RE: Proposed Resolution No. 20417—Ratification of Chiller Repairs
Nature of the Request:
Due to apparent failure and rupture of the heat exchanger bundle at the Water Treatment Plant,
water and refrigerant mixed, rendering the entire unit inoperable. It is more cost effective to
replace the entire unit. This was an emergency which required corrections as soon as possible.
However, there was no immediate threat to the health and welfare of our citizens, but the
conditions were so uncomfortable that mistakes could possibly be made due to a lack of
concentration by the operators, because of the heat.
The Utilities Department is seeking ratification of replacement of the chiller unit through ABM
Building Services, LLC of Houston, Texas. ABM Building Services, LLC of Houston, Texas
submitted a buyboard quote, #552-17, of$44,472.00. Funding is available in Water Utilities 0 &
M Budget, Account No. 410-1252-532.32-00, Building Maintenance.
Staff Analysis, Considerations:
None.
Budtiet Considerations:
This project will be charged to Water Utilities 0 & M Budget, Account No. 410-1252-532.32-
00, Building Maintenance.
Recommendation:
I recommend that the City Council approve Proposed Resolution No. 20417 to ratify the chiller
replacement in the amount of$44,472.00 due to the rupture of the heat exchanger bundle at the
Water Treatment Plant.

A RESOLUTION RATIFYING THE REPLACEMENT OF A
CHILLER UNIT WITH ABM BUILDING SERVICES, LLC OF
HOUSTON, TEXAS THROUGH BUYBOARD CONTRACT NO.
552-17, DUE TO A RUPTURE IN THE HEAT EXCHANGER
BUNDLE AT THE WATER PURIFICATION PLANT IN THE
AMOUNT OF $44,472.00; FUNDING IS AVAILABLE IN WATER
UTILITIES ACCOUNT NO. 410-1252-532.32-00, BUILDING
MAINTENANCE.
WHEREAS,a rupture of the heat exchanger rendered the entire unit inoperable; and,
WHEREAS, it is more cost effective to replace the unit instead of making repairs; and,
.WHEREAS,this was an_emergency which required corrections as soon as possible; and,
WHEREAS, prolonged exposure to heat can cause excessive fatigue, making chemical
calculations difficult, thereby potentially endangering the public; and,
WHEREAS, pursuant to Resolution No. 02-341, the City of Port Arthur entered into an
interlocal agreement for cooperative purchasing with the Buyboard Cooperative Purchasing
Program("Buyboard"); and,
WHEREAS,City staff has solicited a BUYBOARD quote, #552-17, for a Chiller Unit as
delineated in our Purchasing Policy; and,
WHEREAS, ABM Building Services, LLC of Houston, Texas through Buyboard,
provided the quote attached as EXHIBIT"A", which meets our specifications; and,
WHEREAS, it is further authorized pursuant to Section 252.022(a)(2), of the Texas
Local Government Code, a procurement necessary to preserve or protect the public health or
safety of the municipality's residents. This procurement is also authorized pursuant to Section
252.022(a)(3), of the Texas Local Government Code, because of unforeseen damage to public
machinery, equipment, or other property.

NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF PORT ARTHUR:
THAT,the facts and opinions in the preamble are true and correct; and,
THAT, the City Council of the City of Port Arthur hereby ratifies the replacement of the
chiller at the Water Treatment Plant by ABM Building Services, LLC of Houston, Texas for the
amount of$44,472.00, as delineated in Exhibit"A".
THAT, a copy of the caption of this Resolution be spread upon the Minutes of the City
Council.
