ORDINANCE NO.
AN ORDINANCE AMENDING CHAPTER 78 (PERSONNEL), ARTICLE
II (PERSONNEL POLICY), DIVISION 3 (APPOINTMENT AND
SEPARATION), SECTION 78-108(b) OF THE CODE OF
ORDINANCES OF THE CITY OF PORT ARTHUR AS IT PERTAINS TO
REEMPLOYMENT
WHEREAS, Section 78-108(b) of the existing personnel policy states as follows:
"Sec. 78-108. - Reemployment.
(b) A former employee who is re-employed shall be re-employed as a new
probationary employee and shall lose all prior service credit including, but
not limited to, service credit in salary range for step pay purposes and
seniority. Notwithstanding any other provisions of the personnel policy, a
regular former employee who was separated in good standing and who is
reinstated within 60 days from the date of separation, shall be
immediately entitled to group insurance as other regular employees as
delineated in section 78-265.
WHEREAS, the Interim City Manager desires to change Section 78-108(b) as it
pertains to employees who have vested with the City (at least 10 years of credited
TMRS service) and separated in good standing who are re-employed, as delineated in
Exhibit "A" attached hereto.
NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF PORT ARTHUR, TEXAS:
Section 1. That the facts and opinions in the preamble are true and correct.
Section 2. That Chapter 78 (Personnel), Article II (Personnel Policy), Division
3 (Appointment and Separation), Section 78-108(b) of the Code Of Ordinances of the
City Of Port Arthur as it pertains to reemployment is hereby amended as delineated in
Exhibit "A" attached hereto.
Section 3. That this being an Ordinance that does not require publication, this
Ordinance shall become effective immediately.
Section 4. That all Ordinances in conflict herewith are herein repealed to the
extent of conflict.
Section 5. That the Personnel Policies shall be amended accordingly.
Section 6. That a copy of the caption of this Ordinance shall be spread upon
the Minutes of the City Council.

"Sec. 78-108. - Reemployment.
(b) A former employee who is re-employed shall be re-employed as a new
probationary employee and shall lose all prior service credit including, but
not limited to, service credit in salary range for step pay purposes and
seniority. Notwithstanding any other provisions of the personnel policy, a
regular former employee who was separated in good standing and who is
reinstated within 60 days from the date of separation, shall be
immediately entitled to group insurance as other regular employees as
delineated in section 78-265. However, employees who have vested with
the City (at least 10 years of credited TMRS service) and separated in
good standing may be re-employed as a probationary employee. If said
employee(s) successfully completes his/her probationary period, then all
accrual rates, benefits and entitlements in effect prior to date of
separation shall be restored.
