Williams, Safety& Risk a it-,;, RE: A Resolution Approving a Property Damage Settlement in the Amount of$5,574.92 for Damages to Contents in Library Storage Building Nature of the request: On August 30, Hurricane Harvey struck the City of Port Arthur, resulting in flood damage to contents in a storage building at the Port Arthur Public Library (4615 9th Avenue). Staff Analysis, Considerations: The City has Physical Damage insurance coverage through Texas Municipal League Intergovernmental Risk Pool (TML) with a $1,000.00 deductible. TML has offered the City a settlement of$5,574.92, less the $1,000.00 deductible, making the final settlement offer $4,574.92 (Exhibit "A" attached). This amount is sufficient to cover all estimated property damages to the contents in the storage building. If additional damages are discovered, TML may issue a supplemental payment. Recommendation: I recommend approval of Proposed Resolution No. 20397 authorizing the property damage settlement against TML for damage sustained to the contents in the storage building at the Port Arthur Public Library. TML has offered to settle the claim for $5,574.92, less the $1,000.00 deductible, making the final settlement offer $4,574.92. This is considered a fair and reasonable settlement. Budget Considerations: The funds received will be deposited in the General Fund Insurance Proceeds Account#001-0000-369.85-00. "Remember we are here to serve the Citizens of Port Arthur" P.R. A RESOLUTION AUTHORIZING THE CITY MANAGER TO EXECUTE THE SETTLEMENT OF A CLAIM IN THE AMOUNT OF $5,574.92 MADE AGAINST TEXAS MUNICIPAL LEAGUE INTERGOVERNMENTAL RISK POOL (TML) AS A RESULT OF THE FLOOD DAMAGE CONTENTS IN A STORAGE BUILDING AT THE PORT ARTHUR PUBLIC LIBRARY AS A RESULT OF HURRICANE HARVEY (AUGUST 30, 2017) WHEREAS, on August 30, 2017, Hurricane Harvey struck the City of Port Arthur, resulting in flood damage to the contents of a storage building at the Port Arthur Public Library (4615 9th Avenue) as listed in Attachments "A" (attached); and, WHEREAS, as a result of the damage, a claim was filed with Texas Municipal League Intergovernmental Risk Pool (TML); and, WHEREAS, TML has offered to settle the claim in the amount of $5,574.92, less the $1 ,000.00 deductible, which has been determined to be a fair and reasonable settlement. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PORT ARTHUR, TEXAS: Section 1. That, the facts and opinions in the preamble are true and correct. Section 2. That, the City Manager is hereby authorized to execute settlement in the amount of $5,574.92, less the $1,000.00 deductible, for the claim against Texas Municipal League Intergovernmental Risk Pool (TML). This amount is based on an estimated cost for flood-related repairs; therefore, if additional flood-related costs are incurred, Texas Municipal League Intergovernmental Risk Pool may issue a supplemental payment.
