BACKGROUND INFORMATION:
On Saturday, June 2, 2018, twenty-one (21) notices were mailed to adjacent property
owners within a 200 ft. radius, as well as published in the Port Arthur News; fifteen (15)
days before the PEtZ public hearing scheduled for June 18, 2018.
FISCAL IMPACT/BUDGET IMPLICATIONS:
N/A
CASE SUMMARY:
The applicant is seeking to replat a part of Lot 6, Block 3, Range "G," Port Arthur Land
Company Subdivision into two tracts of land. The property is zoned "LC" Light Commercial
and "SF" Single Family. The subdivision increases the lot yield from one lot to two tracts
and therefore triggers the need for a public hearing. The replat creates two tracts that
exceed the minimum width and area requirements for commercial development. The
parcels have direct access to a public street(s) (Gulfway Drive and Dryden Road).
RECOMMENDED ACTION:
Staff recommends approval of the proposed Replat
of the Texas Local Government Code and Appendix A,
Code of Ordinances.

SECTION 1 AREA
That the zoning designation of the following described tract of

District under the provisions of Section 19:

SECTION 2 PERMITTED USES

otherwise authorized herein or on the Comprehensive Site Plan or
development plan approved by the Planning and Zoning Commission.
2. For those uses north of 4th Street where there is an existing
structure, there shall be no off-street parking or off-street loading
required.

if the proposed replat requires a variance and is protested in accordance with this subsection, the proposed replat must receive, in order
to be approved, the affirmative vote of at least three-fourths of the members present of the municipal planning commission or governing
body, orboth. For a legal protest written instruments signed by the owners of at least 20 percent of the area of the lots or land immediately
adjoining the area covered by the proposed replat and extending 200 feet from that area, but within the original subdivision, must be filed
with the municipal planning commission or governing body, or both, prior to the close of the public hearing.
