Introduction:
The intent of this Agenda Item is to seek City Council's approval of the termination of the
contract for Bar Screen Repair with Coastal Pump Services, Inc., of Manvel, Texas and thereby
awarding the contract to ALLCO, LLC of Beaumont, Texas. Coastal Pump Services, Inc. has
indicated that they cannot fulfill the contract for repairing the bar screen at the Main Wastewater
Treatment Plant. ALLCO of Beaumont, Texas was the second lowest bidder. Funding for the
- contract is available in Utility Operations, Account No. 410-1256-532.42-00, Equipment
Maintenance. The difference in price is $703.00, with a total budgetary impact of$31,715.00.
Background:
Coastal Pump Services, Inc. was awarded the contract for bar screen repair by Resolution 18-
092. However, Coastal Pump Services, Inc. has indicated that they cannot fulfill the contract for
repairing the bar screen at the Main Wastewater Treatment Plant. ALLCO of Beaumont, Texas
was the second lowest bidder.
Budget Impact:
Funding for the contract is available in Utility Operations, Account No. 410-1256-532.42-00,
Equipment Maintenance. The difference in price is $703.00, with a total budgetary impact of
$31,715.00.
Recommendation:
I recommend that the City Council approve Proposed Resolution No. 20323 authorizing the
execution of a contract for the repair of the bar screen with ALLCO, LLC of Beaumont, Texas,
and rescinding the contract with Coastal Pump Services, Inc., of Manvel, Texas.

A RESOLUTION TERMINATING THE CONTRACT
WITH COASTAL PUMP SERVICES, INC. OF MANVEL,
TEXAS, FOR BAR SCREEN REPAIR, AND AWARDING
THE CONTRACT TO ALLCO, LLC OF BEAUMONT,
TEXAS, WITH A PROJECTED BUDGETARY IMPACT
OF $31,715.00 TO ACCOUNT NUMBER 410-1256-532.42-
00,EQUIPMENT MAINTENANCE.
WHEREAS, pursuant to Resolution No. 18-092, the City Council awarded a contract to
Coastal Pump Services, Inc. for bar screen repair; and,
WHEREAS, Coastal Pump Services, Inc. of Manvel, Texas has stated that they can no
longer fulfill the terms of the contract; and,
WHEREAS, the bar screen is a critical component of the wastewater treatment process
and needs to be repaired as quickly as possible to ensure public health and safety; and,
WHEREAS, it is further authorized pursuant to Section 252.022(a)(2), of the Texas
Local Government Code, a procurement necessary to preserve or protect the public health or
safety of the municipality's residents. This procurement is also authorized pursuant to Section
252.022(a)(3), of the Texas Local Government Code, because of unforeseen damage to public
machinery, equipment, or other property; and,
WHEREAS, these repairs are necessary to the proper functioning of the bar screen,
without these repairs, the equipment would not function properly, potentially causing more
damage to the unit; and,
WHEREAS,the next lowest bidder to meet City Specifications for bar screen repair was
ALLCO, LLC of Beaumont, Texas (Original Bid Tabulation attached as Exhibit A); and,
WHEREAS, the Interim City Manager gave emergency approval for the next lowest
bidder to assume the unfulfilled contract for bar screen repair due to possible risks to public
health and safety.

NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF PORT ARTHUR:
THAT, the City Council hereby authorizes the termination of the contract with Coastal
Pump Services, Inc. for bar screen repair; and,
THAT, the Interim City Manager of the City of Port Arthur is hereby authorized and
directed to execute on behalf of the City of Port Arthur a contract between the CITY OF PORT
ARTHUR and ALLCO, LLC of Beaumont, Texas for bar screen repair with a projected
budgetary impact of$31,715.00; and,
THAT, funding for this contract is provided for in the Utility Operations O&M budget
410-1256-532.42-00, Equipment Maintenance; and,
THAT a copy of the caption of this resolution be spread upon the minutes of the City
Council.

CONTRACT FOR Main Wastewater Treatment Plant Bar Screen Repair
THIS AGREEMENT, made this the day of , 2018 by and
between the City of Port Arthur, a municipal corporation organized under the laws of
the State of Texas, hereinafter called "OWNER" or"CITY", and ,
hereinafter called "CONTRACTOR".
WITNESSED: That for and in consideration of the payment terms, conditions
and agreements set forth herein, OWNER and CONTRACTOR agree as follows:
1. The term of this Agreement shall be for four (4) weeks from the date stated on
the Notice to Proceed. The City can terminate this contract at its convenience
which includes, but is not limited to, funding not being available in any budget
cycle within fifteen (15) days written notice.
2. During the term of this Contract, the CONTRACTOR will furnish at their own
expense all of the materials, supplies, tools, equipment, labor, and other services
necessary to connection therewith, excepting those supplies specifically not
required of CONTRACTOR in the Specifications.
3. The CONTRACTOR agrees to perform all the work described in their February 26,
2018 proposal attached hereto.
4. This Agreement shall be binding upon all parties hereto and their respective
heirs, executors, administrators, successors, and assigns.
5. IN WITNESS WHEREOF, the parties here to have executed, or caused to be
executed by their duly authorized officials, this Agreement in two (2) copies,
each of which shall be deemed an original of the date first written above.
