and paid vendors directly in an estimated total of$750,000.00. Recommendation: I recommend approval of Proposed Resolution No. 20300 authorizing TML to reimburse SynergyNDS in an estimated amount of$750,000.00 for services provided to the City of Port Arthur to conduct recovery and disaster services in the aftermath of Hurricane Harvey. Budget Considerations: There will be no budgetary impact with this consideration. "Remember we are here to serve the Citizens of Port Arthur" P.R. NO. 20300 06/13/18 TAW RESOLUTION NO. A RESOLUTION AUTHORIZING THE CITY MANAGER TO EXECUTE A CONTRACT BETWEEN TEXAS MUNICPAL LEAGUE INTERGOVERNMENTAL RISK POOL FOR DISASTER RECOVERY SERVICES IN THE ESTIMATED AMOUNT OF $750,000.00 PROVIDED BY SYNERGYNDS DURING HURRICANE HARVEY WHEREAS, the City Council of the City of Port Arthur deems it necessary and appropriate to execute a contract (Exhibit "A") between Texas Municipal League Intergovernmental Risk Pool for disaster recovery services in the estimated amount of $750,000.00 provided by SynergyNDS during Hurricane Harvey; and, WHEREAS, in the face of the catastrophic damages due to Hurricane Harvey, the Texas Municipal League Intergovernmental Risk Pool ("TMLIRP") contracted with SynergyNDS, Inc. ("SynergyNDS") to provide TMLIRP with recovery management and disaster recovery services on its Members property losses caused by Hurricane Harvey and covered by TMLIRP. Many of the Members allowed SynergyNDS to locate vendors that could immediately provide emergency services to stabilize property and mitigate damages on covered property losses. With prior written authorization by TMLIRP, SynergyNDS may advance approved claim costs on behalf of covered TMLIRP Member property loss claims to vendors that provided such emergency services. If the Member agrees, TMLIRP will reimburse SynergyNDS directly on such covered property expenses; and, WHEREAS, TML will pay SynergyNDS directly for the services provided in "Exhibit B" and the cost of temporary office facilities. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR, TEXAS: Section 1 . That, the facts and opinions in the preamble are true and correct. P.R. That, the City Manager is hereby authorized to execute a contract between Texas Municipal League Intergovernmental Risk Pool for disaster recovery services in the estimated amount of $750,000.00 provided by SynergyNDS during Hurricane Harvey. Section 3. That, a copy of this Resolution be spread upon the minutes of the City Council.
