Introduction:
The intent of this Agenda Item is to seek the City Council's approval for the City Manager to enter
into the second renewal (final year) of the contract with DRC Emergency Services, LLC for
emergency environmental, disaster, and logistical response services in the event of an emergency
or a disaster.
•
Background:
The City Council per Resolution No. 16-215, authorized a contract with DRC Emergency
Services, LLC, with an option to renew for two additional one year periods. Per Resolution No.
17-182,the City Council authorized the first renewal (second year). The City would like to use the
option to renew for the second year(final year).
Budget Impact:
Funds will be provided for in the appropriate disaster/emergency recovery project accounts.
Recommendation:
It is recommended that City Council authorize the City Manager to enter into the second renewal
(final year) of the contract with DRC Emergency Services, LLC for emergency environmental,
disaster, and logistical response services in the event of an emergency or a disaster, as discussed
and/or outline above.

RESOLUTION NO.
A RESOLUTION AUTHORIZING THE SECOND RENEWAL
(FINAL YEAR) OF THE CONTRACT BETWEEN THE CITY
OF PORT ARTHUR AND DRC EMERGENCY SERVICES,
LLC OF GALVESTON, TEXAS FOR PROVISION OF
EMERGENCY ENVIRONMENTAL, DISASTER, AND
LOGISTICAL RESPONSE SERVICES IN THE EVENT OF
AN EMERGENCY OR DISASTER
WHEREAS, it is deemed in the best interest of the City of Port Arthur to have a service in
place for the provision of emergency environmental, disaster, and logistical response services in
the event of an emergency or a disaster; and,
WHEREAS, on August 9, 2016, the City Council approved Resolution number 16-215
authorizing the City Manager to enter into a one (1)year contract with two (2) additional one (1)
year renewals with DRC Emergency Services, LLC of Galveston, Texas; and
WHEREAS,pursuant to Resolution No. 17-182,the City Council authorized the first
renewal (second year) of the contract; and
WHEREAS,this will be second renewal (final year) of the contract with DRC Emergency
Services, LLC; and
WHEREAS,the City Council deems it is in the best interest of the City to renew the
contract.
NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF PORT ARTHUR:
Section 1. That the facts and opinions in the preamble are true and correct.
Section 2. That, the City Council hereby authorizes the second renewal (final year) of
the contract between DRC Emergency Services, LLC of Galveston, Texas and the City of Port
Arthur for the provision of emergency environmental, disaster, and logistical response services in
the event of an emergency or a disaster, in substantially the same form as attached hereto as
Exhibit"A".
Section 3. That, a copy of the caption of this Resolution be spread upon the Minutes of
the City Council.

The City of Port Arthur, Texas contract is set to expire on September 10, 2018. DRC Emergency Services,
LLC would like to take this opportunity to offer the City an extension to the contract between DRC
Emergency Services, LLC and the City of Port Arthur, TX dated September 11, 2017, for a period of one(1)
year. The terms and conditions in the original contract will remain in effect for the duration of this contract
expiring September 10, 2019.

CONTRACT TO PROVIDE EMERGENCY AND
DISASTER SUPPORT AND MANAGEMENT SERVICES
THIS AGREEMENT, made this day of , 2018, by and between the
City of Port Arthur, a municipal corporation organized under the laws of the State of Texas,
hereinafter called "OWNER" or "CITY" and DRC Emergency Services, LLC, a(n)
Corporation herein after called "CONTRACTOR".
WITNESSETH: That for and in consideration of the payment terms, conditions and agreements
set forth herein, OWNER and CONTRACTOR agree as follows:
1. The term of this Contract shall be from September 11, 2018 to September 10, 2019. This is
the second renewal (final year).
2. During the term of this Contract, the Contractor will furnish at his own expense all of the
materials, supplies, tools, equipment, labor and other services necessary to connection
therewith, excepting those supplies specifically not required of Contractor in the
Specifications.
3. The CONTRACTOR agrees to perform all the work described in the specifications and
contract documents and to comply with the terms in the amounts stated in bid document.
4. The term "Contract Documents" means and includes the following:
1) Agreement
2) Invitation to Bid *
3) General Information *
3) Specification *
11) Bid *
5) Notice of Award *
*These items were attached to the original letting contract. The agreement is only
included in this renewal.
5. This Agreement shall be binding upon all parties hereto and their respective heirs, executors,
administrators, successors and assigns.
6. IN WITNESS WHEREOF, the parties hereto have executed, or caused to be executed by
their duly authorized officials,this Agreement in(2 copies) each of which shall be deemed an
original on the date first written above.
