Background: Proposed Change Order No. 2 is a request of additional time due to delays occurring on May 2, 3, & 18 of 2018 due to AT&T utility installations and on June 6, 7, 8, 12, 13, 14, 15 of 2018 extra work was performed outside of the scope of the original contract; concrete repairs, removal and replacement of sidewalks, installation of handicap ramps and replaced storm sewer pipes and tie-ins.This work will not increase the total contract price. Change order No. 1 increased the contract term from 270 calendar days to 294 calendar days. This change order would increase the revised term of 294 calendar days to 304 calendar days and a new substantial completion date from June 28, 2018 to August 1, 2018. Budget Impact: There is no budget impact. A RESOLUTION AUTHORIZING THE CITY MANAGER TO EXECUTE CHANGE ORDER NO. 2 TO THE CONTRACT BETWEEN THE CITY OF PORT ARTHUR AND NORMAN HIGHWAY CONSTRUCTORS OF ORANGE, TEXAS FOR THE STORM SEWER IMPROVEMENTS ALONG WOODWORTH BLVD. FROM 7TH STREET TO THOMAS BLVD. INCREASING THE CONTRACT TERM BY 10 DAYS TO A NEW TOTAL OF 304 DAYS. WHEREAS, per Resolution No. 17-188, the City Council awarded a contract for the Storm Sewer Improvements along Woodworth Blvd. from Thomas Blvd. to 7th Street to Norman Highway Constructors of Orange, Texas in the projected budgetary impact amount of $1,186,728.00 and a term of 270 calendar days; and, WHEREAS, per Resolution No. 18-147, the City Council authorized Change Order No. 1, increasing the initial term of the contract from 270 to 294 calendar days; and, WHEREAS, proposed Change Order No. 2 is a request for a time extension of 10 days due to delays by a local utility contractor and extra work performed outside of the scope of the original contract; concrete repairs, removal and replacement of sidewalks, installation of handicap ramps and replaced storm sewer pipes and tie-ins. This work will not increase the total contract price; and, WHEREAS, Change Order No. 2 will increase the revised contract term from 294 to 304 calendar days, extending the substantial completion date from July 22, 2018 to August 1, 2018 herein deemed an appropriate action; now, therefore, P.R. 20328 Page 2 BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR: THAT, the facts and opinions in the preamble are true and correct; and, THAT, the City Manager of the City of Port Arthur is hereby authorized and directed to execute said Change Order No. 2 to the contract between the City of Port Arthur and Norman Highway Constructors of Orange, Texas; and, THAT, Change Order No. 2 increases the contract term from 294 calendar days to 304 calendar days and extends the substantial completion date from July 22, 2018 to August 1, 2018; and, THAT, a copy of the caption of this Resolution be spread upon the Minutes of the City Council. Job No. CPA-855 Dear Mr. Gutierrez: Attached is Change Order No. 2 for the Proposed City Street Strom Sewer Improvements along Woodworth Blvd. This change order includes the request for time extension of 10 days from delays and extra work performed from May to June. The Contractor completed work outside the original scope of the contract and encountered delays due to a local utility contractor. The added work includes full depth concrete repairs, remove and replace sidewalks. install handicap ramps and replace storm sewer pipe at an inlet tie-in. These items will be paid under existing items and will not increase the total contract price. We recommend the City of Port Arthur authorize the change to the contract by adding 10 calendar days to extend the contract end date from July 22, 2018 to August 1, 2018. I have attached Change Order No. 2 which modifies the contract to reflect this revision for your consideration and action.
